State Council Decision Concerning Amending the “Audiovisual Product Management Regulations” (Opinion-Seeking Draft)

Article 1: The State Council has decided to make the following revisions to the “Audiovisual Product Management Regulations” (State Council Decree no. 341):

 

Article 2: Article 1 is changed into: “In order to strengthen audiovisual product management, stimulate the healthy development and flourishing of the audiovisual sector, enrich the popular masses’ cultural life, stimulate the construction of a socialist material civilization and spiritual civilization, these Articles are formulated.”

 

Article 3: Article 2 Paragraph I is changed into: “These Regulations apply to activities of audiovisual product publishing, production, reproduction, import, distribution, etc.”

A paragraph is added to Article 2, to be Paragraph II: “Audiovisual products as named in these Regulations, refers to magnetic tapes, compact discs or mobile storage media such as cassette tapes, video tapes, records, laser audio discs, laser video discs, hard disc chips, etc., containing recorded sound or image programme content, as well as other carrier forms determined by the State Council administrative publications entity.

 

Article 4: Article 3 Paragraph I is changed into “Publishing, producing, reproducing, importing and distribution of audiovisual products, shall abide by the Constitution and relevant laws and regulations, persist in the orientation of serving the People and serving Socialism, disseminating ideology, morals, science, technology and culture knowledge beneficial to economic development and social progress”.

 

Article 5: Article 4 Paragraph I is changed into: “The State Council administrative publications entity is responsible for supervision and management work of audiovisual product publishing, production, reproduction and distribution nationwide; other relevant State Council administrative entities, according to the division of responsibilities provided by the State Council, are responsible for supervision and management over relevant audiovisual product business activities.”

Article 4 Paragraph II is changed into: “County-level or higher local People’s Government administrative publishing management entities (hereafter simply named administrative publishing entities) are responsible for supervision and management work over audiovisual product publishing, production, reproduction, import and distribution in their administrative regions; other relevant county-level or higher local People’s Government relevant administrative entities are each responsible for supervision and management work over relevant audiovisual product business activities according to their scope of responsibility.

 

Article 6: Article 5 Paragraph I is changed into “The State implements a permit system over publishing, production, reproduction, import and distribution of audiovisual products; without a permit, any work unit or individual may not engage in activities such as audiovisual product publishing, production, reproduction, import, distribution, etc.”

 

Article 7: Article 6 is changed into: “The State Council administrative publications entity is responsible for formulating audiovisual sector development plans, and determining the total amount, distribution and structuring of audiovisual publishing work units, audiovisual reproduction work units and audiovisual completed product import business work units nationwide.

 

Article 8: Article 9 is changed into: “Applications for establishing an audiovisual publishing work unit, after examination, verification and agreement of the local provincial, autonomous region or municipal People’s Government administrative publications entity, is reported to the State Council administrative publications entity for examination and approval. The State Council publishing entity shall within sixty days of receiving the application, make a decision of approval or non-approval, and notify the applicant. To those approved, an “Audiovisual Product Publishing Permit” is issued, the applicant shall go to the administrative industry and commerce management entity for registration with the “Audiovisual Product Publishing Permit”; to those not approved, the reasons shall be explained in writing.”

 

Article 9: Article 12 Paragraph II is changed into “Audiovisual publishing entities shall deliver free samples according to relevant state regulations to the National Library, the Chinese Edition Library, the State Council administrative publications entity and the local provincial, autonomous region or municipal People’s Government administrative publications entity.”

 

Article 10: Article 17 Paragraph I is changed into: “Work units other than audiovisual publishing work units applying for establishment of a work unit independently engaging in audiovisual product production work (hereafter simply named audiovisual production work units”, are examined and approved by the provincial, autonomous region and municipal People’s Government administrative publications entity. Provincial, autonomous region and municipal People’s Government administrative publications entities shall within sixty days of receiving the application, make a decision of approval or non-approval, and notify the applicant. To those approved, an “Audiovisual Product Production Permit” shall be issued, the applicant shall go to the administrative industry and commerce management entity for registration with the “Audiovisual Product Production Permit”, and obtain a business permit according to the law; to those not approved, the reasons shall be explained. Establishment of radio and television programme production work units will be dealt with according to relevant laws and administrative regulations.”

 

Article 11: Article 19 Paragraph III is changed into: “Audiovisual production work units may not publish, reproduce or distribute audiovisual products.”

