China Law Society Bodies Implementation Plan for the “China Law Society Opinions concerning Further Letting Legal Research Flourish”

In order to implement the “China Law Society Opinions concerning Further Letting Legal Research Flourish”, according to the requirements of the Presidential Business Meeting of 9 December 2005, and on the basis of grouping the opinions of all departments of the Society bodies, the following implementation plan is put forward:

I, Concerning using developing Marxism to guide legal research

1. Strengthening regularized analysis of the situation of legal research. Every half year, make a comprehensive analysis report of legal research trends and the ideological trends of research teams. (Implemented by the research department)

2. Establishing a project to construct Socialist legal studies with Chinese Characteristics. In 2006, convene the “Conference on Using Developing Marxism to Guide Legal Research”, research how to use developing Marxism as guidance, establish, complete and perfect a Socialist legal studies structure with Chinese characteristics. (Implemented by the research department).

II, Concerning launching legal research revolving around the larger picture of Socialist construction

3. According to the “China Law Society Five-Year Work Development Plan Outline” and the “China Law Society Opinions concerning further letting legal research flourish, determine major research themes for 2006 and the following period. These mainly include” research on the Socialist legal studies structure with Chinese characteristics; research on the theory and practice of the scientific development view and ruling the country according to the law; research on constructing rule of law government, and legal problems in moving forward administration according to the law; research on legal problems in constructing a new Socialist countryside; research on legal institutional guarantees for indigenous innovation; research on legal structures for social construction and social management; research on legal problem in the transition period after our country joined the WTO; and research on legal issues related to maintaining social stability, judicial structural reform, anti-corruption, respecting and guaranteeing human rights, etc. (Implemented by the research department)

4. Revolving around our country’s larger picture of reform, development and stability, perfecting establishment, tendering, bidding, evaluation and other mechanisms for focus themes. High regard must be given to basic theoretical research and even more to applied research, fix eyes on resolving real problems. (Implemented by the research department)

III, Concerning strengthening legal research organization structure construction

5. Further perfecting research associations’ organization structures. Implement the “Regulations for Research Associations Subordinate to the China Law Society”, strengthen guidance over existing research association construction, give rein to the superiority of all research associations in special fields. Promote the establishment of new research associations, provide guidance and assistance to them. (Implemented by the research department)

6. Vigorously promote local law societies to complete their research association structure. Where law societies change leaders, it must be supervise that they establish corresponding research associations, and revolve around issues that the masses care about, that Party Committees and governments pay close attention to, or on economic and social development needs, and launch academic research activities. Continue to move the work forward that provincial or vice-provincial-level city law societies that have not yet changed their leaders change their leaders, promote legal research organization construction, make establishing and completing research structures into a focus work in the following period. (Implemented by the member department and research department)

7. Striving to complete the examination and approval work concerning structuring and personnel allocation of the “China Law Society Legal Research Centre”. Under the precondition that permission for establishment is obtained, prepare to construct matters on the one hand, and launch work on the other hand. (Implemented by the human affairs department).

8. Further giving rein to the function of the China Law Society Academic Committee. Fully give rein to its superiority of authority in the academic area, do the work of academic research and appraisal, and providing consulting services, etc., well.

9. Establishing and completing organizational mechanisms for members to broadly participate in legal research. Strengthen cooperation between local law societies and research associations through themes, conferences, annual meetings, fora, seminars, legal scholar reporting tours and other methods. Timely understand and grasp the information of all law societies’ academic annual conferences, research seminars and other academic activities, notify local research associations, vigorously organize member participation. At the beginning of the year, formulate plans for academic lectures, deliberation  and training activities aimed at members, cooperate with relevant local law societies for organization and implementation. Closely integrate the major moves of Party and State legal system construction, organize activities for soliciting articles from members, select outstanding contributions and publish them in compilation. IV, Concerning strengthening cooperation and stimulating the close integration between legal theory and practice

10. Establishing cooperation mechanisms with legislative, administrative and judicial organs. Establish work links with the relevant departments of the National People’s Congress, the State Council, the Supreme People’s Court and the Supreme People’s Procuratorate, actively provide plans for relevant research work of the China Law Society to them, report the research situation and relevant information, and timely understand the relevant situation in legislation and adjudication. Accept entrustment from relevant departments of legislative, administrative and judicial organs, and complete tasks. (Implemented by the research department).

