Internet Information Service Management Rules (Opinion-Seeking Version of Revision Draft)

Chapter I: General provisions

Article 1: In order to stimulate the healthy and orderly development of Internet information services, safeguard national security and the public interest, protect the lawful rights and interests of citizens and Internet information service providers, and standardize Internet information services activities, these Rules are formulated.

Article 2: When engaging in Internet information services activities within the borders of the People’s Republic of China, these Rules shall be obeyed.

Internet information services as named in these rules, refers to providing information services through the Internet.

Article 3: The State Internet information content controlling department is responsible for Internet information content management according to their duties, and coordinates with the State Council telecommunications controlling department, the State Council public security department and other corresponding departments to implement supervision and management over Internet information content.

The State Council telecommunications controlling department is responsible for Internet sector management according to their duties, and is responsible for implementing supervision and management over Internet information service market access, market order, network resources, network information security, etc.

The State Council public security department is responsible for Internet security supervision according to their duties, safeguarding Internet public order and public security, guarding against and punishing network lawbreaking and criminal activities.

Other State Council departments implement management over Internet information within the scope of responsibility of each.

Local Internet information service management responsibilities are determined according to relevant State regulations.

Article 4: The State encourages Internet information service providers to disseminate information beneficial to raising the quality of the nation and promoting economic and social development.

Article 5: The State encourages Internet information service providers to launch sector self-discipline activities, and encourages public supervision of Internet information services.

Chapter II: Establishment

Article 6: Internet information services are divided into two categories: commercial and non-commercial.

When engaging in commercial Internet information services, an Internet information services added value telecommunications business license issued by the telecommunications controlling department shall be obtained; when engaging in non-commercial Internet information services, this shall be filed with the telecommunications controlling department. Those who have not obtained a licence or have not carried out filing formalities, may not engage in Internet information services.

Article 7: When engaging in Internet information services, no punishment of the telecommunications management department cancelling Internet information services added value telecommunications service business licence credentials or filing cancellation may have been received for three years.

When applying for an Internet information services value-added telecommunications business licence or carrying out filing formalities, the following materials shall be provided to the telecommunications controlling department:

(1) the real identity certification documents, address, contact method and other basic situations of the organizer and other related persons;

(2) the name, Internet address, server location and access service provider that are aimed to be used and other relevant situations;

(3) the licensing documents of the service programme that is aimed to be provided and corresponding controlling department;

(4) security inspection opinions provided by the public security organs.

When engaging in Internet information services, network security and information security management systems and technological guarantee measures conform to State regulations must be in place.

Article 8: When engaging in Internet information services, apart from obeying the provisions of Article 7 of these Rules, the following conditions shall also be met:

(1) the operator is a lawfully registered enterprise legal person;

(2) having funding, premises, facilities and specialist personnel corresponding to engaging in Internet information services;

(3) having the capacity to provide long-term services to users that can be proven;

(4) having business development plans and corresponding technological plans.

Article 9: When applying to engage in commercial Internet information services, the application shall be put to the telecommunications controlling department, the telecommunications controlling department shall complete examination within 60 days of receiving the application, and make a decision of approval or non-approval.

Article 10: When engaging in Internet information services, involving the following service programmes, permission shall be obtained from the corresponding controlling department.

(1) engaging in Internet news information services, providing services for Internet users to publish information to the public, and provide Internet information search services, must be permitted by the Internet information content controlling department;

(2) engaging in culture, publishing, audiovisual programme, education, medical care, drugs and medical apparatuses and other Internet information services, must be permitted by relevant controlling department according to laws, administrative regulations as well as State provisions, the permission result is to be reported to the State Internet information content management department for filing.

Licensing conditions, procedures, periods, materials to be submitted, etc., concerning services of providing services for Internet users to publish information to society as listed in Clause (1) of the previous Paragraph, and providing Internet information search services, are published by the State Internet information content controlling department.

