Chapter I: General Principles

Article 1: In order to standardize the audiovisual programme dissemination order through the Internet and other information networks, stimulate the healthy and orderly development of audiovisual programme dissemination services through the Internet and other such information networks, safeguard the national interest and the public interest, and protect the lawful rights and interests of the public and bodies involved, these Rules are formulated.

Article 2: These Rules apply to those engaging in activities including content services, integrated broadcasting , transmission, distribution, etc., concerning the dissemination of audiovisual programmes through the Internet and other information networks.

Article 3: Dissemination of audiovisual programmes through the Internet and other information networks as mentioned in these Rules (hereafter simply named online radio and television services), refers to engaging the activity of providing radio and television services to the public, including IPTV, mobile phone television, Internet television, etc., with television sets, mobile phones (including call kinds of hand-held electronic devices) and other such electronic equipment as reception terminals, and with the Internet and other information networks (including cable networks and wireless networks), local area networks as well as virtual private networks running through the Internet as channels.

Article 4: The State Council administrative press, publications, radio, film and television department is responsible for online radio and television services work nationwide.

County-level or higher local People’s Government administrative press, publications, radio, film and television departments are responsible for online radio and television services supervision and management work within their administrative areas.

Article 5: Online radio and television services work units are important online culture construction forces, they bear responsibilities for building an online culture with Chinese characteristics and safeguarding national cultural and information security, they should consciously abide by the Constitution, the laws and administrative regulations, strengthen sectoral self-discipline, and provide excellent and reliable services.

Article 6: The development of online radio and television services should persist in serving the people and serving Socialism, persist in the correct orientation, put social effect first, carry forward the Socialist core value view, abide by Socialist moral norms, incessantly reflect the ideological culture of the developments of the times and the progress of society, forcefully carry forward the nation’s excellent cultural traditions, provide ever more and ever better online radio and television services, satisfy the popular masses’ daily increasing demands, and incessantly enrich the popular masses’ spiritual and cultural lives.

The public are encouraged to supervise online radio and television services.

Chapter II: The establishment of online radio and television services work units

Article 7 Those engaging in online radio and television services, shall obtain an “Permit for the Dissemination of Audiovisual Programmes through Information Networks” issued by the administrative press, publications, radio, film and television department (hereafter simply named “Permit”), in accordance with these Rules. Without having obtained a “Permit” issued by the administrative press, publications, radio, film and television department in accordance with these Rules, no work unit or individual may engage in online radio and television services.

A professional guidance catalogue for online radio and television services will be formulated by the State Council administrative press, publications, radio, film and television department.

Article 8: Work units applying to engage in online radio and television services shall meet the following basic conditions:

(1) having legal person qualifications, being an exclusively State-owned or State-held work unit, and not having a record of breaking laws or regulations within three years preceding the date of application;

(2) having comprehensive programme dissemination security management structures and security protection measures;

(3) having technological capabilities, business premises, funds and relevant resources suited to their business;

(4) having specialist personnel suited to their business, and the main funders and managers may not have a record of breaking laws or regulations within three years preceding the date of application;

(5) having technological plans that conform to State standards, sectoral standards and technological norms;

(6) conforming to the general plan, distribution and business guidance catalogue for online radio and television services determined by the State Council administrative press, publications, radio, film and television department;

(7) conforming to other conditions provided in laws, administrative regulations and State provisions.

Article 9: Those applying to engage in IPTV, mobile phone television and Internet television content services shall be district (city) level or higher radio and television broadcast bodies or Central news work units established with the permission of the State Council administrative press, publications, radio, film and television department. Those applying to engage in IPT, mobile phone television and Internet content services shall also have programme content storage of 2000 hours or more, and shall at the same time have 30 or more specialist programme editing and screening staff.

Those applying to engage in IPTV, mobile phone television and Internet integrated broadcast services, shall be provincial, autonomous region or municipal-level or higher radio and television broadcasting bodies established with the permission of the State Council administrative press, publications, radio, film and television department.

Those engaging to apply in IPTV transmission services or mobile phone television distribution services, shall be work units with lawful basic network operator qualifications, they shall have a certain degree of basic public information network infrastructure resources, and have the reputation and capability of providing long-term services to customers.

