I, Definition of investment subjects

The “Ministry of Culture Cultural Industry Investment Guidance Catalogue” (hereafter named “Guidance Catalogue”) only applies to domestic investment subjects. Foreign investing subjects investments in the cultural entities shall be implemented according to the “Foreign Investment Industry Guidance Catalogue”

Domestic investment subject includes State investment subjects and non-state investment subjects.

State investment subject refers to all levels of government and their authorized State asset investment organs, State-owned or State-controlled enterprises, other State-owned economic organizations.

Non-State investment subjects refers to collective enterprises, private enterprises and other non-State economic groups and individuals.

II, Classification principles

The “Guidance Catalogue” is divided into the encouraged category, the permitted category, the limited category and the prohibited category, according to the real circumstances of our country’s cultural industry and the development orientation put forward in the “Cultural Industry Promotion Plan”.

The encouraged category and limited category industries are listed in the “investment catalogue”.

Prohibited category industries are industries prohibited by State laws and relevant regulations. Sectors not part of the encouraged category, limited category and prohibited category, except where State regulations provide otherwise, are all permitted category cultural sectors.

The permitted category  and prohibited category cultural sectors are for now not listed in the “Guidance Catalogue”

(1) Encouraged category principles

The encouraged category is mainly aimed at sectors having desirable economic and social effects, a good market prospect, exceptional connected impetus function, a high technological content and added value, that are beneficial to sector structural optimization and upgrade, that are able to effectively expand internal demand, increase jobs, expand cultural product export.

(2) Limited category principles

The limited category is mainly aimed at sectors conform to trade entry requirements, but in which the State provides for a planned, proportional and progressive development, as well as sectors having investment ratio requirements.

III, Requirements relating to cultural industry investment

For investments in all categories of sectors in the “Guidance Catalogue”, all sector required to be examined and approved before conducting operations, shall report for approval beforehand with the advance permit organ according to relevant State policy regulations.

Investment in cultural products and services shaped by the cultural industry, may not contain the following content; endangering national unity, sovereignty and territorial integrity, endangering State security, or damaging State reputation and interests; inciting ethnic hatred, ethnic discrimination, damaging ethnic traditions, harming ethnic feelings, violating the unity of the ethnicities, violating religious policies, throwing market order into disorder, persecuting social stability; endangering public social virtues or the excellent ethnic cultural traditions; propagating obscenity, sex, heresy, superstition or playing up violence; humiliating or slandering other persons; violating other persons’ lawful rights and interests.

IV, After promulgation of the “Guidance Catalogue”, the encouraged category cultural sectors shall enjoy corresponding preferential policies.

V, This catalogue takes effect on the date of promulgation. Henceforth it shall be adjusted or revised according to relevant State policies, laws and regulations and the development situation of the cultural industry.

VI, The responsibility for interpreting this Catalogue falls to the Ministry of Culture.

文化部出台《文化产业投资指导目录》

人民网北京9月24日电  为贯彻党的十七大关于大力发展文化产业、繁荣文化市场的战略任务,落实《文化产业振兴规划》关于积极吸收社会资本进入文化产业领域的要求,方便国内投资主体了解文化产业发展方向,文化部于近期制定并发布了《文化部文化产业投资指导目录》。以下为《文化部文化产业投资指导目录》全文:

说明

一、投资主体的界定

《文化部文化产业投资指导目录》(下称《指导目录》)只适用于国内投资主体。国外投资主体投资文化产业按照《外商投资产业指导目录》执行。

国内投资主体包括国有投资主体和非国有投资主体。

国有投资主体是指各级政府及其授权国有资产投资机构、国有或者国有控股企业、其他国有经济组织。

非国有投资主体是指集体企业、私营企业、其他非国有经济组织和个人。

二、分类原则

《指导目录》根据我国文化产业发展的现实情况和《文化产业振兴规划》提出的发展方向,划分为鼓励类、允许类、限制类和禁止类。

鼓励类和限制类产业列入《指导目录》。

禁止类产业为国家法律法规和有关政策明令禁止的产业。不属于鼓励类、限制类和禁止类的产业,除国家另有规定外均为允许类文化产业。

允许类、禁止类文化产业暂不列入《指导目录》。

(一)鼓励类的原则

鼓励类主要是针对具有良好的经济和社会效益,市场前景好,关联带动作用突出,技术含量和附加值高,有利于产业结构优化升级,能够有效地扩大内需,增加就业,扩大文化产品出口的产业。

(二)限制类的原则

限制类主要针对符合行业准入条件,但国家规定需有计划按比例逐步发展的产业以及有投资比例要求的产业。

三、文化产业投资的有关要求

投资《指导目录》的各类产业,凡要求进行前置审批的产业应按照国家有关政策法规到前置许可机关先行报批。

投资文化产业形成的文化产品和服务,不得含有下列内容:违反宪法基本原则;危害国家统一、主权和领土完整,危害国家安全,或者损害国家荣誉和利益;煽动民族仇恨、民族歧视,侵害民族风俗习惯,伤害民族感情,破坏民族团结,违反宗教政策;扰乱社会秩序,迫害社会稳定;危害社会公德或者民族优秀文化传统;宣扬淫秽、色情、邪教、迷信或者渲染暴力;侮辱或者诽谤他人,侵害他人合法权益。

四、《指导目录》公布后,对于鼓励类文化产业,享受相应的优惠政策。

五、本目录自公布之日起施行。今后将根据国家有关政策法规和文化产业发展情况进行调整或修订。

六、本目录由文化部负责解释。
