The “Management Rules for the Subscription and Ordering of Foreign Publications” were passed at the first Administration meeting of the General Administration of Press and Publications on 17 March 2011, is hereby promulgated, and takes effect on the date of promulgation.

Management Rules for the Subscription and Ordering of Foreign Publications

Article 1: In order to satisfy the reading demands of domestic work units and individuals, foreign bodies in China, foreign-invested enterprises’ foreigners and Hong Kong, Macau and Taiwan persons concerning foreign publications, and strengthen management over imported publications, on the basis of the “Publishing Management Regulations and relevant laws, regulations and rules, these Rules are formulated.

Article 2: These Rules apply to the subscription to and ordering of imported periodicals within the borders of China.

Imported publications as named in these Rules, refers to books, newspapers (including old newspapers), periodicals (including old periodicals), electronic publications, etc., that are imported by publications import business work units, that are published abroad as well in the Hong Kong Special Administrative Region, the Macau Special Administrative Region and the Taiwan region.

Publications import business work units as named in these Rules, refers to work units established according to the “Publishing Management Regulations”, which engage in publications import business operations.

Subscription as named in these Rules, refers to domestic work units and individuals, foreign bodies in China, foreign invested enterprises, foreigners, as well as Hong Kong, Macau and Taiwan persons who live permanently in China for work, study or life ordering imported publications through publication import business work units.

Ordering as named in these Rules, refers to subscribers placing an order for purchase of imported publications with a publications import business work units, in order to satisfy the reading demands of the work unit or individual concerned.

Article 3: Imported publications are divided into two categories: those limited in distribution scope and those not limited in distribution scope, the State implements differentiated management over their distribution.

A subscriber purchasing and differentiated supply distribution method is implemented for imported newspapers, periodicals, books, electronic publications, etc., with limited distribution scope; distribution system integrating voluntary subscriber purchasing and market sales is implemented for imported newspapers and periodicals that are not limited in distribution scope; a market sales distribution method is implemented for imported books, electronic publications, etc., that are not limited in scope.

The categories of imported newspapers, periodicals, books and electronic publications that are limited in distribution scope are determined by the General Administration of Press and Publications.

Article 4: Subscribers ordering imported publications are to be served by publications import business work units. Within this, the business of subscribers ordering imported newspapers, periodicals, books and electronic publications with limited distribution scope must be operated by publications import businesses appointed by the General Administration of Press and Publications.

Without approval from the General Administration of Press and Publications, no work unit or individual may engage in business activities of subscription or ordering imported publications.

Publications import business work units entrusting non-publications import business work unit as agents to solicit subscriptions or as agents for delivery of imported publications, must report in advance to the General Administration of Press and Publications for agreement.

Article 5: Domestic work units subscribing to or ordering imported newspapers or periodicals that are not limited in distribution scope, are to go directly to a newspaper or periodical importing business work units with the work unit’s ordering request letter and handle purchasing formalities. Domestic individuals subscribing shall carry out ordering formalities through their work unit.

Article 6: Domestic work units permitted to order imported newspapers, periodicals, books and electronic publications with limited distribution scope are determined by the General Administration of Press and Publications.

Article 7: For domestic work units subscribing to or ordering imported newspapers, periodicals, books, electronic publications, etc., with limited distribution scope, central work units’ subscriptions are approved by the central ministry of commission to which they are subordinate; local work units’ subscriptions are to be submitted to the same level’s Party Committee Propaganda Department for examination and approval after examination and verification by the local provincial, autonomous region or municipal administrative press and publications department. Subscribers obtaining approval are to go to the publications importing business work unit appointed by the General Administration of Press and Publications with the work unit’s subscription application letter and relevant approval documents, and carry out ordering formalities.

Domestic work units subscribing to or ordering imported newspapers, periodicals, books, electronic publications, etc., with limited distribution scopes shall formulate corresponding usage management rules.

Article 8: Foreign organs in China, foreign-invested enterprises and foreign nationals and Hong Kong, Macau and Taiwan persons who work, study or live in China permanently who subscribe to or order imported newspapers or periodicals shall go to a newspaper or periodical importing business work unit appointed by the General Administration of Press and publications with the work unit’s subscription application letter or their individual identity document to conduct subscription formalities.

Article 9: Publications import business work units are responsible for examining the subscribers of imported newspapers, periodicals, books and electronic publications with a limited distribution scope, and shall report a name list of subscribers and the titles and quantities of newspapers, periodicals, books and electronic publications they intend to purchase to the General Administration of Press and Publications for approval, after examination and verification. Publications import business work units are to supply subscriptions according to the list of subscribers, titles and quantities of imported newspapers, periodicals, books and electronic publications that has been approved.

