On 4 February, SARFT issued the “Notice Concerning Improving and Completing Film Script (Outline) Filing and Film Examination Work” to all provincial, autonomous region and municipal radio, film and television bureaus, the Xinjiang Production-Construction Corps Radio and Television Bureaus, all SARFT organs and departments, directly subordinate work units and all film production work units nationwide, the notice said that in recent years, under the close concern of the Party Central Committee, with the vigorous support of all levels of government, through the untiring diligence of all film workers, the incessant development of film industrialization has been pushed forward, in film creation and film markets, a desirable development situation has emerged. At present, according to the unified deployment of the Central Committee, the national film management system planning work has already completely reached the goals, this provides desirable conditions for rationalizing film management systems, accelerating film industrialization’s even better and quicker development. In order to fully give rein to the vigour of provincial-level administrative radio, film and television entities (hereinafter simply named “provincial radio, film and television entities”, even better carry out film management functions, standardize administrative examination and approval procedures and segments, and provide an even more convenient and highly efficient service to film production enterprises, according to the “Film Management Regulations” and the “Film Script (Outline) Filling and Film Management Regulations” (SARFT decree no. 52), the improvements and completions of the film script (outline) filing and film examination management work are notified as follows:
I, Establishing and completing management systems
Film script (outline) filing and film examination are key to guaranteeing the flourishing and correct guidance of film creation, and are basic and important segments in film management work. SARFT promulgated the “Film Script (Outline) Filling and Film Management Regulations” in 2006. These Regulations have been implemented more than three years ago, and have lead to a standardizing and guaranteeing function for the whole film creation and production. All provincial-level radio, film and television entities must earnestly sum op their experiences, give high regard to and strengthen this management segment, establish and perfect film management and film examination structures, guarantee that implementation of personnel, technological equipment, etc., meets goals as soon as possible, and guarantee this work to be regularly carried out.
II, Further guaranteeing management responsibility
SARFT is responsible for national film script (outline) filing and film examination management work, SARFT film examination organs are responsible for final film examination.
All provincial-level radio, film and television entity are responsible for film script (outline) filing and initial film examination management work in their administrative areas, and to establish corresponding management organs and film examination organs, to be concretely responsible for film script (outline) filing reporting, reply and initial film examination and reporting in their administrative areas. Provincial-level radio, film and television entities and film examination organs implementing territorial examination (Jilin, Guangdong, Zhejiang, Shaanxi, Hubei and Beijing) are responsible for film script (outline) reporting and reply, and initial film examination and part of final film examination in their administrative areas.
(1) Film script (outline) filing
1, Where film producing work units (including all sorts of film and television culture companies established through approval with industry and commerce administration, likewise hereinafter) produce films, the film script (outline) shall be delivered by the first producing work units to the provincial level radio, film and television entity of the locality of registration with industry and commerce administration before filming for filing, the provincial level radio, film and television entity makes a decision within the period provided in the “Administrative Permission Law” and reports to SARFT, and after SARFT promulgates the filing result, a “Film Script (Outline) Filing Receipt” shall be provided to the film production work units holding the “Film Production Permit”, other film production work units shall be issued a “Film Production Permit (Single Film), where filming is permitted after revision or filming is not permitted, the reasons shall be explained and the production work unit shall be notified in writing.
2, For all plots with main content and main roles involving aspects such as State security, foreign relations, religion, military affairs, public security, judicature, history and famous cultural persons, sensitive historical incidents, etc., (hereinafter named special subjects), the provincial level radio, film and television entity may only file after seeking opinions from the corresponding controlling authority.
3, Shooting major revolutionary and history theme films, major historical documentaries, Sino-foreign cooperative films, after the provincial-level radio, film and television entity examines the film script, will be reported to SARFT to conduct project establishment examination and approval according to relevant management regulations.
4, Film production work units subordinate to Central Committee and State organs (the Army) shooting films, must directly submit the film script (outline) to SARFT for filing or project establishment examination and approval.