Chapter III: Operation

Article 11: Internet access service providers shall examine the lawful qualifications. of Internet information service providers, and may not provide services to Internet information service providers that have not obtained lawful qualifications.

Where engaging in services using the Internet requires obtaining corresponding qualifications according to the provisions of laws and administrative regulations, the Internet information service provider shall examine and approve the lawful qualifications of the service counterpart.

Article 12: Internet information service providers shall, when providing services, clearly display their licence number or filing number.

Where change occurs in Internet information service providers’ licensing or filing matters, it shall conduct modification formalities with the original licensing or filing department.

Article 13: Internet information service providers may not violate the lawful rights and interests of other Internet information service providers.

Article 14: Internet information service providers and Internet access service providers shall establish network security and information security management, public information patrol, emergency management, user information security management and other systems and put in place security guard measures.

Article 15: Internet information service providers providing services for Internet users to publish information to the public, shall require users to use the real identity information to register.

Internet access service providers shall record the real identity information, website name, Internet address and other information of Internet information service providers for which they provide access.

Article 16: Internet information service providers shall record the published information and the information published by service counterparts, and preserve this for six months.

Internet information service providers and Internet access service providers shall record daily information and preserve it for 12 months, and provide technological support for inquiry according to the law by public security organs and national security organs.

Article 17: Internet information service providers and Internet access service providers bear the duty to keep users’ identity information, daily record information and other information secret, and may not sell, distort, wilfully divulge or illegally use users’ individual information.

Article 18: No work unit or individual may produce, reproduce, distribute, or disseminate information with the following content, or wilfully provide services for producing, reproducing, distributing or disseminating information with the following content:

(1) opposing the basic principles determined in the Constitution;

(2) endangering national security, divulging State secrets, subverting the State regime, destroying national unity;

(3) damaging the honour or interests of the State;

(4) inciting ethnic hatred and ethnic discrimination, destroying ethnic unity;

(5) destroying State religious policies, propagating heresy and feudal superstition;

(6) spreading rumours, inciting illegal assemblies, disordering social order, destroying social stability;

(7) disseminating obscenity, sex, gambling, violence, murder, terror or instigating crime, or trading and producing prohibited products, controlled goods, etc.;

(8) insulting or slandering other persons, harming other persons’ lawful rights and interests, or imitating and using the name of State organs, social organizations and other legal persons;

(9) containing other content prohibited by laws and administrative regulations.

Article 19: Internet information service providers and Internet access service providers clearly knowing that distributed or transmitted information falls under content listed in Article 18 of these Rules, shall immediately cease distribution or transmission, preserve relevant records and report this to the Internet information content controlling department and the public security organs.

Relevant State departments may adopt measures to prevent the dissemination of information falling under content listed in Article 18 of these Rules.

Chapter IV: Supervision and inspection

Article 20: The Internet information content controlling department,, the telecommunications controlling department and other relevant departments shall make the licensing and filing situation of concerning Internet information services public, the public has the right to consult the relevant licensing and filing situation.

Article 21: When Internet information content controlling department, telecommunications controlling department, public security organs and other relevant departments’ work personnel implement their supervision, inspection and law enforcement duties according to the law, Internet information service providers and Internet access service providers shall grant cooperation, and may not refuse or obstruct.

Article 22: When Internet information content controlling department, telecommunications controlling department, public security organs and other relevant departments’ work personnel implement their supervision, inspection and law enforcement duties according to the law, there shall be at least two personnel having administrative law enforcement qualifications. participating, and they shall actively show their law enforcement credentials.

Article 23: Internet information content controlling department, telecommunications controlling department, public security organs and other relevant departments’ work personnel shall record the situation of supervision, inspection and law enforcement and the processing results. Supervision and inspection records and law enforcement records are signed and filed by law enforcement personnel. The public has the right to consult supervision and inspection records.

Article 24: The Internet information content controlling department, the telecommunications controlling department, public security organs and other relevant departments shall establish information sharing and information communication systems.