Article 10: Applications to engage in online radio and television services, shall be put to the State Council administrative press, publications, radio, film and television department through provincial, autonomous region or municipal People’s Government administrative press, publications, radio, film and television departments, work units directly subordinate to the Centre shall submit applications directly to the State Council administrative press, publications, radio, film and television department.

Provincial, autonomous region and municipal People’s Government administrative press, publications, radio, film and television departments shall put forward a preliminary opinion within 20 days of receiving the application, and report it to the State Council administrative press, publications, radio, film and television department for examination and approval; the State Council administrative press, publications, radio, film and television department shall make a decision of granting or not granting permission within 40 days of receiving an application or a preliminary opinion, the time allotted to expert appraisal within this period is 20 days. Where permission is granted, a “Permit” is issued to the application, and the matter is announced to society; where permission is not granted, the applicant is notified in writing and the reasons are explained. The “Permit” shall indicate the service categories, service content, transmission network, coverage scope and other such matters pertaining to the online radio and television services.

The period of validity of the “Permit” is three years. Where the period of validity ends, and it is necessary to continue to engage in online radio and television services, corresponding materials conforming to the conditions provided in Articles 7 and 8 of these Rules shall be submitted to the original permit-issuing entity in order to apply for continuation formalities within 30 days before the end of the period of validity. Article 11: Where online radio and television services work units change their shareholders or shareholding structure, g on the market or engage in other major financial activities or major asset changes, they shall carry out examination and approval formalities in accordance with these Rules before the change occurs.

Where online radio and television services work units change their work unit name, business premises or statutory representatives in accordance with the law, they shall file this change with the original permit-issuing entity within 15 days after the change.

Article 12: Where online radio and television services work units change the business categories, service content, transmission networks, coverage scope and other business matters listed on the “Permit” or adopt joint venture or collaborative models to launch their business, they shall carry out examination and approval procedures in accordance with these Rules in advance.

Article 13: Online radio and television services work units shall provide services within 90 days of obtaining the “Permit”. Where services are not provided within this period, the “Permit” is cancelled by the original permit-issuing entity. If the provision of services is deferred or suspended because of exceptional reasons, the original permit-issuing entity must consent. Those applying for termination of services shall apply within 60 days in advance with the original permit-issuing entity, and their “Permit” will be cancelled by the original permit-issuing entity. Where there is a continuous cessation of business in excess of 60 days, the original permit-issuing entity will handle the matter as a termination of business, and the “Permit” will be cancelled by the original permit-issuing entity.

Chapter III: The scope of online radio and television services

Article 14: Online radio and television services shall engage in online radio and television services according to the items indicated on their “Permit”.

Article 15: Work units who are permitted to engage in online radio and television content services, are responsible for the establishment and operation of content service platforms, the organization and editing of programmes, and the provision of programmes to users through integrated broadcast platforms.

Article 16: Radio and television broadcasting bodies that have approval to engage in integrated online radio and television broadcast services are responsible for the construction and operation of integrated broadcast platforms, including uniform integration and broadcast supervision of programmes, electronic programme guides, user terminals, cost calculations, copyright and other such management matters.

Article 17: Online radio and television services work units shall establish online information security management structures, protection systems and emergency response mechanisms, and carry out security protection duties.

Integrated online radio and television broadcast services work units shall establish and complete broadcast security management systems, adopt technological security management and control measures, allocate specialized broadcast security management staff, and integrate and broadcast radio and television broadcast according to the relevant demands of the State Council administrative press, publications, radio, film and television department. It is not permitted to refuse signal access requests from online radio and television services work units, it is not permitted to insert content into, withhold or modify programme signals broadcast by online radio and television services work units without authorization.

Article 18: Online radio and television services work units shall choose work units having obtained integrated online radio and television broadcast services work units permits in accordance with the law to provide access services.

Integrated online radio and television broadcast services work units shall, before providing access services, examine and verify the permits of online radio and television content services work units.