Article 10: Without permission engaging in unauthorized imported publications subscription or ordering activities is punished according to Article 61 of the “Publishing Management Regulations.

Those violating other provisions of this law are ordered to correct matters and issued with a warning by administrative press and publications departments; where circumstances are grave, a fine of 30.000 Yuan or less may additionally be imposed.

Article 11: These Rules take effect on the date of promulgation. The “Management Rules for the Subscription and Ordering of Imported Publications” promulgated by the General Administration of Press and Publications are abolished at the same time.

订户订购进口出版物管理办法

第一条 为了满足国内单位和个人、在华外国机构、外商投资企业外籍人士和港、澳、台人士对进口出版物的阅读需求,加强对进口出版物的管理,根据《出版管理条例》和有关法律、法规,制定本办法。
第二条 在中国境内订户订购进口出版物适用本办法。
本办法所称进口出版物,是指由出版物进口经营单位进口的,在外国以及在中国香港特别行政区、澳门特别行政区和台湾地区出版的图书、报纸(含过期报纸)、期刊(含过期期刊)、电子出版物等。
本办法所称出版物进口经营单位,是指依照《出版管理条例》设立的从事出版物进口业务的单位。
本办法所称订户,是指通过出版物进口经营单位订购进口出版物的国内单位和个人、在华外国机构、外商投资企业和在华长期工作、学习、生活的外籍人士以及港、澳、台人士。
本办法所称订购,是指订户为满足本单位或者本人的阅读需求,向出版物进口经营单位预订购买进口出版物。
第三条 进口出版物分为限定发行范围的和非限定发行范围的两类,国家对其发行实行分类管理。
进口限定发行范围的报纸、期刊、图书、电子出版物等实行订户订购、分类供应的发行方式;非限定发行范围的进口报纸、期刊实行自愿订户订购和市场销售相结合的发行方式;非限定发行范围的进口图书、电子出版物等实行市场销售的发行方式。
限定发行范围的进口报纸、期刊、图书、电子出版物的种类由新闻出版总署确定。
第四条 订户订购进口出版物由出版物进口经营单位经营。其中,订户订购限定发行范围的进口报纸、期刊、图书、电子出版物的业务,须由新闻出版总署指定的出版物进口经营单位经营。
未经新闻出版总署批准,任何单位和个人不得从事订户订购进口出版物的经营活动。
出版物进口经营单位委托非出版物进口经营单位代理征订或者代理配送进口出版物,须事先报新闻出版总署同意。
第五条 国内单位订户订购非限定发行范围的进口报纸、期刊,持单位订购申请书,直接到新闻出版总署批准的报纸、期刊进口经营单位办理订购手续。国内个人订户应通过所在单位办理订购手续。
第六条 可以订购限定发行范围的进口报纸、期刊、图书和电子出版物的国内单位订户由新闻出版总署确定。
第七条 国内单位订户订购限定发行范围的进口报纸、期刊、图书、电子出版物等,中央单位订户由所属中央各部委审批;地方单位订户经所在地省、自治区、直辖市新闻出版行政部门审核后报送同级党委宣传部审批。获得批准的订户持单位订购申请书和有关批准文件,到新闻出版总署指定的出版物进口经营单位办理订购手续。
国内单位订户订购限定发行范围的进口报纸、期刊、图书、电子出版物等,应制定相应的使用管理办法。
第八条 在华外国机构、外商投资企业和在华长期工作、学习、生活的外籍人士和港、澳、台人士订购进口报纸、期刊,应持单位订购申请书或者本人身份证明,到新闻出版总署批准或者指定的报纸、期刊进口经营单位办理订购手续。
第九条 出版物进口经营单位负责对订购限定发行范围的进口报纸、期刊、图书、电子出版物的订户进行审核,并将审核后的订户名单、拟订购进口报纸、期刊、图书、电子出版物的品种和数量报送新闻出版总署批准。出版物进口经营单位依照批准后的订户名单及进口报纸、期刊、图书、电子出版物的品种和数量供应订户。
第十条 未经批准,擅自从事进口出版物的订户订购业务,按照《出版管理条例》第六十一条处罚。
违反本办法其他规定的,由新闻出版行政部门责令改正,给予警告;情节严重的,并处3万元以下的罚款。
第十一条 本办法自公布之日起施行。新闻出版总署2004年12月31日颁布的《订户订购进口出版物管理办法》同时废止。