 

Article 12: Article 21 Paragraph I is changed into: “Applications for establishment of an audiovisual reproduction work unit, after examination, verification and agreement by the local provincial, autonomous region and municipal People’s Government administrative publications entity, shall be reported to the State Council administrative publications entity for examination and approval. The State Council administrative publications entity shall within sixty days of receiving the application make a decision of approval or non-approval, and notify the applicant. To those approved, a “Reproduction Business Permit” is issued, and the applicant shall go to the administrative industry and commerce management entity for registration with the “Reproduction Business Permit”, and obtain a business permit according to the law; to those not approved, the reasons shall be explained.”

 

Article 13: Article 23 Paragraph I is changed into: “Audiovisual reproduction work units accepting entrustment to reproduce audiovisual products, shall according to relevant State Regulations, conclude a reproduction entrustment contract with the entrusting publishing work unit; verify the entrusting publishing work unit’s “Audiovisual Product Publishing Permit” and business licence copies and the stamped audiovisual product reproduction entrustment letter; where audiovisual products of which reproduction is entrusted are not for sale, the identity certification of the entrusting work unit shall be verified  and the entrusting work unit issues a non-commercial audiovisual product reproduction entrustment letter according to the provided model.”

 

Article 14: Article 24 is changed into: ” Audiovisual reproduction work units may not accept entrustment of reproduction of commercial audiovisual products from non-audiovisual publishing work units; they may not of their own accord reproduce audiovisual products; and may not distribute audiovisual products.”

 

Article 15: Article 26 is changed into: “Audiovisual reproduction work units accepting entrustment of reproduction of foreign audiovisual products, must have an authorization letter from the copyright holder, and be approved by the provincial, autonomous region and municipal People’s Government administrative publications entity; the reproduced foreign audiovisual products must be completely exported out of the borders, and may not be distributed inside the borders.”

 

Article 16: Article 27 is changed into: “completed audiovisual product import work is conducted by State Council administrative publications entity-approved completed audiovisual product import business work units; without approval, any work unit or individual may not conduct completed audiovisual product import work.”

 

Article 17: Article 28 Paragraph I is changed into: “Audiovisual products imported for use in publication or information network dissemination, as well as completed audiovisual products imported for use in distribution, etc., shall be reported to the State Council administrative publications entity to conduct content examination.”

Article 28 Paragraph II is changed into: “The State Council administrative publications entity shall within thirty days of receiving the audiovisual product content examination application letter, make a decision of approval or non-approval, and notify the applicant. To those approved, an approval document is issued, to those not approved, the reasons are explained.”

Article 28 Paragraph III is changed into: “Work units importing audiovisual products for use in publishing or information network dissemination and completed audiovisual product import business work units shall go to Customs to conduct import formalities with the State Council administrative publications entity approval document.”

 

Article 18: Article 29 is changed into: “Of audiovisual products imported for use in information network dissemination, copyright matters shall be registered with the State Council administrative copyright management entity.”

 

Article 19: Article 30 Paragraph II is changed into: For audiovisual products imported for use in exposition or exhibition, after State Council administrative publications entity approval, temporary import formalities shall be conducted with Customs.”

Article 30 Paragraph III is changed into: “Audiovisual products imported according to these provisions, may not be commercially reproduced, distributed or screened.”

 

Article 20: Article 31 is changed into: “For establishment of an audiovisual distribution work unit, the following conditions shall be met:

(1) having the name and articles of association of an audiovisual distribution work unit;

(2) having fixed business premises;

(3) having organizational structures and personnel suited to the business scope;

(4) having funding and premises suited to the business scope;

(5) other conditions provided by laws and administrative regulations.”

 

Article 21: Article 32 is changed into: “Establishment of an audiovisual distribution work units or engaging in audiovisual product distribution work, must be approved by the administrative publishing entity, and a “Publications Business Permit” obtained.

