Supplementary Notice concerning Further Perfecting the Management of Online Dramas, Microfilms and Other Such Online Videos

Since the issuance of the “Notice concerning Further Strengthening the Management of Online Dramas, Microfilms and Other Such Online Videos) (GF No. (2012)53), the implementation situation in all localities generally is good, which has had a stimulating effect on standardizing online dramas, microfilms and other such online videos. However, there are also some localities that report that some Internet audiovisual programme service work units examine and broadcast online dramas, microfilms and other such online videos themselves, there are different examination standards and measures, leading to different versions emerging of the same programme; a few programme producers do not hold production qualification for radio and television programmes, and for some programmes that require editing, it is difficult to contact the producer and have them re-edit it; there are also some programmes that have not been filed timely according to requirements. In order to further perfect management, create a civilized and healthy online environment, and prevent online audiovisual programmes with vulgar content, base styles and which play up violence and sex from having a harmful influence on society, the following Supplementary Notice concerning relevant questions is hereby issued:
I, All localities’ administrative press, publications, radio, film and television departments must guide Internet audiovisual programme service work units within their jurisdictions to comprehensively implement the responsibility of the subject in charge, earnestly implement the management system of examining first and broadcasting later, strictly keep the broadcast gate, produce and broadcast online dramas, microfilms and other such online audiovisual programmes that are suited to online dissemination, reflect the spirit of the times, carry forward the true, the good and the beautiful, which the people love to see and hear.
II, Bodies engaging in the production of online dramas, microfilms and other such online audiovisual programmes shall obtain a “Radio and Television Programme Production Business Permit” issued by the administrative radio, film and television department. Internet audiovisual programme service business work units may not broadcast online dramas, microfilms and other such online audiovisual programmes produced by bodies that have not obtained a “Radio and Television Programme Production Business Permit”.
III, For online dramas, microfilms and other such online audiovisual programmes produced and uploaded by individuals, the Interne audiovisual programme service work unit that reposts the said programme bears the responsibility of the production body. Internet audiovisual programme service business work units can only repost online videos, microfilms and other such online video programmes uploaded by individuals of which they have verified the real identity information, and which conform to content management regulations, they may not repost this sort of programme uploaded by non-real-name users.
IV, All localities’ administrative press, publications, radio, film and television departments must strengthen management over radio and television programme production business bodies, launch focused training for creative staff producing online videos, microfilms and other such online audiovisual programmes, strengthen management over themes in online dramas and microfilms, and ensure that the selected themes are positive, healthy and upward. At the same time, [they must] adopt methods such as organising creative conferences, launching excellent programme awards, sector self-regulation and artistic criticism, to guide creative staff to consciously persist in the correct orientation.
V, Internet audiovisual service work units who examine and broadcast online dramas, microfilms and other such online audiovisual programmes themselves, shall complete programme information filing and filing number indication work before broadcast. Programmes that have not been filed or do not carry a filing number indication according to requirements may not be broadcast online.
VI, Where, after online dramas, microfilms and other such online audiovisual programmes are broadcast, the masses report or administrative press, publications, radio, film and television departments discover that the programme content does not conform to relevant state regulations, they must be immediately taken down. More specifically, where there are some programmes which, although they contain problems, can be broadcast after reediting, the programme producing body must be contacted immediately about reediting, and only after the reedited programme passes through examination by the corresponding administrative body and a uniform edition is created, may it be uploaded again.
VII, Where radio and television production business bodies produce online dramas, microfilms and other such online audiovisual programmes, of which the content violates relevant radio, film and television management regulations, the controlling department must impose punishment according to the “Radio and Television Management Regulations” and the “Radio and Television Programme Production Business Management Regulations” (SARFT Decree No. 34).
All localities’ administrative press, publications, radio, film and television departments must timely copy this “Notice” to the bodies holding an “Audiovisual Programme Information Network Communication Permit” in their jurisdictions, and supervise permit-holding bodies in implementing all requirements pointed out.
