On 12 November, SARFT has issued the ‘SARFT Notice Concerning Printing and Circulation of the “Opinions on the Implementation of the Radio and Television Intellectual Property Rights Strategy”‘ to all provincial, autonomous region and municipal radio, film and television bureaus, the Xinjiang Production-Construction Corps radio and television bureau, all SARFT organ departments and all directly subordinate work units, the Notice says that, in order to implement the spirit of the 5th plenum of the 17th Party Congress, according to the “National Intellectual Property Rights Strategy Outline” and the “Cultural Industries Promotion Plan”, SARFT formulated the “Opinions on the Implementation of the Radio and Television Intellectual Property Rights Strategy”, which had been passed by the SARFT departmental meeting. It is hereby issued to you; please earnestly implement it in integration with reality.

According to the “National Intellectual Property Rights Strategy Outline” and the “Cultural Industries Promotion Plan”, in order to implement the spirit of the 5th plenum of the 17th Party Congress, substantially raise radio and television intellectual property rights creation, utilization and management capacities, establish innovative radio and television undertakings and industries, promote the great development and great flourishing of radio and television, these Implementation Opinions are formulated.

 

I, Significance

1, The intellectual property rights system is a basic system for development and utilization of knowledge resources, respecting creative labour and encouraging innovation, it is an important content of establishing a State ruled by law and a sincere society, it is an important support for raising cultural innovation capacity construction and developing cultural undertakings and industries. Radio and television are important components of cultural undertakings and industries, are sectors closely related to intellectual property rights, intellectual property rights are a strategic resource and core factor for radio and television undertakings and industries’ development. Implementing the radio and television intellectual property rights strategy benefits stimulating the realization of leapfrogging development in radio and television, fully giving rein to the important function of radio and television in guiding society, educating the people and promoting development, satisfying the people’s incessantly increasing spiritual culture needs, safeguarding national culture and ideological safety, making radio and television having an even larger function in economic development path transformation and construction of an innovative country.

Substantially raising the radio, film and television intellectual property rights creation, utilization, protection and management capacities, incessantly innovating radio, film and television production and dissemination methods, strengthening the vitality of the innovative development of radio, film and television, producing a marked effect for promoting the cultural industries to become a national industry backbone industry and stimulating the great development and great flourishing of culture.

Continuing to strengthen exchanging and cooperation with international organizations such as the World Intellectual Property Organization, the Asian Broadcasting Union, the European Broadcasting Union, the Asia-Pacific Institute for Broadcasting Development, etc. Researching new international radio, film and television intellectual property rights problems, paying close attention to understanding, consulting and learning from thinking and methods resolving problems concerning intellectual property rights in international organizations and other nations.

 