Online radio and television transmission and distribution services work units shall, before providing transmission and distribution services to integrated broadcast platforms, examine and verify the permits of Integrated online radio and television broadcast services work units.

Article 19: Online radio and television content services work units and integrated broadcast services work units shall, place the broadcast logo, name and “Permit” number as approved by the State Council administrative press, publications, radio, film and television department in a clear position on their broadcast interface.

Article 20: online radio and television services work units shall implement standardized linkages according to radio and television management regulations and corresponding standards, and provide the necessary technological support and service guarantees for these linkages.

Article 21: The programmes broadcast by online radio and television content services work units shall conform to the provisions of laws, administrative regulations and departmental rules, and may not contain the following content:

(1) content violating the basic principles determined in the Constitution, inciting resistance to or destruction of the implementation of the Constitution, laws, administrative regulations and rules;

(2) content endangering national unity, sovereignty and territorial integrity;

(3) content divulging State secrets, endangering national security, or damaging the national reputation and interest;

(4) content inciting ethnic hatred and ethnic discrimination, harming the nation’s customs and habits, injuring the feelings of the nation, and destroying the unity of the nation;

(5) content violating State religious policies, propagating religious extremism and heresy, superstition, discrimination, and insulting religious beliefs;

(6) content upsetting social order or destroying social stability;

(7) content propagating obscenity, gambling, violence, terror, drug use, abetting crime or imparting criminal methods;

(8) content insulting or slandering others;

(9) content endangering social public morals or the excellent cultural traditions of the nation;

(10) content endangering the lawful rights and interests of minors or harming the physical and mental health of minors;

(11) other content prohibited by laws, administrative regulations and rules.

Article 22: Films, television dramas, cartoons, documentaries and other kinds of programmes broadcast by online radio and television content service work units, shall conform to State management regulations concerning radio, film and television programmes. Current affairs-type audiovisual news programmes broadcast by radio and television content services work units shall be news programmes produced and broadcast by district (city) level or higher radio stations or television stations.

Article 23: Programmes broadcast by online radio and television content service work units shall be provided to users after being uniformly integrated through integrated broadcast platforms established by integrated online radio and television broadcast service work units.

Online radio and television services work units may not retransmit illegal radio and television programmes, they may not link to, compile or integrate programmes that are made by work units that have not obtained online radio and television content services permits.

Article 24: Integrated online radio and television broadcast services work units are responsible for carrying out supervision over the programmes broadcast by content services work units, when they discover that programmes inserted on integrated broadcast platforms contain content violating these Rules, they shall immediately sever the programme source, and report the matter to the administrative press, publications, radio, film and television department.

Article 25: Online radio and television content services work units are responsible to examine whether programmes they provide conform to the provisions of laws, administrative regulations and departmental rules, and to conduct pre-broadcast censorship. Online radio and television content services work units shall establish and complete programme content management structures for programme censorship and broadcasting security, and allocate specialist programme censors. The name, content outline, broadcasting time, duration, source and other such information shall be preserved for 60 days at least, and shall actively cooperate when controlling departments’ inquiries in accordance with the law. Online radio and television content services work units shall immediately delete programmes with content violating these Rules and preserve relevant records, carry out their reporting duties, and implement the management requirements of administrative press, publications, radio, film and television departments.

Article 26: Online radio and television transmission and distribution services work units shall respect State management regulations concerning radio and television transmission security, and guarantee online transmission security. It is prohibited to insert into, withhold, or change the radio and television programme signals broadcast by integrated broadcast platforms and control signals concerning electronic programme guides (EPGs), user terminals, fee payment, copyright, etc.

Article 27: Technological systems and terminal products used for online radio and television services shall conform to radio and television standards and requirements. No work unit may provide corresponding server contracting, online transmission, software and hardware technological support, fee collection agency and other such services to work units that have not obtained online radio and television services permits.

Article 28: Provincial-level or higher administrative press, publications, radio, film and television departments shall establish and complete online radio and television programme supervision and management systems, establish public supervision reporting structures, and strengthen supervision and management of online radio and television systems.

