All provincial, autonomous region and municipal telecommunications management bureaus, the National Computer Network Emergency Response Technological Handling and Coordination Centre, the China Internet Information Centre, the China Internet Association, China Telecom Group, China Mobile Group, China Unicom Group, relevant telecommunications business operators, Internet information service providers, Internet domain name registration management and service organs, mobile telephone search engine service enterprises:

The “Supreme People’s Court and Supreme People’s Procuratorate Interpretation of Some Questions on Concretely Applicable Law in Handling Criminal Cases of Using the Internet or Mobile Communication Terminals and Voicemail Platforms to Produce, Reproduce, Publish, Peddle or Disseminate Obscene Electronic Information (II)” (FZ No. [2010]3, hereafter simply named “Interpretation (II)”) has been promulgated on 2 February 2010 and took effect on 4 February.

The “Interpretation (II)” is an important legal basis for severely punishing criminal activities of using Internet and mobile terminals to publish, reproduce, publish, peddle or disseminate obscene electronic information, and disseminating obscene audio information through voicemail platforms, etc. according to the law. In order to coordinate with all levels’ judiciary organs in implementing the “Interpretation (II)”, safeguard social order, guarantee citizens’ rights and interest, and stimulate the healthy and orderly development of the telecommunications sector, the following requirements are put forward:

I, Earnestly study and propagate the “Interpretation (II)”. The “Interpretation (II)” is both a legal basis for judicial organs to attack crimes of disseminating obscene electronic information, and is also a principle for telecommunications business operators and Internet information service providers to strengthen information security management and cleaning up the network environment. All provincial (autonomous region, municipal) telecommunications management bureaus, telecommunications business operators and Internet information service providers must give it high regard, integrate study and propaganda of the “Interpretation (II)” with deeply implementing the “National People’s Congress Standing Committee Decision concerning Safeguarding Internet Security”, the “Telecommunications Regulations of the People’s Republic of China”, the “Internet Information Service Management Rules”, the “Telecommunication Business Operation Permit Management Rules and other regulations, strengthen education of the legal system in the sector and the staff, in order to completely understand all concrete provisions of the “Interpretation (II)”. All provincial (autonomous region, municipal) telecommunications management bureaus must organize and stimulate telecommunications business operators and Internet information service providers in their jurisdiction to deeply study the “Interpretation (II)”, strengthen guidance over study and propaganda work, and let the spirit of the “Interpretation (II)” penetrate into telecommunications sector management work. All telecommunications business operators and Internet information service providers must, through concentrated study, discussion and exchange, special subject deliberation and other methods, deeply study the “Interpretation (II)”, and deepen their understanding of all provisions of the “Interpretation (II)”.

II, Vigorously coordinate with judicial organs to investigate and prosecute criminal cases on obscene electronic information. The “Interpretation (II)” has further clarified the conviction and penalty standards for criminal cases on obscene electronic information, and is a legal basis for judicial organs to strictly punish criminals using the Internet, mobile telecommunications terminals of voicemail platforms to produce, reproduce, publish, peddle or disseminate obscene electronic information. All provincial (autonomous region, municipal) telecommunications management bureaus, telecommunications business operators and Internet information service providers must vigorously coordinate with judicial organs to investigate and prosecute criminal cases of obscene electronic information according to the law. Where judicial organs dealing with criminal cases of using the Internet, mobile telecommunications terminals, etc., to produce, publish, peddle or disseminate obscene electronic information, and relevant specialist technology or other problems are involved, all provincial (autonomous region, municipal) telecommunications management bureaus, telecommunications business operators and Internet information service providers must give rein to their specialization and technological expertise, and vigorously cooperate to do the relevant investigation, evidence-gathering and technological analysis work, etc. well.

III, Further strengthen network information security management. All provincial (autonomous region, municipal) telecommunications management bureaus must integrate study and propaganda of the “Interpretation (II)”, completely implement all management responsibilities, raise their capacity to safeguard telecommunications market order and clean up the network environment according to the law. Cases of disseminating mobile telephone obscenities, that are insufficient to prosecute criminal liability, must be dealt with according to the law; those constituting a crime, conform to the relevant regulations of the “Interpretation (II)”, must be submitted to the judicial organs for prosecution of criminal liability according to the law. New circumstances and new problems encountered in studying and propagating the “Interpretation (II)”, must be earnestly researched and summarized, and timely reported to our Ministry and relevant departments, in order to link up administrative punishment with the “Interpretation (II)”. Telecommunications business operators and Internet information service providers must supervise every department and every branch of their enterprises to strictly implement relevant information security management systems, strengthen the management over enterprise business marketing channels, website content access, server multiple-level subletting, surfing fee agency, suspected pornographic websites changing domain names and other segments, and jointly create a healthy network environment.