 

Article 22: Article 33 Paragraph I is changed into: “Audiovisual product distribution work units changing their name or business scope, or merging with other audiovisual product distribution work units, or where new audiovisual product distribution work units are established through merger or separate establishment, examination and approval formalities shall be conducted according to the provisions of Article 32 of these Regulations, and corresponding registration formalities must be conducted with the originally-registering administrative industry and commerce management entity.:

Article 33 Paragraph II is changed into: “Audiovisual product distribution work units changing their name, legal representative or main personnel in charge, or terminating business operations, or individuals engaging in audiovisual product distribution business activities changing their business scope, address or terminating business activities, shall go to the originally-registering administrative industry and commerce management entity to conduct registration modification or

 

Article 23: Article 34 is changed into: “Audiovisual publishing work units may according to relevant State regulations, distribute audiovisual products published by that work unit. Those engaging in distribution of audiovisual products not published by that work unit, shall conduct examination and approval procedures according to the provisions of Article 32, and go to the originally-registering administrative industry and commerce management entity to conduct registration formalities.”

 

Article 24: Article 35 is changed into: “The State permits establishment of Sino-foreign cooperative business enterprises engaging in audiovisual product distribution.”

 

Article 25: Article 36 is changed into: “Audiovisual product distribution work units or work units or individuals engaging in audiovisual product distribution work, may not do business in audiovisual products published by non-audiovisual product publishing work units or audiovisual products reproduced by non-audiovisual product reproduction work units, may not do business in audiovisual products imported without State Council administrative publications entity approval, and may not do business in audiovisual products infringing other persons’ copyright.”

 

Article 26: Article 37 is changed into: “Administrative publications entities, administrative industry and commerce management entities or other relevant administrative entities and their personnel, where using their post to facilitate acceptance of other persons property or other benefits, and approve audiovisual product publishing, production, reproduction, import or distribution work units not conforming to statutory establishment conditions, or not implementing supervision duties, or not investigating and prosecuting unlawful activities they discover, creating grave consequences, criminal liability  of the responsible persons in charge and other directly responsible personnel will be investigated according to the law, according to Criminal Law provisions concerning the crime of accepting bribes, the crime of abusing power, the crime of dereliction of duty or other crimes; where it does not yet constitute a crime, administrative punishment of demotion or dismissal will be imposed.”

 

Article 27: Article 39 is changed into: “those without approval or authorization establishing audiovisual product publishing , production, reproduction, import, or distribution work units, without authorization engaging in audiovisual product publishing, production, reproduction or import and distribution business activities, will be banned by the administrative publications entity or administrative industry and commerce management entity according to their statutory powers; in accordance with Criminal Law provisions concerning the crime of illegal business, criminal responsibility will be investigated according to the law; where it does not yet constitute a crime, audiovisual products used in unlawful business and illegal income, as well as special tools and equipment used to conduct illegal activities will be confiscated; where the unlawful business value 10.000 Yuan or more, a fine of five times or more but ten times or less is also imposed; where the unlawful business value is less than 10.000 Yuan, a fine of 50.000 Yuan or less is also imposed.”

 

Article 28: Article 40 is changed into: “Those publishing audiovisual products containing content prohibited by Article 3 Paragraph II of these Regulations, or produce, reproduce or distribute audiovisual products containing content prohibited by Article 3 Paragraph II of these Regulations knowingly or where they should have known; according to relevant Criminal law provisions, criminal liability will be investigated according to the law; where it does not yet constitute a crime, the administrative publications entity or public security entity will order cessation of business for rectifications according do official powers of each, audiovisual products used in unlawful business will be confiscated; where the illegal business value is 10.000 Yuan or more, a fine of five times or more but ten times or less is also imposed; where the unlawful business value is less than 10.000 Yuan, a fine of 50.000 Yuan or less is also imposed; where circumstances are grave, the original permit-issuing organ revokes the permits.”

 

Article 29: Article 42 is changed into: “Where one of the following activities is present, the administrative publications entity orders cessation if the unlawful act, issues a warning, confiscates audiovisual products used in unlawful business and unlawful income; where the unlawful business value is 10.000 or higher, a fine of five times or more but less than ten times is also imposed; where the unlawful business value is less than 10.000 Yuan, a fine of 50.000 Yuan or less is imposed; where circumstances are grave, business cessation for rectification will be issued or the original permit-issuing organ revokes permits:

(1) audiovisual publishing work units renting, lending, selling or in any other way transferring the name of that work unit to other work units or individuals, selling or in another method transferring that work unit’s publication number;

(2) audiovisual publishing work unit entrusting work units not having obtained an “Audiovisual Product Production Permit” to produce audiovisual products, or entrusting work units not having obtained an “Audiovisual Product Reproduction Permit” to reproduce audiovisual products;

(3) audiovisual publishing work units without State Council administrative publications entity approval importing unauthorized audiovisual products;

(4) audiovisual production work units or audiovisual reproduction work units not verifying the audiovisual publishing work unit’s entrustment letter or certification according to the provisions of these Regulations;

(5) audiovisual reproduction work units without authorization reproducing audiovisual products of others, or accepting entrustment to reproduce commercial audiovisual products from non-audiovisual publishing work units or individuals, or reproducing audiovisual products of their own accord.”