Online radio and television content services, integrated broadcast, transmission and distribution work units shall provide the necessary signal access conditions to online radio and television programme supervision and control systems established by administrative press, publications, radio, film and television departments.

Chapter IV: Legal liability

Article 29: Those engaging in unauthorized online radio and television services, will be subject to a warning and order of rectification by county-level or higher administrative press, publications, radio, film and television departments, and a fine of 30.000 Yuan or less may additionally be imposed; where circumstances are grave, matters are handled according to the provisions of Article 47 of the “Radio and Television Management Regulations”.

Article 30: Where online radio and television content services work units broadcast programmes with content violating the provisions of these Rules, the county-level or higher administrative press, publications, radio, film and television department will issue a warning, order rectification, and may additionally impose a fine of 30.000 Yuan or less; where circumstances are grave, matters are handled according to the provisions of Article 49 of the “Radio and Television Management Regulations”.

Where radio and television content services work units broadcast programmes from sources violating the provisions of these Rules, the county-level or higher administrative press, publications, radio, film and television department will issue a warning, order rectification, and may additionally impose a fine of 20.000 Yuan or less; where circumstances are grave, matters are handled according to the provisions of Article 50 of the “Radio and Television Management Regulations”.

Article 31: Those engaging in online radio and television services in excess of the matters indicated on permits, will be subject to a warning and order of rectification by county-level or higher administrative press, publications, radio, film and television departments, and a fine of 20.000 Yuan or less may additionally be imposed; where circumstances are grave, matters are handled according to the provisions of Article 50 of the “Radio and Television Management Regulations”.

Article 32: Those violating these regulations, in one of the following manners, will be subject to a warning and order of rectification by county-level or higher administrative press, publications, radio, film and television departments, and a fine of 20.000 Yuan or less may additionally be imposed; where circumstances are grave, matters are handled according to the provisions of Article 51 of the “Radio and Television Management Regulations”:

(1) where online radio and television content services work units choose work units that have not obtained integrated online radio and television broadcast permits to provide integrated broadcast services, or where integrated broadcast platforms that have not been lawfully established directly provide services to users after uniform integration;

(2) where integrated online radio and television broadcast services work units refuse programme signals access requests of online radio and television content services work units or insert into, withhold or alter programme signals broadcast by online radio and television content services work units;

(3) where online radio and television transmission and distribution services work units violate State management provisions concerning radio and television transmission security, or insert into, withhold or alter radio and television programme signals broadcast by integrated online radio and television broadcast platforms or control signals concerning electronic programme guides (EPGs), user terminals, fee payment, copyright, etc., without authorization;

(4) where integrated online radio and television services broadcast do not carry out permit verification duties before providing access services to radio and television content services work units;

(5) where online radio and television services work units do not carry out standardization linkages according to radio and television management rules and corresponding standards or do not provide the necessary technological support and service guarantees;

(6) where online radio and television transmission and distribution work units do not verify the permits of integrated online radio and television broadcast services work units before providing transmission and distribution services to integrated broadcast platforms.

Article 33: Where online radio and television services engage in one of the following activities, the country-level or higher administrative press, publications, radio, film and television department will issue a warning, order rectification and may impose an additional fine of 30.000 Yuan or less; at the same time, it may issue a warning to the main funders and managers, and may impose a fine of 20.000 Yuan or less:

(1) where major financial acts are conducted or major asset changes take place, including changes in shareholders or shareholding structures, going onto the market, etc., without conducting examination and approval formalities in advance;

(2) where changes are made in major business matters such as the business categories, service content, transmission networks, coverage scope indicated on the “Permit”, etc., as well as joint venture or cooperative models are used to set up businesses, without conducting examination and approval formalities in advance;

(3) where management structures for broadcast control security, programme censorship, broadcast security, transmission security, etc., are not established and completed according to the demands of these Rules, or specialized security management and programme censorship personnel are not allocated;

(4) where online radio and television content services work units and integrated broadcast services work units do not indicate the broadcasting logo, name and “Permit” number in a clear position on the broadcasting interface;

(5) where online radio and television content services work unit discover programmes with content violating these Rules and do not timely delete it, do not preserve programme broadcast information, do not actively cooperate with inquiry by controlling departments, or do not fulfil reporting duties;