IV, Comprehensively utilize legal, economic, technological, administrative and other methods to bring mobile telephone obscenity and sex under control. All provincial (autonomous region, municipal) telecommunications management bureaus must, with studying and propagating the “Interpretation (II)” as juncture, expand their strength to deal with mobile telephone obscenity and sex, and clean up the mobile network environment. They must earnestly use all sorts of telecommunications supervision and management measures, and administrative law enforcement methods, closely coordinate with judicial authorities’ strict punishment of criminal activities, and create legal deterrence. At the same time, they must strengthen construction of technological monitoring measures, raise support and guarantee capacity, and even better serve information security management work. They must target the weak links in mobile Internet technology and business development and management after the commercial and large-scale application of third-generation mobile telecommunications, research effective network information security management measures, and strive to realize that unlawful networks are “discovered early, and dealt with early”. They must deal with enterprises’ unlawful acts in network access, fee collection agency, business cooperation, multi-level sub-letting and other aspects, and prevent the flood of mobile telephone obscenity and sex.

关于做好学习宣传《最高人民法院 最高人民检察院关于办理利用互联网 移动通讯终端 声讯台制作 复制 出版 贩卖 传播淫秽电子信息刑事案件具体应用法律若干问题的解释(二)》有关工作的通知

各省、自治区、直辖市通信管理局,国家计算机网络应急技术处理协调中心、中国互联网络信息中心、中国互联网协会,中国电信集团公司、中国移动通信集团公司、中国联合网络通信集团有限公司,有关电信业务经营者、互联网信息服务提供者、互联网域名注册管理和服务机构、手机搜索引擎服务企业:

 

《最高人民法院最高人民检察院关于办理利用互联网、移动通讯终端、声讯台制作、复制、出版、贩卖、传播淫秽电子信息刑事案件具体应用法律若干问题的解释(二)》(法释[2010]3号,以下简称《解释(二)》)已于2010年2月2日公布,自2月4日起施行。

 

《解释(二)》是依法惩治利用互联网、移动通讯终端制作、复制、出版、贩卖、传播淫秽电子信息,通过声讯台传播淫秽语音信息等犯罪活动的重要法律依据。为配合各级司法机关贯彻实施《解释(二)》,维护社会秩序,保障公民权益,促进电信业健康有序发展,提出要求如下:

 

一、认真学习宣传《解释(二)》。《解释(二)》既是司法机关打击淫秽电子信息犯罪的法律依据,也是电信业务经营者、互联网信息服务提供者加强信息安全管理,净化网络环境的行为准则。各省(自治区、直辖市)通信管理局、电信业务经营者、互联网信息服务提供者要高度重视,把学习宣传《解释(二)》与深入贯彻落实《全国人民代表大会常务委员会关于维护互联网安全的决定》、《中华人民共和国电信条例》、《互联网信息服务管理办法》、《电信业务经营许可管理办法》等规定紧密结合起来,加强对行业、职工的法制教育,全面领会《解释(二)》的各项具体规定。各省(自治区、直辖市)通信管理局要组织和督促所辖区域内电信业务经营者、互联网信息服务提供者深入学习《解释(二)》,加强对学习宣传工作的指导,把《解释(二)》的精神贯穿到电信行业管理工作中去。各电信业务经营者、互联网信息服务提供者要通过集中学习、座谈交流、专题研讨等方式,深入学习《解释(二)》,加深对《解释(二)》各项规定的理解。

 

二、积极配合司法机关依法查处淫秽电子信息刑事案件。《解释(二)》进一步明确了淫秽电子信息刑事案件的定罪量刑标准,是司法机关惩治利用互联网、移动通讯终端、声讯台制作、复制、出版、贩卖、传播淫秽电子信息犯罪的法律依据。各省(自治区、直辖市)通信管理局、电信业务经营者、互联网信息服务提供者要积极配合司法机关依法查处淫秽电子信息刑事案件。对于司法机关依法办理利用互联网、移动通信网等制作、复制、出版、贩卖、传播淫秽电子信息刑事案件,涉及有关专业技术等问题的,各省(自治区、直辖市)通信管理局、电信业务经营者、互联网信息服务提供者要发挥专业和技术专长,积极配合做好有关调查取证、技术分析等工作。

 

三、进一步加强网络信息安全管理。各省(自治区、直辖市)通信管理局要结合学习宣传《解释(二)》,全面履行各项管理职责,提高依法维护电信市场秩序、净化网络环境的能力。对于传播手机淫秽色情、不够追究刑事责任的,要依法做出处理;符合《解释(二)》有关规定、构成犯罪的,要依法移送司法机关追究刑事责任。对于在学习宣传《解释(二)》中遇到的新情况、新问题,要认真研究总结,及时报告我部和有关部门,做好行政处罚与《解释(二)》的对接。电信业务经营者、互联网信息服务提供者要督促企业各部门、各分支机构严格执行有关信息安全管理制度,加强对企业业务推广渠道、网站内容接入、服务器层层转租、上网代收费、涉黄网站变换域名等环节的管理,共同营造健康的网络环境。

 

四、综合运用法律、经济、技术、行政等手段治理手机淫秽色情。各省(自治区、直辖市)通信管理局要以学习宣传《解释(二)》为契机,加大整治手机淫秽色情的力度,净化移动网络环境。要切实利用好各种电信监管措施和行政执法手段,密切配合司法机关惩治犯罪行为,形成法律威慑力。同时,要加强技术监测手段的建设,提升支撑保障能力,更好地服务于信息安全管理工作。要针对第三代移动通信大规模商用后移动互联网新技术、新业务发展和管理的薄弱环节,研究有效的网络信息安全管理措施,努力实现对违法网站的“`
