Guiding Opinions Concerning Strengthening Comprehensive Culture Market Law Enforcement Equipment Allocation

In order to further strengthen and standardize comprehensive culture market law enforcement equipment allocation work, stimulate comprehensive culture market law enforcement teams’ specialization, standardization and informatization construction, according to the “Opinions Concerning Accelerating and Stimulating Comprehensive Culture Market Law Enforcement Reform Work” of the Central Propaganda Department, Ministry of Culture and five other departments, and the “Ministry of Culture Notice Concerning Strengthening Comprehensive Culture Market Law Enforcement Guidance Work”, integrating the reality of comprehensive culture market law enforcement, the following opinions are put forward:

I, Fully understanding the importance of strengthening comprehensive culture market law enforcement equipment allocation work

Comprehensive culture market law enforcement equipment refers to communication tools, equipment, information network equipment and other technological equipment, etc., used by comprehensive culture market law enforcement personnel when conducting administrative management and administrative management work for completing law enforcement duties and guaranteeing their personal safety. Law enforcement equipment is the material basis for comprehensive culture market law enforcement, is a component part of law enforcement team’s fighting capacity, and is an important content of law enforcement team professional construction. (4) Constructing technological supervision and management platforms. All levels’ administrative culture entities and comprehensive law enforcement organs shall adapt to the requirements of informatization development, strengthen technical supervision and management platform construction, realize functions such as information management, online law enforcement, remote supervision and management, etc., and raise culture market supervision and management effectiveness and levels.

IV, realistically organizing implementation work

(1) Raising understanding, strengthening leadership. 文化部关于加强文化市场综合执法装备配备工作的指导意见

各省、自治区、直辖市文化厅(局),新疆生产建设兵团文化广播电视局,北京、天津、上海、重庆市文化市场行政执法总队:

为进一步加强和规范文化市场综合执法装备配备工作,促进文化市场综合执法队伍专业化、规范化、信息化建设,根据中宣部、文化部等5部门《关于加快推进文化市场综合执法改革工作的意见》、《文化部关于加强文化市场综合执法指导工作的通知》精神,结合文化市场综合执法实际,提出如下意见:

一、充分认识加强文化市场综合执法装备配备工作的重要意义

文化市场综合执法装备是指文化市场综合执法机构及执法人员在开展行政管理和行政执法工作中,用以完成执法任务和保障自身安全的交通工具、器材、信息网络装备及其他技术设备等。执法装备是文化市场综合执法的物质基础,是执法队伍战斗力的组成部分,是加强执法队伍业务建设的重要内容。全面推进文化市场综合执法装备配备工作,既是科学监管和依法行政的基本需要,也是不断提高文化市场监管能力,规范文化市场秩序,维护国家文化安全的重要保障。

二、加强装备配备工作的基本原则

(一)统筹规划。省级文化行政部门和文化市场综合执法机构负责制定执法装备的配备规划,统一指导全省综合执法装备配备工作。市县文化行政部门和综合执法机构按照规划落实。

(二)科学配置。结合实际,因地制宜配备文化市场综合执法装备,突出针对性、通用性和先进性。优化资源配置,实现合作共享,提高使用效率,保证执法工作正常开展。

(三)政府投入。文化市场综合执法装备配备经费由文化行政部门和综合执法机构向同级财政部门申请。各地结合执法工作需要和经济发展水平,不断加大投入力度,确保执法装备配备到位。

三、加强装备配备工作的主要任务

加强文化市场综合执法队伍装备建设,在2至3年内,各级文化行政部门和综合执法机构要按照本意见,全面完成执法装备的配备工作。

(一)配备执法专用房间。各级文化市场综合执法机构应配备举报受理室、询问调查室、证据保存室、技术监控室和罚没物品库房等执法专用房间。日常办公用房参照党政机关办公用房建设标准执行。

(二)配备执法专用车辆。各级文化市场综合执法机构应配备巡查用车及暗访用车,保证文化市场日常巡查、举报受理、调查取证、重大活动保障和突发事件应急处置等工作需要。巡查用车应喷涂“文化执法”、“举报电话12318”等执法标识。

(三)配备执法专用设备。各级文化市场综合执法机构应根据本部门工作职责和文化市场监管需求,配备数码照相机、移动存储介质、便携式打印机、移动执法手持式终端等执法专用设备,规范执法行为,提高执法效能。

(四)建设技术监管平台。各级文化行政部门和综合执法机构应适应信息化发展要求,加强技术监管平台建设,实现信息管理、网上执法、远程监管等功能,提高文化市场监管效率与水平。

四、切实做好组织实施工作

(一)提高认识,加强领导。要充分认识装备配备工作的重要性和必要性,加强组织领导,制定实施方案,落实工作措施,确保装备配备及时到位。

(二)主动协调,保证投入。要加强与当地政府和财政部门的协调沟通,争取支持,确保资金足额投入,专款专用。科学编制资金预算,合理安排支出,提高资金的使用效益。

(三)健全制度,明确责任。要建立健全执法装备管理的规章制度,做好执法装备资料的建档工作,实行动态管理,做到合理使用、妥善保管、专人维护。

(四)专项督查,逐级考核。文化部将把执法装备配备情况作为一项重要指标,纳入文化市场平安建设考核体系,定期组织督查。省级文化行政部门和综合执法机构要加强对本地区执法装备配备工作的指导,督查考核市县综合执法机构的装备配备工作。