V, Guarantee steps

12, Strengthening organizational guidance, implementing responsibility systems. 11月12日,广电总局向各省、自治区、直辖市广播影视局,新疆生产建设兵团广播电视局,总局机关各司局、直属各单位发出《广电总局关于印发<广播影视知识产权战略实施意见>的通知》,通知说,为贯彻党的十七届五中全会精神,根据《国家知识产权战略纲要》和《文化产业振兴规划》,总局制定了《广播影视知识产权战略实施意见》,已经总局局务会议审议通过。现印发给你们,请结合实际认真贯彻执行。
广播影视知识产权战略实施意见
根据《国家知识产权战略纲要》、《文化产业振兴规划》,为贯彻党的十七届五中全会精神,大幅度提升广播影视知识产权创造、运用、保护和管理能力,建设创新型广播影视事业产业,促进广播影视大发展大繁荣,制定本实施意见。
一、重要意义
1、知识产权制度是开发和利用知识资源,尊重创造性劳动和激励创新的基本制度,是建设法治国家和诚信社会的重要内容,是提升文化创新能力建设、发展文化事业产业的重要依托。广播影视是文化事业产业的重要组成,是知识产权密集型行业,知识产权是广播影视事业产业发展的战略性资源和核心要素。实施广播影视知识产权战略有利于促进广播影视实现跨越式发展,充分发挥广播影视引导社会、教育人民、推动发展的重要功能,满足人民群众不断增长的精神文化需求,维护国家的文化和意识形态安全,使广播影视在国家经济发展方式转变和创新型国家建设中发挥更大作用。
二、总体要求
2、高举中国特色社会主义理论旗帜,坚持以邓小平理论和“三个代表”重要思想为指导,深入贯彻落实科学发展观,遵照党的十七届五中全会精神和《国家知识产权战略纲要》的要求,按照激励创造、有效运用、依法保护、科学管理的重要方针,推进《国家知识产权战略纲要》在广播影视领域的全面实施。着力完善广播影视知识产权制度,积极营造良好的知识产权环境,始终把社会效益放在首位,实现经济效益和社会效益有机统一。大幅度提升广播影视知识产权创造、运用、保护和管理能力,不断创新广播影视制作生产和传播方式,增强广播影视创新发展的活力,为推动文化产业成为国民经济支柱性产业、促进文化大发展大繁荣发挥作用。
三、战略目标
3、到2020年,我国广播影视知识产权的创造、运用、保护和管理水平获得较大程度提高。尤其在“十二五”期间,广播影视知识产权法律制度进一步完善,促进广播影视舆论引导能力、文化创新能力、创作经营能力和品牌影响力显著提高,广播影视市场发展环境、市场环境进一步改善,国际竞争力显著增强,广播影视技术标准体系基本建成,自主知识产权拥有量逐步增长,科技支撑力显著增强,形成一批拥有知名品牌的广播影视企事业单位和品牌频道频率、栏目节目,造就一支高素质的广播影视知识产权人才队伍。
四、主要任务
4、推进广播影视知识产权保护制度建设与实施。积极主动参与《著作权法》的修改立法工作和有关网络影视版权等其他广播影视知识产权法律制度的制定、修改工作。指导广播影视企事业单位执行好《著作权法》、《商标法》、《专利法》、《反不正当竞争法》、《广播电台电视台播放录音制品支付报酬暂行办法》等知识产权法律、法规。积极参与世界知识产权组织《广播组织权利公约》制定工作。进一步规范广播电台电视台合法使用作品,提高广播电台电视台尊重创作、尊重知识产权的意识。会同有关部门对涉及广播影视知识产权的法律、法规和规章进行立法后评估。
5、鼓励广播影视知识产权创造。以知识产权创造为目标,形成广播影视创意产业群。大力实施广播影视精品工程,坚持抓创意、促原创,扶持内容创作生产,提高影视剧、动画片、纪录片的原创能力。发展广播影视新兴业态,增强多元化供给能力,满足人民群众日益增长的对影视节目内容的需求。完善艺术创作激励机制、内容评价机制和技术发明奖励机制,建立健全有关作品创作资助、评奖、推广、评论机制。鼓励广播电台电视台加强台标、栏目的品牌建设,形成一批拥有精品品牌的广播影视播映和制作经营机构。做大做强一批节目内容制作企业,提高集约化经营水平,促进广播影视领域资源整合和结构调整。鼓励和引导广播影视企事业单位与高等院校、科研机构加强合作,建立产、学、研相结合的知识产权联合创造机制。
6、促进广播影视知识产权运用。促进广播影视知识产权市场化和商品化。建设公平有序的广播影视版权交易市场,在“十二五”期间,推动搭建二至三个广播影视节目交易平台。推动建立广播影视节目版权信息库和审批信息库,有效地提高合法影视作品的公信力和可识别性。加强自主商标运用。提升广播影视企事业单位运用自主商标的能力,支持发展自主品牌特许经营等运营方式,提高自主商标的国际知名度和影响力。开发移动多媒体广播电视、有线数字电视等广播影视专利技术,鼓励具有自主知识产权的高新技术项目发展,推动广播影视系统技术升级。大力支持自主专利技术转化为适应市场需求的技术标准。以数字化、网络化为主线,以三网融合为契机,加强标准规划、完善标准体系,加强高清电视、移动多媒体广播电视、下一代传输网络、数字电影等重点领域的技术标准制定工作。引导广播影视单位综合利用专利、商标、版权对广播影视原作品、复制品、衍生品和形象产品进行多媒体传播,多渠道营销和多层次开发,延伸广播影视产业链,形成广播影视多元盈利模式,充分挖掘广播影视产品的整体效益。