(6) where online radio and television services work units discover programmes from linked integrated broadcast platforms with content violating these Rules and do not cut off programme sources or report the matter to the administrative press, publications, radio, film and television department;

(7) where technology systems and terminal products used for online radio and television services do not conform to relevant radio and television standards and demands;

(8) where necessary signal access conditions are not provided to online radio and television programme control systems established by administrative press, publications, radio, film and television departments;

(9) where online radio and television services work units commit three acts in violation of regulations within one year;

(10) where administrative press, publications, radio, film and television departments conducting supervision or inspection in according to the laws are refused, obstructed or delayed or fraud occurs in the process of supervision and inspection;

(11) where a “Permit” is fraudulently obtained by methods such as false evidence or documents, etc.

Where the act provided in Clause (11) of this Article occurs, the original permit-issuing entity cancels their Permit.

Article 34: Where administrative press, publications, radio, film and television department work personnel abuses their powers or is negligent in their duties, the relevant responsible person must be dealt with according to the law, where it constitutes a crime, the judicial bodies will investigate criminal liability in accordance with the law.

Article 35: These Rules take effect on x day, x month, x year. The “Management Rules for the Dissemination of Audiovisual Programmes through the Internet and Other Such Information Networks” (SARFT Decree No. 39) promulgated by SARFT on 15 June 2004 is abolished on the same date.

互联网等信息网络传播视听节目管理办法

(修订征求意见稿)

第一章 总则

第一条 为规范互联网等信息网络传播视听节目秩序,促进互联网等信息网络传播视听节目服务健康有序发展,维护国家利益和公共利益,保护公众和从业机构的合法权益,制定本办法。

第二条 从事互联网等信息网络传播视听节目服务的内容服务、集成播控、传输分发等活动,适用本办法。

第三条 本办法所称互联网等信息网络传播视听节目服务(以下简称网络广播电视服务),是指以互联网等信息网络(含有线、无线网络)、局域网络及利用互联网架设虚拟专网为传输通道,以电视机、手机(含各类手持电子设备)等电子设备为接收终端,从事向公众定向提供广播电视服务的活动,包括IP电视(IPTV)、手机电视、互联网电视等。

第四条 国务院新闻出版广电行政部门负责全国的网络广播电视服务监督管理工作。

县级以上地方人民政府新闻出版广电行政部门负责本行政区域内的网络广播电视服务的监督管理工作。

第五条 网络广播电视服务单位是重要的网络文化建设力量,承担建设中国特色网络文化和维护网络文化信息安全的责任,应自觉遵守宪法、法律和行政法规,加强行业自律,提供优质可靠服务。

第六条 发展网络广播电视服务,应当坚持为人民服务、为社会主义服务,坚持正确导向,把社会效益放在首位,弘扬社会主义核心价值观,遵守社会主义道德规范,不断体现时代发展和社会进步的思想文化,大力弘扬民族优秀文化传统,提供更多更好的网络广播电视服务,满足人民群众日益增长的需求,不断丰富人民群众的精神文化生活。

鼓励公众监督网络广播电视服务。

第二章 网络广播电视服务单位的设立

第七条 从事网络广播电视服务,应当依照本办法取得新闻出版广电行政部门颁发的《信息网络传播视听节目许可证》(以下简称《许可证》)。未按照本办法取得新闻出版广电行政部门颁发的《许可证》,任何单位和个人不得从事网络广播电视服务。

网络广播电视服务业务指导目录由国务院新闻出版广电行政部门制定。

第八条 申请从事网络广播电视服务的单位,应当具备下列基本条件:

(一)具备法人资格,为国有独资或国有控股单位,且在申请之日前三年内无违法违规记录;

(二)有健全的节目安全传播管理制度和安全保护措施;

(三)有与其业务相适应的技术能力、经营场所、资金和相关资源;

(四)有与其业务相适应的专业人员,且主要出资者和经营者在申请之日前三年内无违法违规记录;

(五)技术方案符合国家标准、行业标准和技术规范;