 

Article 30: Article 43 is changed into: “Where audiovisual publishing work units violate relevant State regulations and produce audiovisual products in cooperation with Hong Kong SAR, Macau SAR, Taiwan region or foreign organizations or individuals, audiovisual reproduction work units violate relevant State regulations and accept entrustment for reproducing foreign audiovisual products, without examination, verification and agreement of the provincial, autonomous region and municipal People’s Government administrative publications entity, or do not completely export the reproduced foreign audiovisual products outside of the borders,  the provincial, autonomous region and municipal People’s Government administrative publications entity will order rectification, confiscate the audiovisual products used in unlawful business and unlawful income; where the unlawful business value is 10.000 Yuan or higher, a fine of five times or more but less than ten times is also imposed; where the unlawful business value is less than 10.000 Yuan, a fine of 50.000 Yuan or less is also imposed; where circumstances are grave, the original permit-issuing entity will revoke permits.”

 

Article 31: Article 44 is changed into: “Where one of the following activities is present, the administrative publications entity orders rectification and issues a warning; where circumstances are grave, it also orders cessation of business for rectification or the original permit-issuing organ revokes permits:

(1) audiovisual publishing work units not reporting their annual publishing planning or major themes relating to aspects such as national security or social security, etc., to the State Council administrative publications entity for filing;

(2) audiovisual publishing, production, reproduction or distribution work unit changing name, address, legal representative or main person in charge, professional scope, etc., not conducting examination and approval, or filing formalities according to the provisions of these Regulations;

(3) audiovisual publishing work units not indicating on a clear position on published audiovisual products and their packaging the content provided in these Regulations;

(4) audiovisual publishing work units not according to the provisions of these Regulations submitting samples;

(5) audiovisual publishing work units not according to the provisions of these Regulations preserving materials for future reference;

(6) where audiovisual reproduction work units engaging in compact disc reproduction, reproduce compact discs, and using moulding equipment not etched with the State Council administrative publications entity laser digital storage disc source identification code.”

 

Article 32: Article 45 is changed into: “Where one of the following activities is present, the administrative publications entity orders cessation of the unlawful act, issues a warning, confiscates audiovisual products used in unlawful business and unlawful income; where the unlawful business value is 10.000 Yuan or more, a fine of five times or more but less than ten times is also imposed; where the unlawful business value is less than 10.000 Yuan, a fine of 50.000 Yuan or less is also imposed; where circumstances are grave, cessation of business for rectification will be ordered, or the original permit-issuing organ revokes permits:

(1) distributing audiovisual products published by non-audiovisual publishing work units or audiovisual products reproduced by non-audiovisual reproduction work units;

(2) distributing audiovisual products imported without State Council administrative publications entity approval;

(3) distributing audiovisual products imported for research or educational reference or for use in expositions or exhibitions.”

 

Article 33: Article 47 Paragraph I is changed into: “Of work units violating the provisions of these Regulations, that are subject to the administrative punishment of permit revocation, legal representatives or main persons in charge may not undertake the task of audiovisual product publishing, production, reproduction, import or distribution work unit legal representative or main person in charge for ten years from the day of permit revocation.”

Article 47 Paragraph II is changed into: “Individuals engaging in audiovisual product distribution work violating the provisions of these Regulations, who are subject to the administrative punishment of permit revocation, may not engage in audiovisual product distribution work for ten years from the day of permit revocation.”

 

Article 34: Article 49 is changed into: “Apart from Article 35 of these Regulations, these Regulations apply to activities such as electronic publications publishing, production, reproduction, import, distribution, etc.”

These Regulations take effect on (Day) (Month) 2011.

 

The “Audiovisual Product Management Regulations” will be revised corresponding to this Decision, and promulgated anew.