7、提高广播影视知识产权保护水平。建立健全广播影视知识产权保护体系。以知识产权保护为后盾,营造广播影视创新环境。探索建立广播影视版权认证制度和评估体系,合理划分广播影视作品著作权权利状态和著作权价值。建立健全广播影视系统商业秘密保护机制。指导和帮助广播影视企事业单位对运营方法、营销策略、客户名单、广告标底和使用作品付酬数额等信息进行商业秘密保护。妥善处理广播影视企事业单位商业秘密保护与职工合理流动的关系。开发推广技术保护措施。研发数字电影版权保护技术,研究推广自主的数字电影系统规范,开发网络影视节目内容加密技术和密钥管理技术。
8、完善广播影视知识产权管理机制。研究制定广播影视知识产权管理规范。加快建设广播影视企事业单位内部版权合同管理、台标标识管理、品牌栏目注册管理等制度,推行知识产权法律文书示范文本。形成由广播影视行政部门、行业组织和企事业单位共同参与的知识产权管理机构,探索建立知识产权预警机制、海外维权机制,积极参与建立和完善知识产权争端解决机制。在重大经济活动中,对知识产权事项进行审查,特别注意保护广播影视著作权、商标权、专利权和有关商业秘密等不受侵害。在转企改制、股份制、规模化、集约化等广播影视改革发展进程中,避免商标、商号、栏目名称等无形资产流失。建立完善媒体资产管理系统。鼓励广播影视企事业单位建设版权信息记录系统,对广播影视作品进行数字化转储与版权登记管理。
9、实施打击侵犯知识产权的专项行动。指导文化市场综合执法机构和广播影视执法机构实施国家关于打击侵犯知识产权和制售假冒伪劣商品的专项行动,配合工商、新闻出版(版权)、海关、公安、法院等相关部门和机构严厉查处涉及广播影视行业的知识产权侵权盗版和违法犯罪行为。加强对视听节目服务网站播放正版节目的监督工作,严厉打击互联网侵权盗版,重点打击影视剧作品侵权盗版行为。加强对电视购物活动的监管,重点打击利用广播电视网络销售侵犯知识产权和假冒伪劣商品的欺诈行为。加大软件正版化工作力度。2011年5月底前,完成广电总局软件正版化专项检查和整改工作,重点检查办公软件、杀毒软件使用情况。各级广播影视行政部门和广播影视企事业单位购置、更换计算机办公设备必须同时安排必要的软件购置资金,将软件作为资产纳入部门资产管理体系和媒体资产管理体系,购买的计算机办公设备必须符合预装正版操作系统软件的要求,更新计算机操作系统软件必须使用正版产品。
10、加大知识产权宣传力度。充分发挥广播影视优势,构建广播影视知识产权宣传体系,以多种形式积极开展有关知识产权的宣传报道工作,形成政府主导、媒体支撑、社会公众广泛参与的知识产权宣传工作体系。做好“4·26”世界知识产权日、“12·4”法制宣传日等重点时期的知识产权文化宣传普及,形成尊重知识、崇尚创新、诚信守法的知识产权文化。
11、增强国际合作和文化交流。创新广播影视“走出去”模式,增强广播影视国际竞争力和影响力。充分利用国际影视节展,加大国产影视作品海外营销力度。推动建立海外节目推广平台,鼓励广播影视企事业单位运用知识产权制度参与国际市场竞争,提高国际传播能力。继续加强与世界知识产权组织、亚洲广播联盟、欧洲广播联盟、亚太广播发展机构等国际组织的交流合作。研究国际广播影视知识产权新问题,关注了解和参考借鉴国际组织和其他国家关于知识产权问题的解决思路和方法。
五、保障措施
12、加强组织领导,落实责任制。各级广播影视行政部门要从全局与战略的高度重视和加强知识产权工作,协调或配合相关部门的知识产权立法、执法和司法工作,将知识产权工作纳入重要议事日程。广电总局根据年度《国家知识产权战略实施推进计划》和《中国保护知识产权行动计划》,制定广播影视年度知识产权保护计划。各直属单位结合各自的责任和职能,将落实知识产权计划的具体任务纳入单位年度工作。广播影视企事业单位要建立完善法制和知识产权工作部门,做到有办事机构、办事人员和工作经费。发展广播影视知识产权行业管理组织,指导扶持中国电影著作权协会,中国广播电视协会广播版权管理与保护委员会、电视版权委员会,互联网视听节目服务自律联盟等行业自律组织开展工作。
13、开展知识产权理论研究。加强有关广播影视知识产权理论、案例和管理实务的研究,2011年,完成《广播影视知识产权案例》的编写工作。建立完善知识产权战略实施评估体系,定期对广播影视知识产权战略实施意见的落实进行阶段性评估,推动本意见的贯彻实施。
14、加强广播影视知识产权培训与人才队伍建设。广泛开展针对广播影视系统公务员、企事业单位管理人员、专业技术人员和作品创作人员的知识产权培训活动,切实增强各级领导干部与骨干员工驾驭知识产权工作的能力。加快广播影视知识产权人才培养。从2011年开始,与高校科研机构加强合作,共建广播影视知识产权人才培训基地和实践基地,开展广播影视知识产权学历教育。继续贯彻实施《广播影视名家培养工程实施意见》和《广播影视青年创新人才工程实施意见》,在全国广播影视行业选拔培养一批既熟悉广播影视法律,又具备知识产权工作能力的人才以及广播影视名家和青年创新人才。建立广播影视知识产权人才供需库,注重引进海外高端人才,合理有序引导知识产权人才的流动和配置。创新广播影视知识产权人才评价体系。完善对广播影视知识产权管理人员的职称评定机制,鼓励广播影视企事业单位建立内部知识产权人才绩效评价和激励机制。