11. Organize joint conferences with relevant legislative, administrative and judicial organs, conduct special subject research on major issues existing in legislation theory and practice, provide theoretical support for legislation and adjudication. (Implemented by the research department)

12. Through “Important News”, “Specialist News”, “Expert Commentary” and other forms, timely provide suggestions to relevant departments in areas of important legal research results and major legislation or adjudication, promote the transformation of research results into legislation, administrative law enforcement and adjudication. (Responsibility of the office, with the assistance of the research department)

13. Striving for the support of the Central Political-Legal Committee, recommending bodies’ cadres to be detached to legislative, administrative and judicial organs for training, engaging with reality and increasing their competence. (Implemented by the human affairs department)

14. Establishing joint mechanisms with economic circles, science and technology circles and all other social circles. Accept entrustment from all social circles, social organizations, enterprise and undertaking work units to launch topical research, provide legal consultancy and training to them. (Implemented by the research department)

V, Concerning concentrating forces to organize topical rule of law fora well.

15. Revolving around major problems in rule of law construction, organize the 2006 China Legal Expert Forum well. Organize it once or twice per year; organize the second Outstanding Young Legal Scholar Forum. Organize it once every two years. (Implemented by the research department)

16. Guide local law societies to continue to organize the “Changjiang Delta Rule of Law Forum” and the “Pearl River Delta Rule of Law Forum”, assist local law societies in performing all planning and preparation work for the “Bohai Rule of Law Forum”, the “Northeast Rule of Law Forum”, the “Western Region Rule of Law Forum” and the “Central Region Rule of Law Forum”. The China Law Society assists in determining topics for the fora, and provides the necessary support. (Implemented by the member department)

VI, Concerning perfecting legal research theme management, result appraisal and transformation mechanisms

17. Reforming and perfecting the “China Law Society Research Theme Management Rules”. Perfecting corresponding systems for topic management, strengthen work in topic programme establishment, expert appraisal, intermediate inspection, result examination and other areas; establish “Topic Guidebook” dissemination systems. Major topics relating to the larger picture, with a strong comprehensive nature, or are interdisciplinary, are organized and implemented by the China Law Society. (Implemented by the research departments)

18. Establishing the highest academic award in Chinese legal studies, the “China Excellent Legal Scholarly Result Award”. Start selections in 2007, organize it once every two years. This year, the preliminary preparation work must be done well. (Implemented by the research departments)

19. Further strengthen “Important News” work, earnestly formulate topic selection plans, and vigorously organize compilation, timely offer advice to the Centre and legislative organs, administrative organs and judicial organs. All organs’ departments and offices, all research associations and all local law societies shall vigorously provide legal research results, and provide material to “Important news”. (Implemented by the office)

VII, Concerning strengthening the opening up to the outside world of legal scholarly work

20. Implement the spirit of the nationwide law society foreign affairs work conference, strengthen guidance over the foreign exchange work of local law societies and research associations, shape the comprehensive state of foreign exchange. Provide opportunities to local law societies to participate in foreign legal scholarly reaching. In planning foreign study visits or reception programmes, pay attention to giving rein to the vigour of local law societies and research associations. (Implemented by the foreign exchange department)

21. Strengthen training for foreign affairs cadres, further raise the work capacity of foreign affairs work teams, strengthen the effectiveness of foreign legal scholarly exchange. (Implemented by the foreign exchange department)

22. Perfect the “Foreign Affairs Work Guidelines”, stress summarizing experiences in foreign affairs work, strengthen the scientific, systematized and standardized management of foreign affairs work. Compile the “Foreign-Oriented Legal Scholarly Exchange Trends”. (Implemented by the foreign exchange department)

VIII, Concerning strengthening propaganda of outstanding legal research results

23. Organizing the China Law Society website well. Integrate internal resources of the society, realize linkages with all websites of local law societies, all research associations as well as the legal scholarly circles, and departments related to legal circles, achieving information exchange and research sharing. (Implemented by the office)

24. Through “China Law Studies”, “Democracy and the Legal System”, the “China Law Yearbook” and other periodicals, propagate excellent law results and important laws. Strengthen work guidance and experience exchange through the “China Law Society” work periodical. (Implemented by the office)

25. Start the “100 Legal Scholars, 100 Research Seminars” activity in the second quarter of 2006. (Implemented by the office)

26. Strengthen cooperation with news media, establish news situation reporting systems, arrange one situation reporting meeting per quarter, provide newsgathering clues and newsgathering services to news work units (implemented by the office)

IX, Stimulating the fostering of legal talents

27. The annual focus theme research programme establishment and tendering must be tilted towards young and middle-age legal talents having research abilities, make them undertake more tasks, and stimulate them to mature even faster (implemented by the research department)