Article 25: The Internet information content controlling department, the telecommunications controlling department, public security organs and other relevant departments shall establish public reporting systems, and make the reporting contact method public.

Where any work unit or individual discovers that Internet information service providers or Internet access service providers act in violation of these Rules, they have the right to report this to the relevant department.

When the Internet information content controlling department, the telecommunications controlling department, public security organs and other relevant departments receive reports, they shall record them and timely investigate and handle this according to the law; where this does not fall within the scope of responsibility of their organs, they shall timely transfer cases to relevant departments.

Chapter V: Legal responsibility

Article 26: Where Internet information content controlling department, telecommunications controlling department, public security organs and other relevant departments’ work personnel, neglect their duties, abuse their authority, or engage in favouritism, the directly responsible controlling person and other directly responsible persons will be punished according to the law.

Article 27: Concerning those engaging in authorized Internet information services without obtaining an Internet information services added value telecommunications business licence or without carrying out filing formalities, the telecommunications controlling department will order Internet access service providers to cease to provide access services to them; where there is unlawful income, the unlawful income is confiscated, and a fine of three to five times the unlawful income imposed.

Article  28: Concerning those engaging in Internet information services provided in Article 10 of these rules without authorization, and without obtaining licensing, the telecommunications controlling department will order Internet access service providers to cease to provide access services to them; where there is unlawful income, the unlawful income is confiscated, and a fine of three to five times the unlawful income imposed; where circumstances are grave, the telecommunications controlling department cancels the Internet information services value added telecommunications business licence or cancels filing.

Article 29: Where Internet information service providers do not implement their duties as provided in Article 11 of these Rules, the Internet information content controlling department, the telecommunications controlling department or public security organs, according to their duties, issue warnings and order rectification within a limited period; where there is unlawful income, unlawful income is confiscated, and a fine of three to five times the unlawful income imposed; those not rectifying within the time limit, will be ordered to suspend or cease corresponding Internet information services, or the telecommunications controlling department even cancels the Internet information services value added telecommunications business licence or cancels filing.

Article 30: Where Internet information service providers violate the provisions of these Rules, and one of the following circumstances is present, the original licensing or filing organ issues a warning and orders rectification within a limited time; of those not rectifying within the time limit, the corresponding license credentials are revoked or cancelled, or filing is cancelled:

(1) having obtained licenses or carried out filing formalities while not having truthfully provided corresponding information;

(2) not having clearly displayed the licence number or filing number when providing Internet information services, or displaying a false number;

(3) not having timely conducted modification formalities.

Article 31: Internet information service providers violating the provisions of Article 13 of these Rules, are issued a warning by the telecommunications controlling department, and a fine of 100.000 Yuan or more but less than 1 million Yuan is additionally imposed; where circumstances are grave, suspension of corresponding Internet information services is ordered, or the Internet information services value added telecommunications business licence is revoked or filing cancelled .

Article 32: Internet information service providers not having implemented their duties according to the provisions of Article 14, Article 15 and Article 16 of these Rules, are issued with a warning or ordered to rectify within a limited time by the Internet information content controlling department, the telecommunications controlling department or public security organs according to their responsibilities; those not rectifying within the time limited, will be ordered to suspend or cease corresponding Internet information services, or the telecommunications controlling department even cancels the Internet information services value added telecommunications business licence or cancels filing.

Article 33: Internet access service providers violating the provision of Article 11, Article 14 and Article 15 of these Provisions, are issued a warning and ordered to rectify within a limited time by the telecommunications controlling department, and a fine of 100.000 Yuan or more but less than 1 million Yuan is imposed additionally; where circumstances are grave, their telecommunications business licence credentials are cancelled.

Internet access service providers violating the provisions of Article 16 and Article 19 of these Rules, are issued a warning and ordered to rectify within a limited time by the telecommunications controlling department or public security organs; those not rectifying within the time limit, are fined 100.000 Yuan but less than 1 million Yuan by the telecommunications controlling department; where circumstances are grave, their telecommunications business licence credentials are cancelled.

