Television Drama Management Department Notice Concerning Standardizing Rebroadcast Management of Domestic Television Dramas from Before the Implementation of the Distribution Permit System

All provincial, autonomous region and municipal radio film and television bureaus (offices), CCTV, the PLA General Political Department’s Propaganda Division:

Since 1 November 1998, the State has implemented a distribution permit system for television dramas, and formulated provisions over television drama distribution and broadcast. Article 4 of the “Television Drama Examination Management Regulations” (SARFT Decree no. 40) thereafter clearly provides: “Television Dramas not having obtained the “Television Drama Distribution Permit”, may not be distributed, broadcast, imported or exported. In view of the fact that demand exists for the continued distribution, broadcast, export, etc., of television dramas of which the production was finished before the distribution permit system was implemented, to standardize management, hereby, the following is notified:

 

I, Concerning television dramas never having obtained distribution permits, for continued distribution, broadcast, export, etc., a report must be filed to and a television drama distribution permit must be obtained from the local administrative radio, film and television entity. All provincial-level administrative radio, film and television entities shall according to the present examination procedure and requirements, strictly guard the pass over content, and ensure the proper orientations.

II, All provincial-level administrative radio, film and television entities, when accepting this sort of television drama, must carefully check the corresponding application materials. After the application materials are all complete, and re-examination is passed, a distribution permit is issued for that television drama, using the permit number of the year of issue permit. Also, on the place of the last empty line of the permit, it shall indicate: “Notice: this drama was finished in the year xxxx, and is hereby re-examined for permit issuance”.

III, All provincial-level television drama management entities shall every month, at the time of reporting filing materials of television dramas already issued a permit, report the list of this sort of programmes having obtained a permit through re-examination, and not calculate this into the annual new drama production amount.

IV, Please transmit this document to all television stations in your jurisdiction, and speedily conduct a one-time check, if it is discovered that broadcast of this sort of television drama is organized without permit, it shall be corrected immediately and examination formalities shall be conducted according to regulations.

广电总电视剧管理司关于制度施前的电视剧重播管理的通知

 

各省、自治区、直辖市广播影视局(厅),中央电视台,总政宣传部艺术局:
  自1998年11月1日始,国家对电视剧实施发行许可证制度,并对电视剧的发行、播出做出相关规定。此后的《电视剧审查管理规定》(广电总局令第40号)第四条明确规定:”未取得《电视剧发行许可证》的电视剧,不得发行、播出、进口、出口。”鉴于发行许可证制度实施前已制作完成的电视剧存在继续发行、播出、出口等需求,为规范管理,现通知如下:
  一、从未取得过发行许可证的电视剧,如果需要继续发行、播出、出口等,必须向所属的省级以上电视剧管理部门报审并获得电视剧发行许可证。管理部门需依照审查程序,对内容严格把关,确保导向正确。
  二、电视剧管理部门在受理此类电视剧时,要仔细核对相关的报审材料。在送审材料齐备、重新审查通过后,为该剧核发发行许可证,使用发证当年的许可证编号。并在许可证最后一段空行处注明”备注:该剧完成时间××××年,现重新审查发证。”
  三、各省级电视剧管理部门每月向总局上报已发证电视剧备案材料时,将此类经重审核发许可证的剧目单列上报,不计入当年的新剧产量。
  四、请各省级管理部门转发辖区所有电视台,并迅速进行一次检查,如有未经许可即安排播放的此类电视剧,应即时纠正并按规定办理审查发证手续。
