Notice Concerning Strengthening and Improving Network Music Content Examination Work

All provincial, autonomous region and municipal culture offices (bureaus) Xinjiang Production-Construction Corps Cultural Bureau, Beijing Municipality, Tianjin Municipality, Shanghai Municipality, Chongqing Municipality Cultural Market Administrative Enforcement Teams:

In order to promote the network music development, standardize network music business, realistically implementing the “Ministry of Culture Some Opinions Concerning Network Music Development and Management”, according to the “Information Network Dissemination Rights Protection Regulations”, “Provisional Internet Culture Management Regulations” (hereafter simply named “Provisional Regulations”) and the “Ministry of Culture Some Opinions Concerning Network Music Development and Management” (MCMD No. [2006]32), items relevant to strengthening and improving network music content examination are notified as follows:

I, Management subjects and management objects

(1) Network music refers to music works using digitalized methods, through networks such as the Internet, mobile communications networks, fixed communications networks, etc., including songs, compositions and music videos with pictures assisting music, etc.

(2) To engage in network music work business activities such as production, issue, dissemination (including the method of direct provision of music work links), import, etc., it is necessary to be a commercial Internet culture work unit approved for establishment by the Ministry of Culture (hereafter simply named “commercial work unit”).

(3) Commercial work units dealing in network music works must report to the Ministry of Culture to conduct content examination or filing.

II, Imported network music work content examination

(4) Imported network music works refers to network music works of which the original copyright holder is a foreign natural person or legal person and other organizations. Imported network music works may only after passing through Ministry of Culture content examination, be put into operation.

(5) Imported network music works reporting work units must be the directly licensed person in Chinese territory for said network music work. Directly licensed person refers to commercial work units having directly acquired the exclusive and complete information network dissemination rights or agency rights for the Chinese territory (hereafter simply named “importing work units”).

Chinese Hong Kong SAR, Macao SAR and the Taiwan Area network music works will be reported with reference to imported network music works.

(6) Network music work import contracts (agreements) concluded between importing work units and foreign network music copyright holders must conform to the following provisions:

1. the licence term of imported network music shall be more than one year (including one year);

2. the objects of the contract (agreement) are the information network dissemination rights for music works;

3. the contract (agreement) shall conform to the relevant provisions of laws and regulations such as the “Contract Law” and “Copyright Law” of our country;

4. the contract (agreement) shall clearly indicate that it may only become effective for implementation after passing through Ministry of Culture content examination.

(7) Importing work units, when reporting imported network music must provide the following materials, and are responsible for the authenticity of the provided materials:

1. an application form for imported network music examination (electronic version);

2. the network cultural business permit, business licence (photocopies);

3. lyrics in the original language and translated of the reported songs (electronic version);

4. the network music import contract (agreement), certification material of the original copyright and the letter of authorization (photocopies);

5. other materials needed for content examination.

(8) Imported network music work reporting procedure.

1. The electronic versions of importing work unit reporting materials shall be reported through the “Ministry of Culture Network Music Reporting and Filing Software”, (hereafter simply named “Reporting and Filing Software”, download address: wlyy.mcprc.gov.cn). The relevant information will be filled out according to the requirements of the “Reporting and Filing Software”, and will be transmitted to the Ministry of Culture network music examination acceptance system. Materials such as the required paper documents, CD’s, etc. are sent to the Ministry of Culture by registered mail.

2. Where the reported materials are complete, the Ministry of Culture will accept them, and within 20 working days of acceptance (not including the necessary time for expert examination and comment), will formulate a decision of approval or non-approval on the basis of the expert examination opinion. To those approved, an “Imported Network Music Work Approval Sheet” will be issued, to those not approved, the reasons shall be stated.

3. To music works of which content examination has exceptional time limit requirements, importing work units may conduct an application through the fast channel function provided in the “Reporting and Filing Software”, the Ministry of Culture will formulate a decision of approval or non-approval within 3 working days of acceptance.

4. Of imported music works already having passed content examination of other entities, and being officially published and distributed, the importing work unit must provide the approval documents of the corresponding entity, after Ministry of Culture verification, these may be disseminated in the form of network music, and the content examination procedure can be simplified.

(9) Network music works already approved for import, which need to be imported, again after the licence term expires, must conduct import formalities again. For those of which import is decided to be stopped within the licence term, the importing work unit must report to the Ministry of Culture for revocation of its approval document number.