28. Launching selection and awards in the fifth “National Ten Great Outstanding Young Legal Scholars”, further perfect incentive mechanisms fostering legal talents. (Implemented by the research departments)

29. Formulate the “China Legal Academic Standards”, strengthen study style construction, raise the academic moral conception of legal research personnel. (implemented by the research department)

X, Strengthen guidance over organizing and promoting legal research work

30. The Presidential Meeting will research legal research work at least once per quarter, decide on legal research planning, topic guidance, major topical programmes, conference establishment and other major matters. (Responsibility of the research department, with the assistance of the office)

31. Vigorously raise legal research funding through many channels. Continue to strive for support from State finances. Expand cooperative research strength, use external funds to strengthen guarantees for legal research (implemented by the office and the research department)

32. All offices of the China Law Society organs and all directly subordinate undertaking work units must strengthen cooperation, and form force pools to organize and promote legal research.

中国法学会机关落实《中国法学会关于进一步繁荣法学研究的意见》 的实施方案
(2006年)
为贯彻落实《中国法学会关于进一步繁荣法学研究的意见》, 根据2005年12月9日会长办公会议的要求,在综合学会机关各部室意见的基础上,提出如下实施方案:
一、关于用发展着的马克 思主义指导法学研究
1.加强对法学研究状况的经常性分析。每半年对法学研究理论动态和研究队伍的思想动态作一综合性分析报告。(研究部落 实)
2.设立中国特色社会主义法学建设工程。2006年召开“用发展中的马克思主义指导法学研究座谈会”,研究如何以发展着 的马克思主义为指导,建立健全完善中国特色社会主义法学体系。(研究部落实)
二、关于围绕社会主义建 设大局开展法学研究
3.根据《中国法学会五年工作发展规划纲要》和《中国法学会关于进一步繁荣法学研究的意见》, 确定2006年及今后一个时期的重点研究课题。主要包括:中国特色社会主义法学理论体系研究;科学发展观与依法治国理论与实 践研究;建设法治政府,推进依 法行政法律问题研究;建设社会主义新农村法律问题研究;自主创新法制保障研究;社会建设和社会管理法律制度研究;我国加入 WTO后过渡期法律问题研究;维 护社会稳定、司法体制改革、反腐败、尊重和保障人权等法律问题研究。(研究部落实)
4.围绕国家改革发展稳定大局,完善重点课题的设置、招标、投标、评价等机制。既要重视基础理论研究,更要重视应用研 究,着眼于解决实际问题。(研究部落实)
三、关于加强法学研究组 织体系建设
5.进一步完善研究会组织体系。落实《中国法学会所属研究会规则》,加强对现有研究会建设的指导,发挥各研究会在专业领 域的优势。推动建立新的研究会,为其提供指导和帮助。(研究部落实)
6.积极推动地方法学会健全研究会体系。对完成换届的法学会,要督促其设立相关的研究会,并围绕群众关心、党委和政府关 注、经济社会发展需要的问题, 开展学术研究活动。继续推进未换届的省和副省级城市法学会完成换届工作,推动法学研究组织建设,把建立健全研究会体系作为其 今后一个时期的重点工作。(会 员部、研究部落实)
7.2006年力争完成“中国法学会法学研究中心”的机构、编制的审批工作。在获准设立的前提下,边筹建,边开展工作。 (人事部落实)
