The “Supplementary provisions to the ‘Foreign-invested Books, Newspapers and Periodicals Retail Enterprises Management Rules’ (2)” were passed on 10 July 2009 at the 2nd executive meeting of the General Administration of Press and Publications and the Ministry of Commerce, are hereby promulgated, and shall take effect on 1 October 2009

Supplementary provisions to the “Foreign-invested Books, Newspapers and Periodicals Retail Enterprises Management Rules” (2)

In order to stimulate an even closer trade relationship between Hong Kong, Macau and the Mainland, encourage Hong Kong and Macau service suppliers to establish business enterprises on the Mainland, according to the “‘Mainland and Hong Kong Arrangements Concerning Establishing Even Closer Trade Relations’ Supplementary Agreement Six” and the “‘Mainland and Macau Arrangements Concerning Establishing Even Closer Trade Relations’ Supplementary Agreement Six” approved by the State Council, hereby, the following supplementary provisions are made to the “Foreign-invested Books, Newspapers and Periodicals Retail Enterprises Management Rules” (General Administration of Press and Publication, Ministry of Trade and Economic Cooperation Decree No. 18)

I, The base registered capital requirements of Hong Kong and Macao service providers establishing enterprises engaging in publications sales, shall be implemented comparable to Mainland enterprises.

II, Hong Kong and Macau service providers in these Regulations shall respectively conform to the definition of “service provider” and the requirements of corresponding provisions in the “Mainland and Hong Kong Arrangements Concerning Establishing Even Closer Trade Relations” and the “Mainland and Macau Arrangements Concerning Establishing Even Closer Trade Relations”

III, To Hong Kong and Macau service providers investing in other matters in the book, newspaper and periodical retail area in the Mainland, the “Foreign-invested Books, Newspapers and Periodicals Retail Enterprises Management Rules” shall still be implemented.

IV, These Regulations take effect on 1 October 2009.

关于《外商投资图书、报纸、期刊分销企业管理办法》的补充规定(二)

为促进香港、澳门与内地建立更紧密经贸关系,鼓励香港、澳门服务提供者在内地设立商业企业,根据国务院批准的《〈内地与香港关于建立更紧密经贸关系的安排〉补充协议六》及《〈内地与澳门建立更紧密经贸关系的安排〉补充协议六》,现就《外商投资图示、报纸、期刊分销企业管理办法》(新闻出版总署、对外贸易经济合作部令第18号)做出如下补充规定:

一、对香港、澳门服务提供者在内地设立从事出版物分销的企业的最低注册资本要求,比照内地企业实行。

二、本规定中的香港、澳门服务提供者应分别符合《内地与香港关于建立更紧密经贸关系的安排》及《内地与澳门建立更紧密经贸关系的安排》中关于”服务提供者”定义及相关规定的要求。

三、香港、澳门服务提供者在内地投资图书、报纸、期刊分销领域的其他事项,仍按照《外商投资图书、报纸、期刊分销企业管理办法》执行。

四、本规定子2009年10月1日起施行。