(10) When transferring the licence of network music works already approved for import, the original importing work unit must within 20 days after the act of licence transfer report to the Ministry of Culture for filing, the licensed commercial work unit does not need to report separately. At the time of filing, the following materials must be provided:

1. an application form for imported network music examination (electronic version);

2. the original Ministry of Culture approval document (photocopy);

3. the licensed commercial work unit’s network culture business permit and business licence (photocopies);

4. the licence transfer contract (agreement) (photocopy);

5. other materials necessary for reporting and filing.

(11) Imported network music works not having undergone content examination before printing and issue of this Notice, must be reported for examination to the Ministry of Culture before 31 December 2009 according the requirements of this Notice.

III, Domestic network music filing

(12) For domestic network music works, a filing system is implemented. Network music commercial work units shall within 30 days after officially operating report to the Ministry of Culture for filing.

(13) Commercial work units must provide the following materials, and are responsible for the authenticity of the provided materials:

1. an application form for domestic network music filing (electronic version);

2. the network culture business permit and business licence (photocopies);

3. the lyrics of the reported song (electronic version);

4. the domestic network music use contract (agreement), certification material of the original copyright and the letter of authorization (photocopies);

5. other materials needed for content examination.

(14) Domestic network music filing procedure.

1. The electronic versions of importing work unit reporting materials shall be reported through the “Reporting and Filing Software”. The relevant information will be filled out according to the requirements of the “Reporting and Filing Software”, and will be transmitted to the Ministry of Culture network music examination acceptance system. Materials such as the required paper documents, CD’s, etc. are sent to the Ministry of Culture by registered mail.

2. Where the reported materials are complete, the Ministry of Culture will accept them, and within 10 working days of acceptance, will issue a “Domestic Network Music Work Approval Sheet” will be issued, to those not approved, the reasons shall be stated.

3. Of domestic music works already officially published and distributed, the commercial work unit may provide the corresponding publication number, the Ministry of Culture will file it after verification and simplify the filing procedure.

IV, Standardizing network music operation activities

(15) Commercial work units shall strictly according to the requirements of the “Provisional Regulations”, establish a network music content self-application system, set up special entities to be responsible for music content self-application examination. Commercial work units providing network users network music uploading services such as editing and performance, etc., must strengthen examination, and guarantee its legality.

(16) Commercial work units must indicate on a clear location on the network music work page interface, the approval number or filing number, and may not modify other information such as network music work names approved or filed by the Ministry of Culture without authorization, and may not add, delete or modify network music work content without authorization.

V, strengthening network music content supervision

(17) All localities’ administrative culture entities must strengthen management over network music commercial work units in their jurisdictions, must timely follow management over the music content in the business environment, and investigate and prosecute commercial work units engaging in unlawful network music business activities and providing unlawful network music works according to the law.

It is hereby notified.

文化部关于加强和改进网络音乐内容审查工作的通知

各省、自治区、直辖市文化厅(局),新疆生产建设兵团文化局,北京市、天津市、上海市、重庆市文化市场行政执法总队:

为推动网络音乐发展,规范网络音乐经营,切实落实《文化部关于网络音乐发展和管理的若干意见》,根据《信息网络传播权保护条例》、《互联网文化管理暂行规定》(以下简称《暂行规定》)、《文化部关于网络音乐发展和管理的若干意见》(文市发[2006]32号),现就加强和改进网络音乐内容审查工作有关事项通知如下:

一、管理主体和管理对象

(一)网络音乐是指用数字化方式通过互联网、移动通信网、固定通信网等信息网络,以在线播放和网络下载等形式进行传播的音乐产品,包括歌曲、乐曲以及有画面作为音乐产品辅助手段的MV等。

(二)从事网络音乐产品的制作、发布、传播(含直接提供音乐产品链接方式)、进口等经营活动,须是经文化部批准设立的经营性互联网文化单位(以下简称“经营单位”)。

(三)经营单位经营网络音乐产品,须报文化部进行内容审查或备案。

二、进口网络音乐内容审查

(四)进口网络音乐产品是指原始版权为境外自然人、法人和其它组织所拥有的网络音乐产品。进口网络音乐产品,须经文化部内容审查通过后,方可投入运营。

(五)进口网络音乐产品报审单位须为该网络音乐产品在中国内地的直接被授权人。直接被授权人是指直接获得该网络音乐产品的独家且完整的在中国内地的信息网络传播权或代理权的经营单位(以下简称“进口单位”)。

