Film Work Copyright Collective Management Use Fee Collection Standards

According to the relevant provisions of laws and regulations such as the “Copyright Law of the People’s Republic of China” and the “Collective Copyright Management Regulations”, etc., learning from domestic and foreign collective copyright management groups’ pricing scales, integrating the present realistic situation of China’s film copyright trade, through broad and deep investigation and research, and fully hearing the opinions of rights holders and users, for film work use in the area of mass media, these film work copyright collective management use fee collection standards are formulated.

In view of the large differences in visibility, audience as well as production cost of film works, in order to calculate use fee to the fullest correctness, films shall be divided into six categories taking domestic box office income and film production cost height as standards (of those, the domestic box office income amounts to 65%, film production costs amount to 35%. Let N=domestic box office income x65% + film production cost x 35%):

Category 1: Films of N≥200 million Yuan Renminbi.

Category 2: Films of 100 million Yuan Renminbi ≤N< 200 million Yuan Renminbi.

Category 3: Films of 50 million Yuan Renminbi ≤N< 100 million Yuan Renminbi.

Category 4: Films of 10 million Yuan Renminbi ≤N< 50 million Yuan Renminbi.

Category 5: Films of N < 10 million Yuan Renminbi.

Category 6: Films not screened in cinema chains.

Films for which copyright use fees are collected include: films having obtained a “Public Film Screening Permit” issued by the controlling government authority, which are for the time being in the period of protection provided in the “Copyright Law”. Of those, where fine art films exceed 110 minutes in length, it shall be calculated as 110%, where the length is equal to or less than 85 minutes, it shall be calculated as 85%; where popular science films, (news) documentary are longer than, equal to or less than 60 minutes, it shall be calculated as 100%, 90% and 80% respectively.

I, Network

Through cable or wireless networks providing users to watch on-line or download films, makes use of the film work information network dissemination right. According to the different film categories, the use fees for them are settled according to the following two categories of methods:

(1) Category 1, 2, 3 and 4 film copyright use fees are calculated according to the number of user hits x the fee for every hit x 35%, but users shall pay basic use fees at the time of obtaining a use licence:

Category 1 films, within two years of first screening, basic use fee minimum 100.000 Yuan / film / year, after that a progressive decrease of 20% per year, no more decrease when reaching 12.000 Yuan / film / year;

Category 2 films, within two years of first screening, basic use fee minimum 80.000-100.000 Yuan / film / year, after that a progressive decrease of 20% per year, no more decrease when reaching 10.000 Yuan / film / year;

Category 3 films, within two years of first screening, basic use fee minimum 60.000-80.000 Yuan / film / year, after that a progressive decrease of 20% per year, no more decrease when reaching 8.000 Yuan / film / year;

Category 4 films, within two years of first screening, basic use fee minimum 40.000-60.000 Yuan / film / year, after that a progressive decrease of 20% per year, no more decrease when reaching 6.000 Yuan / film / year.

Where the number of user hits x fee for every hit x 35% > basic use fees, every hit after exceeding the basic use fees shall be paid adding 20 – 25%;

where the number of user hits x fee for every hit x 35% ≤ basic use fees, no additional payment is to be made, but the basic use fee will not decrease.

(2) One-time calculation

Category 5 and 6 films are settled implementing package fee methods, to be calculated according to the package quantity as well as the film kind, length, length of time since first screening, etc., and be fixed at 2.000 – 40.000 Yuan / film / year.

II, Internet cafés

Internet cafés using film works generally is establishing database provisions through downloading from servers. Internet cafés broadcasting films is using the film works’ duplication right and screening right (or the information network dissemination right for use in local area networks other than the Internet). Their daily use fees are: the total amount of computers x the hourly fee standard of the Internet café x 7,5%.

III, Video On Demand

VOD operators providing film works to users (including hotels and restaurants), is using the film works’ duplication right and local area information network dissemination right.

When using category 1, 2, 3 and 4 films, charging according to the number of hits, the basic use fee shall be collected first, and then the following use fees shall be calculated:

(1) The yearly basic use fee for all films: the unit price as fixed by VOD operators for that film per hit x 33,3% x the number of end users x 10%.

(2) The annual use fee calculation method is the unit price annual per hit of that film as fixed by the VOD operator x 30% x the annual number of hits, to be the use fee of every film every year.

Basic use fees must be paid in advance, and settled every year. Where annual use fees are lower than basic use fees, the basic use fees do not decrease; where they are higher than the basic use fees, they must be brought up to the full amount.