Internet access service providers violating the provision of Article 18 of these Rules, and wilfully provide services for producing, reproducing, distributing or disseminating illegal information, are ordered to cease the unlawful activity by the telecommunications controlling department or public security organs according to their responsibilities; where there is unlawful income, the telecommunications controlling department confiscates the unlawful income, and imposes a fine of three to five times the unlawful income; where circumstances are grave, their telecommunications business licence credentials are cancelled.

Article 34: Internet information service providers and Internet access service providers violating the provisions of Article 17 of these Rules, are ordered to rectify by the telecommunications controlling department or public security organs according to their responsibilities, the unlawful income is confiscated; where the unlawful income is higher than 50.000 Yuan, a fine of three to five times the unlawful business income is additionally imposed; where the unlawful income is less than 50.000 Yuan or there is no unlawful income, a fine of 100.000 Yuan or more but less than 150.000 Yuan is additionally imposed; where circumstances are grave, temporary suspension of the corresponding service is imposed, or the telecommunications controlling department even cancels the Internet information services value added telecommunications business licence or cancels filing.

Article  35: Internet information service providers violating the provisions of Article 18 or Article 19 of these Rules, are ordered to cease the unlawful activity by the Internet information content controlling department or the public security organs according to their duties; where there is unlawful income, the unlawful income is confiscated, and a fine of three to five times the unlawful income is additionally imposed; also, the telecommunications controlling department cancels the Internet information services value added telecommunications business licence or cancels filing.

Other work units and individuals will be punished on the basis of corresponding laws and regulations.

Article 36: Concerning violating these regulations, and where the telecommunications controlling department cancels the Internet information services value added telecommunications business licence or cancels filing, the corresponding Internet access service providers and domain name analysis service provider will be notified by the telecommunications controlling department to cease their service provision. Where it involves service programmes provided by Article 10 of these Rules, the telecommunications controlling department also notifies the relevant departments, and the relevant departments cancel the corresponding licence credentials.

Article 37: Where violation of the provisions of these Rules constitutes a crime, criminal responsibility will be investigated according to the law.

Chapter VI: Supplementary provisions

Article 38: Providing services for Internet users to publish information to society as named in these Rules, refers to services of providing information publishing conditions to Internet users, and includes what is generally known as forums, blogs, microblogs, etc.

Article 39: Those already engaging in providing services for Internet users to publish information to society before the implementation of these Rules, or providing Internet information search services, shall carry out licensing formalities according to the provisions of these Rules. Among these, those who do not possess the conditions provided in these Rules, shall achieve the conditions provided in these Rules within six months of implementation of these rules; those not achieving the conditions provided in these Rules at the end of this time limit, are banned by the Internet information content controlling department.

Article 40: These Rules take effect on (day, month, year). The “Internet Information Service Management Rules” promulgated on 25 September 2000 by the State Council are abolished at the same time.

互联网信息服务管理办法

(修订草案征求意见稿)

第一章总则

第一条为了促进互联网信息服务健康有序发展,维护国家安全和公共利益,保护公众和互联网信息服务提供者的合法权益,规范互联网信息服务活动,制定本办法。

第二条在中华人民共和国境内从事互联网信息服务活动,应当遵守本办法。

本办法所称互联网信息服务,是指通过互联网提供信息服务的活动。

第三条国家互联网信息内容主管部门依照职责负责互联网信息内容管理,协调国务院电信主管部门、国务院公安部门及其他相关部门对互联网信息内容实施监督管理。

国务院电信主管部门依照职责负责互联网行业管理,负责对互联网信息服务的市场准入、市场秩序、网络资源、网络信息安全等实施监督管理。

国务院公安部门依照职责负责互联网安全监督,维护互联网公共秩序和公共安全,防范和惩治网络违法犯罪活动。

国务院其他有关部门在各自职责范围内对互联网信息服务实施管理。

地方互联网信息服务管理职责依照国家有关规定确定。

第四条国家鼓励互联网信息服务提供者传播有益于提高民族素质、推动经济社会发展的信息。

第五条国家鼓励互联网信息服务提供者开展行业自律活动,鼓励公众监督互联网信息服务。

第二章设立

第六条互联网信息服务分为经营性和非经营性两类。

从事经营性互联网信息服务,应当获得电信主管部门颁发的互联网信息服务增值电信业务经营许可;从事非经营性互联网信息服务,应当在电信主管部门备案。未取得许可或者未履行备案手续的,不得从事互联网信息服务。