5, All provincial-level radio, film and television entities shall timely report agreed film script (outline) filing to SARFT, the content containing: film name, filing work unit (contact person, telephone number), full name of the scriptwriter (real name), story synopsis (ca. 300 characters) filing opinion, etc.
6, After SARFT conducts gathering and examination of the filing situation, promulgates the filing results of the nationwide film scripts (outlines) on the SARFT government website two times per month, once in the first ten days and once in the last ten days. Film scripts (outlines) not having undergone filing promulgation or project establishment examination and approval may not be shot, completed films will not be accepted for examination.
2) Film examination
1, Films completed by film production work units, must be submitted to the local provincial-level radio, film and television entity film examination organ for initial examination according to film script (outline) filing procedure, and after shaping an initial examination opinion reported by the provincial-level radio, film and television entity to the SARFT examination organ for final examination.
2, All sorts of films produced by film production work units subordinate to the Central Committee and State (Army) organs, are directly reported to the SARFT examination organ for examination.
3, Films examined by the SARFT examination organ, where they meet examination criteria, will be issued a “Public Film Projection Permit” by SARFT, where they do not meet examination criteria or need revision, the production work unit shall be informed in writing.
4, The provincial-level radio, film and television entities implementing territorial examination, except for initial examination major revolutionary and major historical subject films, major culture documentaries, Sino-foreign cooperation films which are then reported to the SARFT examination body for final examination, conduct final examination for all other kinds of films (special subject films must have an opinion from the provincial-level controlling authority), where examination meets qualifications, a “Film Examination Decision Letter” and an “Examination Submission Standard Copy Technology Appraisal Letter” will be issued by the provincial-level radio, film and television entity, the producing work unit will submit this letter together with other relevant filing materials to SARFT to obtain a “Film Public Projection Permit; where revision is needed or qualifications are not met, the reasons shall be stated and notified in writing to the producing work unit; exceptional film cases for which provincial-level radio, film and television entities find it hard to make an examination decision or where the producing work unit does not agree with the decision, may be submitted to the SARFT examination body for examination, but a written opinion and reasons must be submitted.
5, Film producing work units not agreeing with the SARFT examination committee examination decision, may put forward an application for re-examination with the SARFT re-examination committee within 30 working days of receiving the examination decision. The SARFT re-examination committee shall put forward a re-examination decision within 20 working days, where re-examination meets qualification, SARFT issues a “Film Public Projection Permit”, where re-examination does not meet qualifications, it the producing work unit shall be notified in writing.
III, Other relevant matters
(1) This Notice is applicable to script (outline) filing and examination of all sorts of domestic feature films, opera films, cartoon films, documentary films, science and education films (not including State-ordered science and education films), special topic films, etc., as well as domestic films exclusively provided for film channel broadcast.
(2) Concrete work time limits and relevant filing material for film script (outline) filing and film examination touched upon in these Regulations, will still be implemented according to the relevant requirements of Article 6, Article 7, Article 17 and Article 18 of the “Film Script (Outline) Filing, Film Management Regulations” (SARFT Decree No. 52) and the “Provisional Regulations on Digital Film Master Copy Payment Collection”.
(3) Relevant management work during the process of film shooting, will be the responsibility of the provincial-level radio, film and television entity that accepted film script (outline) filing, all those involving assistance from the Army, Public Security, Cultural Relics, etc., for filming and having to conduct border entry and exit formalities, after examination and verification by the provincial-level radio, film and television entity, will be approved by SARFT.
(4) After all provincial-level radio, film and television entities receive this Notice, please report circumstances of subordinate film examination organ staffing and organization, work procedures, technological equipment, etc., to SARFT for filing (Contact person: SARFT Film Department Production Office Liu Yanhui, Huang Zhi, contact telephone: 01086090423, 01086090424).
- This Notice takes effect on the day of issuance, in exceptional cases of reasons such as technological equipment, etc., where provincial-level radio, film and television entities can temporarily not undertake film examination, a written report must be submitted, but implementation must occur before 30 June 2010.