(六)符合国务院新闻出版广电行政部门确定的网络广播电视服务总体规划、布局和业务指导目录;

(七)符合法律、行政法规和国家规定的其他条件。

第九条 申请从事IP电视(IPTV)、手机电视、互联网电视内容服务的,应当是经国务院新闻出版广电行政部门批准设立的地(市)级以上广播电视播出机构和中央新闻单位。申请从事IP电视(IPTV)、手机电视、互联网电视内容服务的,还应当具备2000小时以上的节目内容储备,同时应有30人以上的专业节目编审人员。

申请从事IP电视(IPTV)、手机电视和互联网电视集成播控服务的,应当是经国务院新闻出版广电行政部门批准设立的省、自治区、直辖市级以上广播电视播出机构。

申请从事IP电视(IPTV)传输服务、手机电视分发服务的,应当是有合法基础网络运营资质的单位,有一定规模的公共信息基础网络设施资源,有为用户提供长期服务的信誉或能力。

第十条 申请从事网络广播电视服务,应当通过省、自治区、直辖市人民政府新闻出版广电行政部门向国务院新闻出版广电行政部门提出申请,中央直属单位可直接向国务院新闻出版广电行政部门提出申请。

省、自治区、直辖市人民政府新闻出版广电行政部门应当自收到申请之日起20日内提出初审意见,报国务院新闻出版广电行政部门审批;国务院新闻出版广电行政部门应当自收到申请或者初审意见之日起40日内作出许可或者不予许可的决定,其中专家评审时间为20日。予以许可的,向申请人颁发《许可证》,并向社会公告;不予许可的,应当书面通知申请人并说明理由。《许可证》应当载明网络广播电视服务的业务类别、服务内容、传输网络、覆盖范围等事项。

《许可证》有效期为3年。有效期届满,需继续从事网络广播电视服务的,应于有效期届满前30日内,持符合本办法第七、八条规定条件的相关材料,向原发证机关申请办理续办手续。

第十一条 网络广播电视服务单位变更股东、股权结构以及有上市等重大融资行为或有重大资产变动的,应当在变更前按本办法办理审批手续。

网络广播电视服务单位的单位名称、办公场所、法定代表人依法变更的,应当在变更后15日内向原发证机关备案。

第十二条 网络广播电视服务单位变更《许可证》载明的业务类别、服务内容、传输网络、覆盖范围等业务项目以及采用合资、合作模式开展业务的,应事先按本办法办理审批手续。

第十三条 网络广播电视服务单位应当在取得《许可证》90日内提供服务。未按期提供服务的,其《许可证》由原发证机关予以注销。如因特殊原因,延期或中止提供服务的,应经原发证机关同意。申请终止服务的,应提前60日向原发证机关申报,其《许可证》由原发证机关予以注销。连续停止业务超过60日的,由原发证机关按终止业务处理,其《许可证》由原发证机关予以注销。

第三章 网络广播电视服务规范

第十四条 网络广播电视服务单位应当按照《许可证》载明的事项从事网络广播电视服务。

第十五条 经批准从事网络广播电视内容服务的单位,负责建设和运营内容服务平台,组织、编辑节目并通过集成播控平台向用户提供节目。

第十六条 经批准从事网络广播电视集成播控服务的广播电视播出机构,负责集成播控平台的建设和运营,包括节目的统一集成和播出监控,电子节目指南(EPG)、用户端、计费、版权等管理。

第十七条 网络广播电视服务单位应当建立网络信息安全管理制度、保障体系和应急处理机制,履行安全保障义务。

网络广播电视集成播控服务单位应当建立健全安全播控管理制度,采取技术安全管控措施,配备专业安全播控管理人员,按照国务院新闻出版广电行政部门的有关要求集成、播控广播电视节目。不得拒绝网络广播电视内容服务单位的节目信号接入请求,不得擅自插播、截留、变更网络广播电视内容服务单位播出的节目信号。