第七条从事互联网信息服务,应在三年内未受到电信主管部门吊销互联网信息服务增值电信业务经营许可证件或者取消备案的处罚。

在申请互联网信息服务增值电信业务经营许可或者履行备案手续时,应当向电信主管部门提供以下材料:

(一)主办者等相关人员的真实身份证明文件、地址、联系方式等基本情况;

(二)拟使用的网站名称、互联网地址、服务器所在地、接入服务提供者等有关情况;

(三)拟提供的服务项目及相关主管部门的许可文件;

(四) 公安机关出具的安全检查意见。

从事互联网信息服务,应当具备符合国家规定的网络安全与信息安全管理制度和技术保障措施。

第八条从事经营性互联网信息服务,除应当遵守本办法第七条的规定外,还应当具备以下条件:

(一)经营者为依法设立的企业法人;

(二)有与从事互联网信息服务相适应的资金、场所、设施和专业人员;

(三)有可以证明为用户提供长期服务的能力;

(四)有业务发展计划及相关技术方案。

第九条申请从事经营性互联网信息服务,应当向电信主管部门提出申请,电信主管部门应当自受理申请之日起60日内审查完毕,作出批准或者不予批准的决定。

第十条从事互联网信息服务,涉及以下服务项目的,应当获得相应主管部门的许可:

(一)从事互联网新闻信息服务,提供由互联网用户向公众发布信息的服务,及提供互联网信息搜索服务,须经互联网信息内容主管部门许可;

(二)从事文化、出版、视听节目、教育、医疗保健、药品和医疗器械等互联网信息服务,依照法律、行政法规以及国家有关规定须经有关主管部门许可,许可结果报国家互联网信息内容主管部门备案。

前款第一项中提供由互联网用户向公众发布信息的服务,及提供互联网信息搜索服务的许可条件、程序、期限及需要提供的材料等,由国家互联网信息内容主管部门公布。

第三章运行

第十一条互联网接入服务提供者应当查验互联网信息服务提供者的合法资质,不得为未取得合法资质的互联网信息服务提供者提供服务。

利用互联网从事的服务依照法律、行政法规的规定需要取得相应资质的,互联网信息服务提供者应当查验服务对象的合法资质。

第十二条互联网信息服务提供者应当在提供服务时明示许可证编号或者备案编号。

互联网信息服务提供者许可或者备案事项发生变更的,应当向原许可或者备案机关办理变更手续。

第十三条互联网信息服务提供者不得侵犯其他互联网信息服务提供者和用户的合法权益。

第十四条互联网信息服务提供者、互联网接入服务提供者应当建立网络安全与信息安全管理、公共信息巡查、应急处置、用户信息安全管理等制度及具备安全防范措施。

第十五条提供由互联网用户向公众发布信息服务的互联网信息服务提供者,应当要求用户用真实身份信息注册。

互联网接入服务提供者应当记录其所接入的互联网信息服务提供者的真实身份信息、网站名称、互联网地址等信息。

第十六条互联网信息服务提供者应当记录所发布的信息和服务对象所发布的信息,并保存6个月。

互联网信息服务提供者、互联网接入服务提供者应当记录日志信息,保存12个月,并为公安机关、国家安全机关依法查询提供技术支持。

第十七条互联网信息服务提供者、互联网接入服务提供者对用户的身份信息、日志信息等个人信息负有保密义务,不得出售、篡改、故意泄露或违法使用用户的个人信息。

第十八条任何单位和个人不得制作、复制、发布、传播含有下列内容的信息,或者故意为制作、复制、发布、传播含有下列内容的信息提供服务:

(一)反对宪法所确定的基本原则的;

(二)危害国家安全,泄露国家秘密,颠覆国家政权,破坏国家统一的;

(三)损害国家荣誉和利益的;

(四)煽动民族仇恨、民族歧视,破坏民族团结的;

(五)破坏国家宗教政策,宣扬邪教和封建迷信的;

(六)散布谣言,煽动非法聚集,扰乱社会秩序,破坏社会稳定的;

(七)散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪,或者交易、制造违禁品、管制物品的;

(八)侮辱或者诽谤他人,侵害他人合法权益的,或者仿冒、假借国家机构、社会团体或其他法人名义的;

(九)含有法律、行政法规禁止的其他内容的。

第十九条互联网信息服务提供者、互联网接入服务提供者明知发布、传输的信息属于本办法第十八条所列内容的,应当立即停止发布、传输,保存有关记录,向互联网信息内容主管部门、公安机关报告。

国家有关部门可以采取措施阻断属于本办法第十八条所列内容的信息的传播。
第四章监督检查

第二十条互联网信息内容主管部门、电信主管部门和其他有关部门应当向社会公开对互联网信息服务的许可、备案情况,公众有权查阅有关许可、备案情况。

第二十一条互联网信息内容主管部门、电信主管部门、公安机关和其他有关部门工作人员依法履行监督检查、执法职责时,互联网信息服务提供者、互联网接入服务提供者应当予以配合,不得拒绝、阻挠。

第二十二条互联网信息内容主管部门、电信主管部门、公安机关和其他有关部门工作人员依法履行监督检查、执法职责,至少应有两名具有行政执法资格的人员参加,并主动出示执法证件。

第二十三条互联网信息内容主管部门、电信主管部门、公安机关和其他有关部门工作人员应当记录监督检查、执法的情况和处理结果。监督检查记录、执法记录由执法人员签字归档。公众有权查阅监督检查记录。

第二十四条互联网信息内容主管部门、电信主管部门、公安机关和其他有关部门应当建立信息共享和信息通报制度。

第二十五条互联网信息内容主管部门、电信主管部门、公安机关和其他有关部门应当建立公众举报制度,向社会公开举报联系方式。

任何单位和个人发现互联网信息服务提供者、互联网接入服务提供者有违反本办法行为的,有权向有关部门举报。

互联网信息内容主管部门、电信主管部门、公安机关和其他有关部门接到举报应当记录并及时依法调查处理;对不属于本部门职责范围的,应当及时移送有关部门。

第五章法律责任

第二十六条互联网信息内容主管部门、电信主管部门、公安机关和其他有关部门工作人员,玩忽职守、滥用职权、徇私舞弊的,对直接负责的主管人员和其他直接责任人员依法给予处分。

第二十七条未取得互联网信息服务增值电信业务经营许可或者未履行备案手续,擅自从事互联网信息服务的,由电信主管部门责令互联网接入服务提供者停止为其提供接入服务;有违法所得的,没收违法所得,处违法所得3倍以上5倍以下罚款。

第二十八条未经许可,擅自从事本办法第十条规定互联网信息服务的,由互联网信息内容主管部门或有关主管部门依照职责责令停止相关互联网信息服务;有违法所得的,没收违法所得,处违法所得3倍以上5倍以下罚款;情节严重的,由电信主管部门吊销其互联网信息服务增值电信业务经营许可证件或者取消备案。

第二十九条互联网信息服务提供者未履行本办法第十一条规定义务的,由互联网信息内容主管部门、电信主管部门、公安机关依照职责给予警告,责令限期改正;有违法所得的,没收违法所得,处违法所得3倍以上5倍以下罚款;逾期未改正的,责令暂停或停止相关互联网信息服务,直至由电信主管部门吊销其互联网信息服务增值电信业务经营许可证件或者取消备案。