中国香港、澳门特别行政区和台湾地区的网络音乐产品参照进口网络音乐产品报审。

(六)进口单位与境外网络音乐版权人签订的网络音乐进口合同(协议)须符合以下规定:

1.进口网络音乐的授权期应在一年以上(含一年);

2.合同(协议)标的物为音乐产品的信息网络传播权;

3.合同(协议)应符合我国《合同法》、《著作权法》等法律法规的有关规定;

4.合同(协议)应注明在经文化部内容审查通过后方可生效执行。

(七)进口单位报审进口网络音乐时须提供以下材料,并对所提供材料的真实性负责:

1.进口网络音乐审查申请表(电子版);

2.网络文化经营许可证、营业执照(复印件);

3.报审歌曲的原文和译文歌词(电子版);

4.网络音乐进口合同(协议)、原始版权证明材料和授权书(复印件);

5.内容审查所需的其它材料。

(八)进口网络音乐产品报审程序。

1.进口单位报审材料中的电子版通过“文化部网络音乐报备软件”(以下简称报备软件,下载网址:wlyy.mcprc.gov.cn)进行报审。按照“报备软件”的要求填写相关信息,并上传到文化部网络音乐审查受理系统。需提交的纸制文件、CD等材料挂号寄至文化部。

2.报审材料齐全的,文化部予以受理,并在受理后20个工作日内(不包括专家评审所需时间)根据专家审查意见做出批准或者不批准的决定。批准的核发《进口网络音乐产品批准单》,不批准的说明理由。

3.对内容审查有特殊时限要求的音乐产品,进口单位可通过“报备软件”提供的快速通道功能进行申请,文化部在受理后3个工作日内做出批准或者不批准的决定。

4.对已通过其他相关部门内容审查,并正式出版发行的进口音乐产品,进口单位须提供相关部门的批准文件,文化部核实后准予以网络音乐形式进行传播,并对内容审查程序予以简化。

(九)已批准进口的网络音乐产品在授权期满后需要再次进口的,须重新办理进口手续。授权期内决定终止进口的,进口单位须报文化部撤销其批准文号。

(十)对已批准进口的网络音乐产品在国内进行转授权时,须由原进口单位在转授权行为发生后20日内报文化部备案,被授权的经营单位不再另行报审。备案时须提供以下材料:

1.进口网络音乐产品转授权备案申请表(电子版);

2.文化部原批准文件(复印件);

3.被授权经营单位网络文化经营许可证和营业执照(复印件);

4.转授权合同(协议)(复印件);

5.报备所需的其它材料。

(十一)在本通知印发之日前未经内容审查的进口网络音乐产品,须按照本通知的要求在2009年12月31日前向文化部报审。

三、国产网络音乐备案

(十二)国产网络音乐产品实施备案制度。网络音乐经营单位应在正式运营后30日内报文化部备案。

(十三)经营单位须提供以下材料,并对所提供材料的真实性负责:

1.国产网络音乐备案申请表(电子版);

2.网络文化经营许可证和营业执照(复印件);

3.报备歌曲的歌词(电子版);

4.国产网络音乐使用合同(协议)、原始版权证明材料和授权书(复印件);

5.备案所需的其它材料。

(十四)国产网络音乐备案程序。

1.经营单位报审材料中的电子版通过“报备软件”进行报备。相关信息按照“报备软件”的提示要求进行填写,并上传至文化部网络音乐审查受理系统。需提交纸制文件、CD等材料的,挂号寄至文化部。

2.备案材料齐全的,文化部予以受理;并在受理后10个工作日内,核发《国产网络音乐产品备案表》。

3.对已正式出版发行的国产音乐产品,经营单位可提供相应的出版物版号,文化部核实后予以备案并简化备案程序。

四、规范网络音乐经营行为

(十五)经营单位应当严格按照《暂行规定》的要求,建立网络音乐内容自审制度,设置专门部门负责音乐内容的自审自查。经营单位提供网民编创和表演等网络音乐上传服务的,要加强审查,保障其合法性。

(十六)经营单位须在网络音乐产品页面显著位置标注其批准文号或备案文号,不得擅自变更经文化部批准或备案的网络音乐产品的名称等其他信息,不得擅自增删或变更网络音乐产品内容。

五、加强网络音乐内容监管

(十七)各地文化行政部门要加强对属地内的网络音乐经营单位的管理,对运营环节中的音乐内容要及时跟踪监管,对从事违法网络音乐经营活动和提供违法网络音乐产品的经营单位依法查处。
