In January 2001, the Central Committee and the State Council issued this document, no. GBF [2001]17, or simply Document no. 17. This was a highly secretive document, that was only distributed to high officials in the propaganda system, as it included – amongst others – the assertion that Chinese media are the property of the Party, rather than the State. It also provided the groundwork for the the next phase of structural adjustment in the media sector, amongst others in response to the feared influx of foreign media. State Administration of Cultural Heritage Notice Concerning Museums’ Foreign-Related Work

At present, following the development of the tourism industry, all provincial and municipal museums tasks in receiving international friends becomes ever larger; relationships of international organizations, foreign museums, publishing companies, research departments and individuals with our museums become ever more, and new situations have emerged in museums’ foreign-related work. In order to make museums adapt to this sort of new situation, correctly deal with foreign relationships, we believe that the requirements and opinions put forward by international organizations, foreign organs and individuals must be met with a positive attitude, and different handling methods must be adopted for different situations. Under the condition of mutual benefits, all requirements and suggestions by foreign organs and individuals shall be responded to. Those that can be agreed to are to be agreed to, and reported to higher levels for approval; those that cannot be agreed to should be politely declined. Hereby, the following few points of opinions are put forward concerning related questions:

 

I, It is permitted to orally introduce the situation of museums’ establishment and development history, exhibitions and displays, scientific research, editing and publications, organizational structure and personnel training, etc., or provide written materials. But it must be explained in advance to the other side, that when the other side use these materials, they shall donate some copies of the publications in which these materials are published to the museum.

 

II, If foreign organs or individuals request our museums to appraise the Chinese cultural relics they collected, those with appraisal abilities may accept this. But they shall charge a certain appraisal fee and produce an appraisal letter. For requests put forward by friendly organizations and individuals, the appraisal fee may be waived, and it is not necessary to produce an appraisal letter.

 

III, Foreign organs and individuals requests of the provision of photos or materials of our museums’ cultural relics or photograph them by themselves, shall be carried out according to the relevant regulations of the State Council and the State Administration of Cultural Heritage.

 

IV, Where foreign organs and individuals request to edit relevant books in cooperation with work personnel of our museums, if the other side is friendly to use, and the cooperation conditions are beneficial to us, and we also have the capacity to cooperate, it may be reported to the provincial or municipal leadership for approval, and cooperation contracts may only be concluded with the other side after reporting to our Administration for examination and verification.

 

V, According to work requirements, museums may use open publications edited and printed by that museum to exchange with foreign museums’ publications.

 

VI, Policies, laws and work regulation for protection of our country’s cultural heritage, etc., may be orally explained to foreigners; all those officially published by the State Council or the State Administration of Cultural Heritage, may also be provided in writing to foreigners.

 

Because museums’ foreign-related work is relatively concrete, and the conditions of all museums are also different, all provincial and municipal cultural heritage bureaus (cultural bureaus) shall be requested to conduct research together with foreign affairs department, and put forward handling opinions on the basis of the real situation of their locality, in order to benefit implementation by museums.

 

国家文物局关于博物馆涉外工作的通知

当前,随着旅游事业的发展,各省、市的博物馆接待国际友人的任务越来越大;国际组织、外国博物馆、出版公司、研究部门和个人同我博物馆的联系也越来越多,博物馆的涉外工作出现了新的情况。为使博物馆适应这种新的形势,正确处理涉外关系,我们认为,对国际组织、外国机构和个人提出的要求和建议要采取积极态度,对不同情况要采取不同的处理办法。对外国机构和个人的要求和建议在互利的条件下,均应给予答复。能同意的同意,报上级批准;不能同意的婉言谢绝。现对有关问题提出以下几点意见:

一、对博物馆的建立和发展历史、陈列展览、科学研究、编辑出版、组织机构和人员培训等状况,可以对外口头介绍,或提供文字资料。但事先要向对方说明,如对方利用这些资料时,应将刊载这些资料的出版物送我博物馆若干份。

二、对外国机构或个人要求我博物馆鉴定其收藏的中国文物,如有鉴定力量的可以接受。但应酌收一定鉴定费,出具鉴定书。对友好组织和个人提出的要求,可免收鉴定费,也不必出具鉴定书。

三、对外国机构和个人要求提供或自己拍摄我博物馆文物照片、资料,应按国务院和国家文物局的有关规定执行。

四、对外国机构和个人要求与我博物馆工作人员合作编写有关著作,如对方对我友好,合作条件对我有利,我又有能力合作,可报请省、市领导批准,报我局核定后,再与对方签订合作合同。

五、根据工作需要,博物馆可用本馆编印的公开出版物交换外国博物馆的出版物。

六、对我国的文物保护政策、法令和工作条例等,可对外口头介绍;凡经国务院或国家文物局正式公布的,也可对外提供书面材料。

因博物馆的涉外工作比较具体,各博物馆的条件又不同,应请各省、市文物局(文化局)会同外事部门进行研究,根据本地实际情况提出处理意见,以利博物馆执行。
