Notice concerning Further Implementing Regulations on the Management of Online Foreign Film and Television Dramas

All provincial, autonomous region and municipal press, publications, radio, film and television bureaus, the Xinjiang Production-Construction Corps Radio, Film and Television Bureau

On the basis of the “Radio and Television Management Regulations” (State Council Decree No. 228), the “Internet Audiovisual Programme Service Management Regulations” (SARFT, Ministry of Industry and Information Technology Decree No. 56), the State Administration of Radio, Film and Television “Notice concerning Strengthening Management over Internet Dissemination of Film and Television Dramas” (GF No. (2007)122) and other such regulations and provisions, foreign film and television dramas used for dissemination on the Internet and other such information networks shall obtain a “Public Film Screening Permit” or a “Television Drama Distribution Permit” according to the law. In order to develop online culture and let it flourish, and vigorously absorb the excellent cultural achievements of the world at the same time as inheriting and carrying forward China’s excellent cultural traditions, the following provisions on further implementing management over dissemination of foreign film and television dramas on information networks (hereafter simply named online foreign film and television dramas) are hereby notified:

I, At the same time as safeguarding the dominant position of the culture of our country and nation, import appropriate amounts of foreign films and television dramas for dissemination on information networks, to satisfy the popular masses’ daily increasing spiritual and cultural needs. Encourage Internet audiovisual programme service websites meeting conditions to import and disseminate foreign film and television dramas with healthy content, excellent production, which carry forward the true, the good and the beautiful.

II, Foreign films and television dramas disseminated online shall obtain approval documents such as the “Public Film Screening Permit” or “Television Drama Distribution Permit” issued by the press, publications, radio, film and television departments according to the law, and obtain information network dissemination rights from the copyright holder. Foreign films and television dramas that have not obtained a “Public Film Screening Permit” or “Television Drama Distribution Permit” may without exception not be disseminated online.

III, Websites that have obtained a “Permit for the Dissemination of Audiovisual Programmes on Information Networks” issued by the State Administration of Press, Publications, Radio, Film and Television, and whose permit categories include ” Category II Internet audiovisual programme services, Item 5: collection and broadcast services of films, television dramas and cartoon-type audiovisual programmes” may import foreign films and television drama for exclusive use in dissemination on information networks.

Each website can only import foreign films and television dramas for use by the website itself, they may also, at the same time these are disseminated on the website itself, and under the condition that copyright demands are met, sell them to other websites that hold licenses qualifying them to engage in film and television drama dissemination. Each website cannot import foreign films and television dramas exclusively for sale to other websites that disseminate them.

Individual websites’ annual import quantities of foreign films and television dramas may not exceed 30% of the quantity of domestically produced films and television dramas the said website purchased in the previous year.

IV, The content and style of films and television dramas imported by each website shall be healthy and upward, conform to the provisions of Article 15 of the “Foreign Television Programme Import and Broadcast Management Regulations (SARFT Decree No. 42), and may not contain the following content:

1, content violating the basic provisions determined in the Chinese Constitution;

2, content endangering China’s national unity, sovereignty and territorial integrity;

3, content divulging China’s state secrets, harming China’s national security or harming China’s honour and interests;

4, content inciting ethnic hatred or ethnic discrimination in China, destroying China’s ethnic unity, or harming China’s ethnic customs and habits;

5, content propagating heresy or superstition;

6, content disordering China’s social order, or destroying China’s social stability;

7, content propagating obscenity, gambling, violence or abetting crime;

8, content defaming or slandering others, or harming others’ lawful rights and interests;

9, content endangering China’s social morals or the excellent traditional culture of the Chinese nation;

other content violating Chinese laws, regulations and rules.

V, The State Administration of Press, Publications, Radio, Film and Television formulates the overall plan for the import of foreign films and television dramas for use in dissemination through information networks. Websites importing foreign films and television programmes exclusively for use in dissemination on information networks shall, after the website’s annual import plans are preliminarily approved by the provincial-level press, publications, radio, film and television bureau before the end of the previous year, report them to the State Administration of Press, Publications, Radio, Film and Television (Centre-subordinate work units’ subordinate websites report directly to the Administration), including the names, number of episodes, place of production, copyright holder, content outline and other such information of the films or television dramas that are slated for import, as well as the corresponding evidence of purchase of domestically produced films and television dramas for that website in the previous year.

The State Administration of Press, Publications, Radio, Film and Television will, before 20 February in each year, publish the information concerning the films and television dramas that are slated for import, were reported by all websites, and conform to the demands of the general plan, on the “Uniform Online Foreign Film and Television Drama Import Information Registration Platform”, for consultation by relevant websites.

If any website adjusts their annual plans for import of foreign films and television dramas exclusively imported for use in dissemination on information networks, they may report the adjusted import plan to the Administration in August of every year, the Administration will publish information concerning the adjusted films and television dramas slated for import on the “Uniform Online Foreign Film and Television Drama Import Information Registration Platform” before 30 September of each year.