 

国务院关于修改《音像制品管理条例》的决定(送审稿)

 

第一条 国务院决定对《音像制品管理条例》(国务院令第341号)作如下修改:

第二条 将第一条修改为:“为了加强音像制品的管理,促进音像业的健康发展和繁荣,丰富人民群众的文化生活,促进社会主义物质文明和精神文明建设,制定本条例。”

第三条 将第二条第一款修改为:“本条例适用于音像制品的出版、制作、复制、进口、发行等活动。”

在第二条增加一款,作为第二款:“本条例所称音像制品,是指载有录音、录像节目内容的录音带、录像带、唱片、激光唱盘、激光视盘、硬盘芯片等磁带、光盘或移动存储介质以及国务院出版行政部门认定的其他载体形态。”

第四条 将第三条第一款修改为:“出版、制作、复制、进口、发行音像制品,应当遵守宪法和有关法律、法规,坚持为人民服务和为社会主义服务的方向,传播有益于经济发展和社会进步的思想、道德、科学技术和文化知识。”

第五条 将第四条第一款修改为:“国务院出版行政部门负责全国音像制品的出版、制作、复制、进口和发行的监督管理工作;国务院其他有关行政部门按照国务院规定的职责分工,负责有关的音像制品经营活动的监督管理工作。”
将第四条第二款修改为:“县级以上地方人民政府出版管理的行政部门(以下简称出版行政部门)负责本行政区域内音像制品的出版、制作、复制、进口和发行的监督管理工作;县级以上地方人民政府其他有关行政部门在各自的职责范围内负责有关的音像制品经营活动的监督管理工作。”

第六条 将第五条第一款修改为:“国家对出版、制作、复制、进口、发行音像制品,实行许可制度;未经许可,任何单位和个人不得从事音像制品的出版、制作、复制、进口、发行等活动。”

第七条 将第六条修改为:“国务院出版行政部门负责制定音像业的发展规划,确定全国音像出版单位、音像复制单位和音像制品成品进口经营单位的总量、布局和结构。”

第八条 将第九条第一款修改为:“申请设立音像出版单位,由所在地省、自治区、直辖市人民政府出版行政部门审核同意后,报国务院出版行政部门审批。国务院出版行政部门应当自受理申请之日起60日内作出批准或者不批准的决定,并通知申请人。批准的,发给《音像制品出版许可证》,由申请人持《音像制品出版许可证》到工商行政管理部门登记,依法领取营业执照;不批准的,应当说明理由。”

第九条 将第十二条第二款修改为:“音像出版单位应当按照国家有关规定向国家图书馆、中国版本图书馆、国务院出版行政部门和所在地省、自治区、直辖市人民政府出版行政部门免费送交样本。”

第十条 将第十七条第一款修改为:“音像出版单位以外的单位申请设立独立从事音像制品的制作业务的单位(以下简称音像制作单位),由所在地省、自治区、直辖市人民政府出版行政部门审批。省、自治区、直辖市人民政府出版行政部门应当自受理申请之日起60日内作出批准或者不批准的决定,并通知申请人。批准的,发给《音像制品制作许可证》,由申请人持《音像制品制作许可证》到工商行政管理部门登记,依法领取营业执照;不批准的,应当说明理由。广播、电视节目制作经营单位的设立,依照有关法律、行政法规的规定办理。”

第十一条 将第十九条第三款修改为:“音像制作单位不得出版、复制、发行音像制品。”

第十二条 将第二十一条第一款修改为:“申请设立音像复制单位,由所在地省、自治区、直辖市人民政府出版行政部门审核同意后,报国务院出版行政部门审批。国务院出版行政部门应当自受理申请之日起60日内作出批准或者不批准的决定,并通知申请人。批准的,发给《复制经营许可证》,由申请人持《复制经营许可证》到工商行政管理部门登记,依法领取营业执照;不批准的,应当说明理由。”

第十三条 将第二十三条第一款修改为:“音像复制单位接受委托复制音像制品的,应当按照国家有关规定,与委托的出版单位订立复制委托合同;验证委托的出版单位的《音像制品出版许可证》和营业执照副本及其盖章的音像制品复制委托书;接受委托复制的音像制品属于非卖品的,应当验证委托单位的身份证明并由委托单位出具规定格式的音像制品非卖品复制委托书。”

第十四条 将第二十四条修改为:“音像复制单位不得接受非音像出版单位或者个人的委托复制经营性的音像制品;不得自行复制音像制品;不得发行音像制品。”