For using category 5 and 6 films or category 1, 2, 3 and 4 films after removal from VOD and bringing them into package fees, the use fee for every film is to be fixed at 5.000 – 50.000 Yuan / year on the basis of number of users, the length of time since first screening and the watchbility of the film itself.

IV, Means of transportation

Means of transportation such as airplanes, trains, ships, long-distance buses, etc., are at present generally all screening films through databases provided and established by those respective companies or intermediary companies, using film works’ duplication right and screening rights. Their use fee standards are as follows:

(1) Airplanes and trains:

Within two years from first screening, where the cover exceeds 10.000 flights (trains) / year, the annual use fees per film are:

category 1 films, 25.000 – 50.000 Yuan;

category 2 films, 18.000 – 25.000 Yuan;

category 3 films, 16.000 – 18.000 Yuan;

category 4 films, 14.000 – 16.000 Yuan;

category 5 and 6 films, 2.500 – 14.000 Yuan.

Where the cover is lower than 10.000 flights (trains) / year, the use fees are halved.

After two years from first screening, the use fees may be reduced.

(2) Ships:

Within two years from first screening, where the cover exceeds 5.000 sailings / Year, the annual use fees per film are:

category 1 films, 10.000 – 11.000 Yuan;

category 2 films, 9.000 – 10.000 Yuan;

category 3 films, 8.000 – 9.000 Yuan;

category 4 films, 7.000 – 8.000 Yuan;

other films, depending on different category or length, 800 – 6000 Yuan.

Where the cover is lower than 5.000 sailings / year, the use fees are halved.

After two years from first screening, the use fees may be reduced.

(3) Long-distance buses:

All long-distance buses screening film works, regardless of the number of category of films used, without exception implement centralized receipt, collected copyright use fees per bus per year are 365 – 500 Yuan.

V, Non-commercial local area networks

Community, organ, enterprise or undertaking work unit non-commercial local area networks broadcasting films, is using the film works’ right of dissemination through an information network, taking every 500 end user terminals as one unit of calculation, copyright use fees are 100 Yuan per calculation unit per film per year. Those using 50 films within one year will be calculated at 10% discount, those using 100 films within one year will be calculated at 20% discount.

VI, Audiovisual product rental

Commercial film and audiovisual product rental services, use film works’ rental right. A central receipt for use fees of film works’ rental right is 200 Yuan per year per rental point.

VII, Others

For film work dissemination in areas such as radio, film, network, and mobile phone through montages, and compilations, is using film works’ compilation right. For using film works’ compilation rights, the right holders’ permission must be obtained in advance (or through a collective copyright management group). After compilation, the work shall obtain the approval of the copyright holder. Use fees may be discussed separately according to factors such as the length or number of selections, etc.

These use fee collection standards are standard prices. Where it is suitable, they may be floated according to the realistic situation during implementation, but the degree of flotation is to be decided through discussion of the Association’s board of directors.

电影作品著作权集体管理使用费收取标准

根据《中华人民共和国著作权法》、《著作权集体管理条例》等法律法规的有关规定,借鉴国内外著作权集体管理组织的价格尺度,结合目前中国电影版权交易的实际情况,经过广泛深入地调查研究,并充分听取权利人和使用者的意见,就电影作品在大众传媒领域内的使用,制定本电影作品著作权集体管理使用费收取标准。

鉴于电影作品的可看性、受众面以及成本差异较大,为尽量准确计算使用费,以国内票房和影片成本的高低为标准将影片分为六类(其中国内票房所占比重为65%,影片成本所占比重为35%。设定N =国内票房×65%+影片成本×35%):

第一类,N≥2亿元人民币的影片。

第二类,1亿元人民币≤N<2亿元人民币的影片。

第三类,5000万元人民币≤N<1亿元人民币的影片。

第四类,1000万元人民币≤N<5000万元人民币的影片。

第五类,N<1000万元人民币的影片。

第六类,未进院线上映的影片。

收取著作权使用费的电影作品包括:所有取得政府主管部门颁发的《电影片公映许可证》、且在《著作权法》规定的保护期内的影片。其中,美术片长度超过110分钟的,按110%计算,长度等于、少于85分钟的,按85%计算;科教片、(新闻)纪录片大于、等于或少于60分钟的,分别以100%、90%及80%计算。

一、网络

通过有线或无线网络提供用户在线观看或下载影片,使用的是电影作品的信息网络传播权。根据影片类别的不同,其使用费分别按以下两类办法结算:

(一)第一、二、三、四类影片的著作权使用费按用户点击次数×每次点击费用×35%计算,但是使用者应在取得使用许可时支付基本使用费:

第一类影片,距首映两年内的,基本使用费下限为10万元/部年,其后每年递减20%,至12000元/部年不再递减;

第二类影片,距首映两年内的,基本使用费为8-10万元/部年,其后每年递减20%,至10000元/部年不再递减;

第三类影片,距首映两年内的,基本使用费为6-8万元/部年,其后每年递减20%,至8000元/部年不再递减;

第四类影片,距首映两年内的,基本使用费为4-6万元/部年,其后每年递减20%,至6000元/部年不再递减。

用户点击次数×每次点击费用×35%>基本使用费的,超过基本使用费之后的每一次点击,按20%-25%追加支付;

用户点击次数×每次点击费用×35%≤基本使用费的,则不再追加支付,但基本使用费不减。

(二)一次性结算

第五、第六类影片实行打包收费办法结算,根据打包数量以及影片种类、长度,距首映时间的长短等因素计算,确定为2000-40000元/部年。

二、网吧

网吧使用电影作品一般是通过服务器下载建立数据库提供的。网吧播映影片使用的是电影作品的复制权和放映权(或区别于互联网的局域网内使用的信息网络传播权)。其每天的使用费为:电脑总量×网吧每小时收费标准×7.5%。

三、视频点播(VOD)

由VOD运营商向用户(包括宾馆饭店)提供电影作品,使用的是电影作品的复制权和局域网信息网络传播权。

使用第一、二、三、四类影片在按点击次数收费时,应先缴纳基本使用费,再结算使用费:

(一)每年每部影片的基本使用费:由VOD运营商确定的该部影片每次点击的单价×33.3%×终端用户数×10%

(二)年度使用费的计算方式是按VOD运营商确定的每次点击该影片的单价×30%×年点击次数,即为每部影片每年的使用费。

基本使用费必须预付,次年结算。年度使用费少于基本使用费的,基本使用费不退;多于基本使用费的则须补足。

使用第五、六类影片或第一、二、三、四类影片点播下线后纳入打包收费的,每部影片的使用费根据用户数量、距首映时间的长短及影片本身的可看性确定为5000-50000元/年。

四、交通工具

飞机、火车、轮船、长途汽车等交通工具目前一般都是通过各自公司或中介公司提供并建立的数据库播映影片,使用的是电影作品的复制权和放映权。其使用费标准如下:

(一)飞机和火车:

在影片首映两年内,其覆盖范围超过10000架次(列次)/年的,每年每部影片的使用费为:

第一类影片,2.5-5万元;

第二类影片,1.8-2.5万元;

第三类影片,1.6-1.8万元;

第四类影片,1.4-1.6万元;

第五、六类影片2500-14000元。

覆盖范围在10000架次(列次)/年以下的,使用费减半。

影片首映两年后,使用费可酌减。

(二)轮船:

影片首映两年内,其覆盖范围超过5000航次/年的,每年每部影片使用费为:

第一类影片,10000-11000元;

第二类影片,9000-10000元;

第三类影片,8000-9000元;

第四类影片,7000-8000元;

其余影片因类别和长度不同,800-6000元。

覆盖范围少于5000航次/年的,使用费减半。

影片首映两年后,使用费可酌减。

(三)长途汽车:

凡播映电影作品的长途汽车,不分使用影片的数量及类别,一律实行统收,每辆车每年收取著作权使用费365-500元。

五、非营利性局域网

社区、机关、企事业单位的非营利性局域网播映电影,使用的是电影作品的信息网络传播权,按每500户终端为一个计算单位,每个计算单位每年每部影片的著作权使用费为100元。一年内使用满50部影片的按九折计算,一年内使用满100部的按八折计算。

六、音像制品出租

经营影片音像制品出租业务,使用的是电影作品的出租权。每年每个出租点统收电影作品出租权使用费200元。

七、其他

在广播、电视、网络、手机等领域通过剪辑、汇编电影作品传播的,使用的是电影作品的汇编权。使用电影作品的汇编权必须事先(或通过著作权集体管理组织)得到权利人的许可。汇编后的作品应得到权利人的认可。其使用费可根据选用量的多少等因素另行商定。

本使用费收取标准为基准价。在实施过程中根据实际情况可作适当浮动,但浮动幅度由协会理事会讨论决定。