VI, After all websites conclude agreements and contracts with copyright holders according to their annual import plan and on the basis of relevant information published on the “Uniform Online Foreign Film and Television Drama Import Information Registration Platform”, they are to report materials including a sample of the foreign films and television dramas imported for exclusive use in dissemination through information networks, contracts, copyright proof, plot outlines, etc., to the local provincial-level press, publications, radio, film and television department for content inspection, those passing inspection are issued with a “Television Drama Distribution Permit” (indicating exclusive use in dissemination on information networks), which at the same time indicates the beginning and end dates of copyright. Foreign films and television dramas imported by Centre-subordinate work units’ subordinate websites are reported to the State Administration of Press, Publications, Radio, Film and Television for content inspection.

The content inspection standards for films and television dramas especially used in dissemination on information networks are implemented according to relevant content inspection regulations for films and television dramas.

VII, Films and television dramas used in dissemination through information networks that are imported through different channels, shall all be registered on the “Uniform Online Foreign Film and Television Drama Import Information Registration Platform”. All work units shall, after purchasing the information network dissemination rights for foreign films or television dramas, upload the imported film or television drama’s name, episode quantity, copyright starting and ending dates, content outline, content inspection body and other such information onto the “Uniform Online Foreign Film and Television Drama Import Information Registration Platform” within three working days of sighing the contract., including in the following circumstances:

1, foreign films that have obtained a “Public Film Screening Permit” for use in cinemas, for which information network dissemination rights are obtained at the same time or afterwards;

2, foreign television dramas that have obtained a “Television Drama Distribution Permit” for use in television broadcasting, for which information dissemination rights are obtained at the same time or afterwards;

3, audiovisual products of foreign films or television dramas for which audiovisual product approval documents for domestic reproduction or distribution have been obtained from the State Administration of Press, Publications, Radio, Film and Television, for which information dissemination rights are obtained at the same time or afterwards;

4, foreign television dramas that are imported for exclusive use in dissemination through information networks according to this Notice.

VIII, The Administration allocates programme registration serial numbers after all kinds of work units have uploaded corresponding information onto the “Uniform Online Foreign Film and Television Drama Import Information Registration Platform”, and will publish a catalogue of all foreign films and television dramas used in dissemination on information networks on the Administration’s governmental website.

When websites disseminate foreign films and television dramas, they shall indicate the registration serial number in the beginning of the programme clip. No website may broadcast foreign films or television dramas that have not been registered on the platform or announced.

IX, Where websites, television stations, publishers and all other such work units repurchase information network dissemination rights of foreign films or television dramas that have been imported with approval from the press, publications, radio, film and television department, and for which cinema screening or television broadcasting rights have been obtained, or audiovisual products of foreign television dramas for which domestic reproduction and distribution rights have been obtained, they do not need to report the matter to the Administration according to the annual import plan, but they must use programme versions examined, verified and approved by the press, publications, radio, film and television department.

Where audiovisual product publishing work units, when they import audiovisual products of foreign films and television dramas, only import information network dissemination rights, the matter will be managed according to the provisions in this Notice concerning the management of foreign films and television dramas imported for exclusive use in information network dissemination.

X, Before 31 March 2015, all websites must upload the name, episode number, purchasing contract, copyright start and end dates, content outline, content inspection situation and other such information of foreign films and television dramas that are being disseminated by that website onto the “Uniform Online Foreign Film and Television Drama Information Registration Platform”. From 1 April 2015 onwards, unregistered foreign films and television dramas may not be disseminated online.

No website may conduct copyright contract renewal of films and television dramas that are being disseminated online, which have been registered, but which have not obtained import approval documents from the press, publications, radio, film and television department, the programme may no longer be disseminated after the copyright period expires.