第十五条 将第二十六条修改为:“音像复制单位接受委托复制境外音像制品的,必须持著作权人的授权书,经省、自治区、直辖市人民政府出版行政部门批准;复制的境外音像制品必须全部运输出境,不得在境内发行。”

第十六条 将第二十七条修改为:“音像制品成品进口业务由国务院出版行政部门批准的音像制品成品进口经营单位经营;未经批准,任何单位或者个人不得经营音像制品成品进口业务。”

第十七条 将第二十八条第一款修改为:“进口用于出版和信息网络传播的音像制品,以及进口用于发行等的音像制品成品,应当报国务院出版行政部门进行内容审查。”
将第二十八条第二款修改为:“国务院出版行政部门应当自收到音像制品内容审查申请书之日起30日内作出批准或者不批准的决定,并通知申请人。批准的,发给批准文件;不批准的,应当说明理由。”
将第二十八条第三款修改为:“进口用于出版和信息网络传播的音像制品的单位、音像制品成品进口经营单位应当持国务院出版行政部门的批准文件到海关办理进口手续。”

第十八条 将第二十九条修改为:“进口用于出版和信息网络传播的音像制品,其著作权事项应当向国务院著作权行政管理部门登记。”

第十九条 将第三十条第二款修改为:“进口用于展览、展示的音像制品,经国务院出版行政部门批准后,到海关办理临时进口手续。”

将第三十条第三款修改为:“依照本条规定进口的音像制品,不得进行经营性复制、发行和放映。”

第二十条 将第三十一条修改为:“设立音像制品发行单位,应当具备下列条件:(一)有音像制品发行单位的名称、章程;(二)有确定的业务范围;(三)有适应业务范围需要的组织机构和人员;(四)有适应业务范围需要的资金和场所;(五)法律、行政法规规定的其他条件。”

第二十一条 将第三十二条修改为:“设立音像制品发行单位或从事音像制品发行业务,应当经出版行政部门批准,取得《出版物经营许可证》。”

第二十二条 将第三十三条第一款修改为:“音像制品发行单位变更名称、业务范围,或者兼并其他音像制品发行单位,或者因合并、分立而设立新的音像制品发行单位的,应当依照本条例第三十二条的规定办理审批手续,并到原登记的工商行政管理部门办理相应的登记手续。”
将第三十三条第二款修改为:“音像制品发行单位变更地址、法定代表人或者主要负责人或者终止经营活动,从事音像制品发行经营活动的个人变更业务范围、地址或者终止经营活动的,应当到原登记的工商行政管理部门办理变更登记或者注销登记,并向原批准的出版行政部门备案。”

第二十三条 将第三十四条修改为:“音像出版单位可以按照国家有关规定,发行本单位出版的音像制品。从事非本单位出版的音像制品的发行业务的,应当依照本条例第三十二条的规定办理审批手续,并到原登记的工商行政管理部门办理登记手续。”

第二十四条 将第三十五条修改为:“国家允许设立从事音像制品发行业务的中外合作经营企业。”

第二十五条 将第三十六条修改为:“音像制品发行单位和从事音像制品发行业务的单位或者个人,不得经营非音像出版单位出版的音像制品或者非音像复制单位复制的音像制品,不得经营未经国务院出版行政部门批准进口的音像制品,不得经营侵犯他人著作权的音像制品。”

第二十六条 将第三十七条修改为:“出版行政部门、工商行政管理部门或者其他有关行政部门及其工作人员,利用职务上的便利收受他人财物或者其他好处,批准不符合法定设立条件的音像制品出版、制作、复制、进口、发行单位,或者不履行监督职责,或者发现违法行为不予查处,造成严重后果的,对负有责任的主管人员和其他直接责任人员依照刑法关于受贿罪、滥用职权罪、玩忽职守罪或者其他罪的规定,依法追究刑事责任;尚不够刑事处罚的,给予降级或者撤职的行政处分。”

第二十七条 将第三十九条修改为:“未经批准,擅自设立音像制品出版、制作、复制、进口、发行单位,擅自从事音像制品出版、制作、复制业务或者进口、发行经营活动的,由出版行政部门、工商行政管理部门依照法定职权予以取缔;依照刑法关于非法经营罪的规定,依法追究刑事责任;尚不够刑事处罚的,没收违法经营的音像制品和违法所得以及进行违法活动的专用工具、设备;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,并处5万元以下的罚款。”