第三十条互联网信息服务提供者违反本办法规定,有下列行为之一的,由原许可、备案机关给予警告,责令限期改正;逾期未改正的,吊销或者撤销其相应许可证件或者取消备案:

(一)未如实提供相关材料取得许可或者办理备案手续的;

(二)未在提供互联网信息服务时明示许可证件编号或者备案编号,或者标注虚假编号的;

(三)未及时办理变更手续的。

第三十一条互联网信息服务提供者违反本办法第十三条规定的,由电信主管部门给予警告,并处10万元以上100万元以下罚款;情节严重的,责令暂停相关互联网信息服务,直至吊销其互联网信息服务增值电信业务经营许可证件或者取消备案。

第三十二条互联网信息服务提供者未履行本办法第十四条、第十五条、第十六条规定义务的,由互联网信息内容主管部门、电信主管部门、公安机关依照职责给予警告,责令限期改正;逾期未改正的,责令暂停或停止相关互联网信息服务,直至由电信主管部门吊销其互联网信息服务增值电信业务经营许可证件或者取消备案。

第三十三条互联网接入服务提供者违反本办法第十一条、第十四条、第十五条规定的,由电信主管部门给予警告,责令限期改正,并处10万元以上100万元以下罚款;情节严重的,吊销其电信业务经营许可证件。

互联网接入服务提供者违反本办法第十六条、第十九条规定的,由电信主管部门、公安机关依照职责给予警告,责令限期改正;逾期未改正的,由电信主管部门处10万元以上100万元以下罚款;情节严重的,吊销其电信业务经营许可证件。

互联网接入服务提供者违反本办法第十八条规定,故意为制作、复制、发布、传播违法信息提供服务的,由电信主管部门、公安机关依照职责责令停止违法活动;有违法所得的,由电信主管部门没收违法所得,处违法所得3倍以上5倍以下罚款;情节严重的,吊销其电信业务经营许可证件。

第三十四条互联网信息服务提供者、互联网接入服务提供者违反本办法第十七条规定的,由电信主管部门、公安机关依照职责责令改正,没收违法所得;违法所得5万元以上的,并处违法所得3倍以上5倍以下罚款;违法所得不足5万元或者没有违法所得的,处10万元以上15万元以下罚款;情节严重的,责令暂停相关服务,直至由电信主管部门吊销其电信业务经营许可证件或者取消备案。

第三十五条互联网信息服务提供者违反本办法第十八条、第十九条规定的,由互联网信息内容主管部门、公安机关依照职责责令停止违法活动;有违法所得的,没收违法所得,处违法所得3倍以上5倍以下罚款;并由电信主管部门吊销其互联网信息服务增值电信业务经营许可证件或者取消备案。

对其他单位和个人,依据相关法律法规予以处罚。

第三十六条违反本办法规定,被电信主管部门吊销互联网信息服务增值电信业务经营许可证件或者取消备案的,由电信主管部门通知相关互联网接入服务提供者和域名解析服务提供者停止为其提供服务。涉及本办法第十条规定服务项目的,并由电信主管部门通知有关部门,由有关部门吊销其相应许可证件。

第三十七条违反本办法规定,构成犯罪的,依法追究刑事责任。

第六章附则

第三十八条本办法所称提供由互联网用户向公众发布信息的服务,是指为互联网用户提供信息发布条件的服务,包括通常所称的论坛、博客、微博客等。

第三十九条本办法施行前已经从事提供由互联网用户向公众发布信息的服务,或者提供互联网信息搜索服务的,应当依照本办法的规定办理许可手续。其中,不完全具备本办法规定条件的,应当自本办法施行之日起6个月内达到本办法规定的条件;逾期未达到本办法规定条件的,由互联网信息内容主管部门予以取缔。

第四十条本办法自X年X月X日起施行。2000年9月25日国务院公布的《互联网信息服务管理办法》同时废止。