国家新闻出版广电总局关于进一步落实网上境外影视剧管理有关规定的通知

各省、自治区、直辖市新闻出版广电局,新疆生产建设兵团广播电视局:
根据《广播电视管理条例》(国务院令第228号)、《互联网视听节目服务管理规定》(广电总局、信息产业部令第56号)、国家广电总局《关于加强互联网传播影视剧管理的通知》(广发〔2007〕122号)等有关法规和规定,用于互联网等信息网络传播的境外影视剧应依法取得《电影片公映许可证》或《电视剧发行许可证》。为发展繁荣网络文化,在继承和弘扬中华优秀文化传统的同时,积极吸收世界优秀文化成果,现就进一步落实信息网络传播境外影视剧(以下简称网上境外影视剧)管理的有关规定,通知如下:
一、在维护我国民族文化主体地位的同时,适量引进境外影视剧供信息网络传播,满足人民群众日益增长的精神文化需求。鼓励符合条件的互联网视听节目服务网站引进播出内容健康、制作精良、弘扬真善美的境外影视剧。
二、网上播出的境外电影、电视剧,应依法取得新闻出版广电部门颁发的《电影片公映许可证》或《电视剧发行许可证》等批准文件,并取得著作权人授予的信息网络传播权。未取得《电影片公映许可证》或《电视剧发行许可证》的境外影视剧一律不得上网播放。
三、依法取得国家新闻出版广电总局颁发的《信息网络传播视听节目许可证》,且许可项目含有“第二类互联网视听节目服务第五项:电影、电视剧、动画片类视听节目的汇集、播出业务”的网站,可以引进专门用于信息网络传播的境外影视剧。
各网站只能引进用于本网站播放的境外影视剧,也可在本网站播放的同时,在符合版权要求的情况下,销售给其他具有影视剧播放资质的持证网站播放。各网站不能引进境外影视剧专门销售给其他网站播放。
单个网站年度引进播出境外影视剧的总量,不得超过该网站上一年度购买播出国产影视剧总量的30%。
四、各网站引进境外影视剧的内容、格调应当健康向上,符合《境外电视节目引进、播出管理规定》(广电总局令第42号)第十五条规定,不得载有以下内容:1、反对中国宪法确定的基本原则的;2、危害中国国家统一、主权和领土完整的;3、泄露中国国家秘密、危害中国国家安全或者损害中国荣誉和利益的;4、煽动中国民族仇恨、民族歧视,破坏中国民族团结,或者侵害中国民族风俗、习惯的;5、宣扬邪教、迷信的;6、扰乱中国社会秩序,破坏中国社会稳定的;7、宣扬淫秽、赌博、暴力或者教唆犯罪的;8、侮辱或者诽谤他人,侵害他人合法权益的;9、危害中国社会公德或者中国民族优秀文化传统的;10、其他违反中国法律、法规、规章规定的内容。
五、国家新闻出版广电总局负责制定用于信息网络传播的引进境外影视剧的总体规划。引进专门用于信息网络传播的境外影视剧的网站,应当将本网站年度引进计划于上一年度年底前经省级新闻出版广电局初核后,向国家新闻出版广电总局申报(中央直属单位所属网站直接向总局申报),包括拟引进影视剧的名称、集数、产地、著作权人、内容概要等信息,以及该网站上一年度购买国产影视剧的相关证明。
国家新闻出版广电总局于每年2月20日前,将各网站申报的符合总体规划要求的拟引进境外影视剧相关信息,在“网上境外影视剧引进信息统一登记平台”上发布,供相关网站查询。
各网站如对本网站年度引进专门用于信息网络传播的境外影视剧的计划有调整,可于每年8月份将调整后的引进计划报总局,总局每年9月30日前将调整后的拟引进境外影视剧相关信息,在“网上境外影视剧引进信息统一登记平台”上发布。
六、依照“网上境外影视剧引进信息统一登记平台”发布的相关信息,各网站按年度引进计划与著作权人签订引进协议,签约后,将引进专门用于信息网络传播的境外影视剧的样片、合同、版权证明、剧情概要等材料,报所在地省级新闻出版广电部门进行内容审核,审核通过的发给《电视剧发行许可证》(注明专用于信息网络传播),同时标明版权起止日期。中央直属单位所属网站引进的境外影视剧报国家新闻出版广电总局进行内容审核。
专门用于信息网络传播的境外影视剧的内容审核标准,按照电影、电视剧内容审核相关规定执行。
七、通过不同渠道引进的用于信息网络传播的境外影视剧,都应当在“网上境外影视剧引进信息统一登记平台”上进行登记。各单位购买境外影视剧的信息网络传播权后,应在签约之后的3个工作日内,将所引进境外影视剧的名称、集数、版权起止日期、内容概要、内容审核机构等信息上传到“网上境外影视剧引进信息统一登记平台”,包括以下几种情况:
1、取得《电影片公映许可证》用于影院播放,同时或之后又取得了信息网络传播权的境外电影;
2、取得《电视剧发行许可证》用于电视台播放,同时或之后又取得了信息网络传播权的境外影视剧;
3、取得国家新闻出版广电总局发放的进口音像制品批准文件用于境内复制、发行,同时或之后又取得了信息网络传播权的境外影视剧音像制品;
4、按本通知引进的专门用于信息网络传播的境外影视剧。
八、总局对各类单位上传到“网上境外影视剧引进信息统一登记平台”上的相关信息核对后,配以节目登记序列号,将所有可用于信息网络传播的境外影视剧目录在总局政府网站上公告。
网站在播出境外影视剧时,应在节目片头注明登记序列号。各网站不得播放未在平台上登记和公告的境外影视剧。
九、对于经过新闻出版广电部门批准引进,并已取得境内影院、电视台播映权的境外影视剧,或已取得境内复制、发行权的境外影视剧音像制品,网站、电视台、出版社等各单位如再购买其信息网络传播权的,不用按年度引进计划向总局申报即可直接签约购买,但必须使用经新闻出版广电部门审核通过的节目版本。
音像制品出版单位在引进境外影视剧音像制品时,如只引进信息网络传播权的,按本通知关于引进专门用于信息网络传播的境外影视剧管理的有关规定进行管理。
十、2015年3月31日之前,各网站要将本网站在播境外影视剧名称、集数、购买合同、版权起止日期、内容概要、内容审核情况等信息,上传到“网上境外影视剧引进信息统一登记平台”上进行登记。从2015年4月1日起,未经登记的境外影视剧不得上网播放。
对于已经登记但未取得新闻出版广电部门批准引进文件的网上在播境外影视剧,各网站不得进行版权续约,节目版权到期后不得继续播放。