8.进一步发挥中国法学会学术委员会的作用。充分发挥其在学术方面权威性强的优势,做好学术研究、评议和提供咨询服务等 工作。(研究部落实)
9.建立健全会员广泛参与法学研究的组织机制。通过课题、研讨会、年会、论坛、报告会、法学家巡回报告等形式,加强地方 法学会与研究会的合作。及时了 解和掌握各研究会的学术年会、研讨会和其他学术活动的信息,向地方法学会通报,积极组织会员参加。年初制定面向会员的学术讲 座、研讨和培训活动的计划,与 有关的地方法学会合作组织实施。紧密结合党和国家法制建设的重大举措,举办会员征文活动,评选优秀稿件结集出版。(会员部负 责、研究部协助)
四、关于加强合作,促进 法学理论与实际的紧密结合
10.建立与立法、行政和司法机关的合作机制。与全国人大、国务院、最高人民法院、最高人民检察院的有关部门建立工作联 系,主动向其提供中国法学会有 关研究工作的计划,通报研究情况和有关信息,并及时了解立法、司法的有关情况。接受立法、行政和司法机关有着部门的委托,完 成课题。(研究部落实)
11.与立法、行政和司法机关的有关部门联合举办研讨会,就立法理论和实践中存在的重大问题进行专题研究,为立法、司法 提供理论支持。(研究部落实)
12.通过《要报》、《专报》、《专家建议》等形式,及时向有关部门提供重要法学研究成果和重大立法、司法方面的建议, 推动研究成果转化到立法、行政执法和司法实践中。(办公室负责、研究部协助)
13.争取中央政法委员会的支持,推荐机关干部到立法、行政和司法机关挂职锻炼,接触实际,增长才干。(人事部落实)
14.建立与经济界、科技界和其他社会各界的合作机制。接受社会各界、社会团体、企事业单位的委托开展课题研究,为他们 提供法律咨询和培训。(研究部落实)
五、关于集中力量办好主 题法治论坛
15.围绕法治建设中的重大问题,办好2006年中国法学家论坛。每年举办一至两次;办好第二届杰出青年法学家论坛。每 两年举办一次。(研究部落实)
16.指导地方法学会继续办好“长三角法治论坛”、“泛珠三角法治论坛”;帮助地方法学会做好“环渤海法治论坛”、“东 北法治论坛”、“西部法治论坛”、“中部法治论坛”的各项筹备工作。中国法学会协助确定论坛主题,提供必要的支持。(会员部 落实)
六、关于完善法学研究课 题管理和成果评价、转化机制
17.修改完善《中国法学会研究课题管理办法》。完善课题管理的相关制度,加强课题立项、专家评议、中期检查、结果评审 等方面的工作;建立“课题指南”发布制度。关系全局、综合性强、跨学科的重大课题,由中国法学会组织实施。(研究部落实)
18.设立中国法学最高学术奖“中国优秀法学成果奖”。2007年开评,每两年评选一次。今年要做好前期准备工作。(研 究部落实)
19.进一步加强《要报》工作,认真制定选题计划,并积极组织编写,及时向中央和立法机关、行政机关、司法机关建言献 策。机关各部室、各研究会、各地方法学会应积极提供法学研究成果,为《要报》提供素材。(办公室落实)
七、关于加强法学工作的 对外开放
20.贯彻全国法学会外事工作会议精神,加强对地方法学会和研究会对外交流工作的指导,形成对外交流的整体态势。为地方 法学会、研究会同志提供参与对外法学交流的机会。在出访和接待项目的策划上,注重发挥地方法学会和研究会的积极性。(对外联 络部落实)
21.加强外事干部的培训,进一步提高外事工作队伍的工作能力,增强对外法学交流的实效。(对外联络部落实)
22.完善“外事工作指南”,注重外事工作的经验总结,加强外事工作科学化、系统化、规范化管理。编辑《对外法学交流动 态》。(对外联络部落实)
八、关于加强优秀法学研 究成果的宣传
23.办好中国法学会网站。整合学会内部资源,实现与各地方法学会、各研究会以及法学界、法律界相关部门网站的联网,做 到信息互通、资源共享。(办公室落实)
24.通过《中国法学》、《民主与法制》、《中国法律年鉴》等刊物,宣传优秀法学研究成果和重要法律。通过《中国法学 会》工作刊加强工作指导和经验交流。(办公室落实)
25.2006年第二季度启动“百名法学家百场报告会”活动。(办公室落实)
26.加强与新闻媒体的合作,建立新闻情况通报制度,每季度安排一次情况通报会,向新闻单位提供采访线索和采访服务。 (办公室落实)
九、促进法学人才培养
27.每年重点课题研究项目的立项、招标,要向有研究能力的中青年法学人才倾斜,使其承担更多的任务,促进其更快成长。 (研究部落实)
28.开展评选和表彰 第五届“全国十大杰出青年法学家”活动,进一步完善法学人才培养的激励机制。(研究部落实)
29.制定“中国法学学术规范”,加强学风建设,提高法学研究人员的学术道德观念。(研究部落实)
十、加强对组织推动法 学研究工作的领导
30.会长办公会议每季度至少研究一次法学研究工作,决定法学研究规划、课题指南、重大课题项目、研究会的组建等重大事 项。(研究部负责,办公室协助)
31.多渠道积极筹措法学研究经费。继续争取国家财政的支持。加大合作研究的力度,利用外部资金增强法学研究的保障。 (办公室、研究部落实)
32.中国法学会机关各部室、各直属事业单位要加强合作,形成组织推动法学研究的合力。