第十八条 网络广播电视内容服务单位应当选择依法取得网络广播电视集成播控服务许可的单位提供接入服务。

网络广播电视集成播控服务单位在提供接入服务前,应当查验网络广播电视内容服务单位的许可证。

网络广播电视传输分发服务单位在为集成播控平台提供传输分发服务前,应当查验网络广播电视集成播控服务单位的许可证。

第十九条 网络广播电视内容服务单位和集成播控服务单位应在播出界面显著位置标注国务院新闻出版广电行政部门批准的播出标识、名称、《许可证》编号。

第二十条 网络广播电视服务单位应当按照广播影视管理规定和相关标准实行规范对接,并为对接提供必要的技术支持和服务保障。

第二十一条 网络广播电视内容服务单位播出的节目应当符合法律、行政法规、部门规章的规定,不得含有以下内容:

(一)违反宪法确定的基本原则,煽动抗拒或者破坏宪法、法律、行政法规和规章实施的;

(二)危害国家统一、主权和领土完整的;

(三)泄露国家秘密,危害国家安全,损害国家荣誉和利益的;

(四)煽动民族仇恨、民族歧视,侵害民族风俗习惯,伤害民族感情,破坏民族团结的;

(五)违背国家宗教政策,宣扬宗教极端主义和邪教、迷信,歧视、侮辱宗教信仰的;

(六)扰乱社会秩序,破坏社会稳定的;

(七)宣扬淫秽、赌博、暴力、恐怖、吸毒,教唆犯罪或者传授犯罪方法的;

(八)侮辱、诽谤他人的;

(九)危害社会公德或者民族优秀文化传统的;

(十)侵害未成年人合法权益或者有害未成年人身心健康的;

(十一)法律、行政法规和规章禁止的其他内容。

第二十二条 网络广播电视内容服务单位播出的电影、电视剧、动画片、纪录片类节目和其它节目,应当符合国家有关广播电影电视节目的管理规定。网络广播电视内容服务单位播出的时政类视听新闻节目,应当是地(市)级以上广播电台、电视台制作、播出的新闻节目。

第二十三条 网络广播电视内容服务单位播出的节目应当经过网络广播电视集成播控服务单位设立的集成播控平台统一集成后提供给用户。

网络广播电视服务单位不得转播非法的广播电视节目,不得链接、聚合、集成未取得网络广播电视内容服务许可的单位开办的节目。

第二十四条 网络广播电视集成播控服务单位负责对内容服务单位播出的节目进行监控,发现接入集成播控平台的节目含有违反本办法的内容时,应立即切断节目源,并报告新闻出版广电行政部门。

第二十五条 网络广播电视内容服务单位负责审查其提供的节目是否符合法律、行政法规、部门规章的规定,并进行播前审查。网络广播电视内容服务单位应建立健全节目审查、安全播出等节目内容管理制度,配备专业节目审查人员。所播出节目的名称、内容概要、播出时间、时长、来源等信息,应至少保留60日,主管部门依法查询时应当主动予以配合。网络广播电视内容服务单位对含有违反本办法的节目,应立即删除并保存有关记录,履行报告义务,落实新闻出版广电行政部门的管理要求。

第二十六条 网络广播电视传输分发服务单位应当遵守国家有关广播电视安全传输的管理规定,保障网络传输安全。不得擅自插播、截留、变更集成播控平台发出的广播电视节目信号和电子节目指南(EPG)、用户端、计费、版权等控制信号。

第二十七条 用于网络广播电视服务的技术系统和终端产品,应符合广播影视有关标准和要求。任何单位不得向未取得网络广播电视服务许可的单位提供相关的服务器托管、网络传输、软硬件技术支持、代收费等服务。

第二十八条 省级以上新闻出版广电行政部门应设立健全网络广播电视节目监管系统,建立公众监督举报制度,加强对网络广播电视服务的监督管理。

网络广播电视内容服务、集成播控、传输分发等单位应当为新闻出版广电行政部门设立的网络广播电视节目监控系统提供必要的信号接入条件。

第四章 法律责任

第二十九条 擅自从事网络广播电视服务的,由县级以上新闻出版广电行政部门予以警告、责令改正,可并处3万元以下罚款;情节严重的,根据《广播电视管理条例》第四十七条的规定予以处罚。

