Notice concerning Strictly Standardizing the Market Order of Internally-Distributed Newspapers and Periodicals and Serial Internal Information Publications
All provincial, autonomous region and municipal press and publications bureaus, all newspaper and periodical controlling department of all Central Committee and State ministries and commissions, all democratic parties, all people’s organizations:
In 2003, all provinces (regions, municipalities) conducted a one-time complete clean-up and rectification of internally-distributed newspapers and periodicals, and serial internal information publications according to the requirements of the General Administration of Press and Publications, effectively curbing unlawful publishing, forced subscription and other unlawful activities in relation to internally-distributed newspapers and periodicals and serial internal information publications, the newspaper and periodical publishing and distribution market order has clearly turned for the better. But, in recent times, the phenomenon of unlawful distribution of internally-distributed newspapers and periodicals and serial internal informative publications has increased somewhat, some internally-distributed newspapers and periodicals such as internal reference or information reference-type periodicals have broken through the limits of their appointed scope of distribution, and openly solicit subscriptions and distribute to society; some serial internal informative publications have violated the management provisions of only being used to guide work and exchange information in their own sector, own system or own work unit, and openly solicit subscriptions and distribute themselves through all sorts of means to society. Especially a number of illegal publications that have not been approved or authorized, are labelled as “XX Internal Reference” or “xx Reference”, indicate expressions such as “specially provided to high-level leaders for policymaking reference”, “provided to department-level or higher leaders for reference”, etc., have been unlawfully published. In order to further standardize the newspaper and periodical publishing and distribution market order, and curb all sorts of unlawful publishing and distribution activities, hereby, the following notification is made concerning related problems:
I, All Party and government departments, and news work units must strictly implement the State management regulations concerning internally-distributed newspapers and periodicals, the internally-distributed newspapers and periodicals they run must be published according to the approved purpose for running newspapers or periodicals and the professional scope, and be distributed according to the determined scope, they may not be unlawfully published and openly solicit subscriptions or be distributed to society in any way.
II, Serial internal informative publications must, according to relevant State provisions, timely apply for an “Internal Informative Publication Printing Permit” (hereafter simply named “Permit”, and be strictly exchanged within the limits of their sector, their system or their work unit, they may not collect fees, may not carry advertising and may not openly solicit subscriptions or be distributed to society, and may not engage in any other commercial activity.
III, Without permission, no work unit or individual may publish internally-distribute newspapers or periodicals, or serial informative internal publications without authorization, printing work units may not contract the printing of publications that have not provided a publishing permit, the “Printing Permit” or that provide a publishing permit or “Printing Permit” that is out of date.
VI, All localities’ administrative press and publications departments must, on the basis of the spirit of this Notice, before the end of October this year, conduct a one-time complete clean-up and inspection of internally distributed newspapers and periodicals and serial internal informative publications within their jurisdiction. Internally-distributed newspapers and periodicals violating regulations are ordered to rectify their act violating regulations, and are punished on the basis of corresponding regulations, serial internal informative publications violating regulations are ordered to correct matters, those refusing to correct are punished according to the law, and their “Printing Permit” will be expired or cancelled. Internally-distributed newspapers and periodicals that have not obtained publishing permission, and serial internal informative publications that have not obtained a “Printing Permit” must be firmly banned, and the illegally-publishing work units and individuals must be strictly investigated and prosecuted, where it is suspected to constitute a crime matters are transferred to the public security organs according to the law, to investigate their criminal responsibility. After clean-up and inspection work is completed, all provincial-level administrative press and publications departments must submit a written report to the General Administration of Press and Publications.
V, All levels’ administrative press and publications departments must, according to the principle of localized management, faithfully implement their management tasks. They must strictly control and grasp examination and approval of internally distributed newspapers and periodicals, and serial internal informative publications, strictly examine and verify the qualifications of work units applying for “Printing Permits”, and must strengthen inspection of the content and quality of those having obtained a “Printing Permit”. They must strengthen daily supervision over internally-distributed newspapers and periodicals and serial internal informative publications, broadly mobilize and earnestly accept reports from the masses, expand the punishment strength against violations of laws and regulations, and strive to safeguard the newspaper and periodical publication and distribution market’s good ordering.