第二十八条 将第四十条修改为:“出版含有本条例第三条第二款禁止内容的音像制品,或者制作、复制、发行明知或者应知含有本条例第三条第二款禁止内容的音像制品的,依照刑法有关规定,依法追究刑事责任;尚不够刑事处罚的,由出版行政部门、公安部门依据各自职权责令停业整顿,没收违法经营的音像制品和违法所得;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,可以并处5万元以下的罚款;情节严重的,并由原发证机关吊销许可证。”

第二十九条 将第四十二条修改为:“有下列行为之一的,由出版行政部门责令停止违法行为,给予警告,没收违法经营的音像制品和违法所得;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,并处5万元以下的罚款;情节严重的,并责令停业整顿或者由原发证机关吊销许可证:(一)音像出版单位向其他单位、个人出租、出借、出售或者以其他任何形式转让本单位的名称,出售或者以其他形式转让本单位的版号的;(二)音像出版单位委托未取得《音像制品制作许可证》的单位制作音像制品,或者委托未取得《复制经营许可证》的单位复制音像制品的;(三)音像出版单位出版未经国务院出版行政部门批准擅自进口的音像制品的;(四)音像制作单位、音像复制单位未依照本条例的规定验证音像出版单位的委托书、有关证明的;(五)音像复制单位擅自复制他人的音像制品,或者接受非音像出版单位、个人的委托复制经营性的音像制品,或者自行复制音像制品的。”

第三十条 将第四十三条修改为:“音像出版单位违反国家有关规定与香港特别行政区、澳门特别行政区、台湾地区或者外国的组织、个人合作制作音像制品,音像复制单位违反国家有关规定接受委托复制境外音像制品,未经省、自治区、直辖市人民政府出版行政部门审核同意,或者未将复制的境外音像制品全部运输出境的,由省、自治区、直辖市人民政府出版行政部门责令改正,没收违法经营的音像制品和违法所得;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,并处5万元以下的罚款;情节严重的,并由原发证机关吊销许可证。”

第三十一条 将第四十四条修改为:“有下列行为之一的,由出版行政部门责令改正,给予警告;情节严重的,并责令停业整顿或者由原发证机关吊销许可证:(一)音像出版单位未将其年度出版计划和涉及国家安全、社会安定等方面的重大选题报国务院出版行政部门备案的;(二)音像制品出版、制作、复制、发行单位变更名称、地址、法定代表人或者主要负责人、业务范围等,未依照本条例规定办理审批、备案手续的;(三)音像出版单位未在其出版的音像制品及其包装的明显位置标明本条例规定的内容的;(四)音像出版单位未依照本条例的规定送交样本的;(五)音像复制单位未依照本条例的规定留存备查的材料的;(六)从事光盘复制的音像复制单位复制光盘,使用未蚀刻国务院出版行政部门核发的激光数码储存片来源识别码的注塑模具的。”

第三十二条 将第四十五条修改为:“有下列行为之一的,由出版行政部门责令停止违法行为,给予警告,没收违法经营的音像制品和违法所得;违法经营额1万元以上的,并处违法经营额5倍以上10倍以下的罚款;违法经营额不足1万元的,并处5万元以下的罚款;情节严重的,并责令停业整顿或者由原发证机关吊销许可证:(一)发行非音像出版单位出版的音像制品或者非音像复制单位复制的音像制品的;(二)发行未经国务院出版行政部门批准进口的音像制品的;(三)发行供研究、教学参考或者用于展览、展示的进口音像制品的。”

第三十三条 将第四十七条第一款修改为:“单位违反本条例的规定,被处以吊销许可证行政处罚的,其法定代表人或者主要负责人自许可证被吊销之日起10年内不得担任音像制品出版、制作、复制、进口、发行单位的法定代表人或者主要负责人。”

将第四十七条第二款修改为:“从事音像制品发行业务的个人违反本条例的规定,被处以吊销许可证行政处罚的,自许可证被吊销之日起10年内不得从事音像制品发行业务。”

第三十四条 将第四十九条修改为:“除本条例第三十五条外,电子出版物的出版、制作、复制、进口、发行等活动适用本条例。”

本决定自2011年  月   日起施行。

《音像制品管理条例》根据本决定作相应的修改,重新公布。