第三十条 网络广播电视内容服务单位播出节目的内容违反本办法规定的,由县级以上新闻出版广电行政部门予以警告、责令改正,可并处3万元以下罚款;情节严重的,根据《广播电视管理条例》第四十九条的规定予以处罚。

网络广播电视内容服务单位播出节目的来源违反本办法规定的,由县级以上新闻出版广电行政部门予以警告、责令改正,可并处2万元以下罚款;情节严重的,根据《广播电视管理条例》第五十条的规定予以处罚。

第三十一条 未按照许可证载明的事项从事网络广播电视服务的,由县级以上新闻出版广电行政部门予以警告、责令改正,可并处2万元以下罚款;情节严重的,根据《广播电视管理条例》第五十条的规定予以处罚。

第三十二条 违反本办法规定,有下列行为之一的,由县级以上新闻出版广电行政部门予以警告、责令改正,可并处2万元以下罚款;情节严重的,根据《广播电视管理条例》第五十一条的规定予以处罚。

(一)网络广播电视内容服务单位选择未取得网络广播电视集成播控许可的单位提供集成播控服务的或未经过合法设立的集成播控平台统一集成后直接提供给用户的;

(二)网络广播电视集成播控服务单位拒绝网络广播电视内容服务单位的节目信号接入请求或擅自插播、截留、变更网络广播电视内容服务单位播出的节目信号的;

(三)网络广播电视传输分发服务单位违反国家有关广播电视安全传输的管理规定的,或擅自插播、截留、变更网络广播电视集成播控平台发出的广播电视节目信号和电子节目指南(EPG)、用户端、计费、版权等控制信号的;

(四)网络广播电视集成播控服务单位在为网络广播电视内容服务单位提供接入服务前,未履行许可证查验义务的;

(五)网络广播电视服务单位未按照广播影视管理规定和相关标准实行规范对接或未提供必要的技术支持和服务保障的;

(六)网络广播电视传输分发服务单位在为集成播控平台提供传输分发服务前,未查验网络广播电视集成播控服务单位的许可证的。

第三十三条 网络广播电视服务单位有下列行为之一的,由县级以上新闻出版广电行政部门予以警告、责令改正,可并处3万元以下罚款;同时,可对其主要出资者和经营者予以警告,可并处2万元以下罚款:

(一)变更股东、股权结构以及有上市等重大融资行为或有重大资产变动,未事先办理审批手续的;

(二)变更《许可证》载明的业务类别、服务内容、传输网络、覆盖范围等业务项目以及采用合资、合作模式开展业务,未事先办理审批手续的;

(三)未按本办法要求建立健全安全播控、节目审查、安全播出、安全传输等管理制度,未配备专业安全管理和节目审查人员的;

(四)网络广播电视内容服务单位和集成播控服务单位未在播出界面显著位置标注播出标识、名称、《许可证》编号的;

(五)网络广播电视内容服务单位发现含有违反本办法的节目未及时删除或未保留节目播出信息或未主动配合主管部门查询以及履行报告义务的;

(六)网络广播电视服务单位发现接入集成播控平台的节目含有违反本办法的内容时未及时切断节目源或未报告新闻出版广电行政部门。

(七)用于网络广播电视服务的技术系统和终端产品不符合广播影视有关标准和要求的;

(八)未向新闻出版广电行政部门设立的网络广播电视节目监控系统提供必要的信号接入条件的;

(九)网络广播电视服务单位在同一年度内三次出现违规行为的;

(十)拒绝、阻挠、拖延新闻出版广电行政部门依法进行监督检查或者在监督检查过程中弄虚作假的;

(十一)以虚假证明、文件等手段骗取《许可证》的。

有本条第(十一)项行为的,发证机关应撤销其许可证。

第三十四条 新闻出版广电行政部门工作人员滥用职权、玩忽职守的,要依法给予有关责任人处分,构成犯罪的,由司法机关依法追究刑事责任。

第三十五条 本规定自 年 月 日起施行。2004年6月15日国家广播电影电视总局发布的《互联网等信息网络传播视听节目管理办法》(国家广播电影电视总局令第39号)同时废止。
