Radio and Television Programme Production Business Management Regulations

Chapter I: General Provisions

Article 1: In order to persist in a correct radio and television programme orientation, stimulate the flourishing and development of the radio and television programme production industry, serve the construction of a socialist material civilization and spiritual civilization, according to relevant State law and regulations, these Regulations are formulated.

Article 2: These Regulations apply to establishment of radio and television programme production business organs or activities of engaging in production and programme copyright trade, agency trade, etc. of radio and television programmes such as special subject, special column, comprehensive arts, cartoons, radio dramas, television dramas, etc.

Organs especially engaging in radio and television advertisement programme production, their establishment and business activities are managed according to relevant laws and regulations such as the “Advertising Law”.

Article 3: The State Administration of Radio, Film and Television (hereafter simply named SARFT) is responsible for formulating nationwide radio and television programme production industry development plans, distribution and structure, managing guiding and supervising nationwide radio and television programme production business activities.

County-level or higher local administrative radio and television entities are responsible for radio and television programme production business activities’ management work within their administrative areas.

Article 4: The State establishes a permit system over establishing radio and television programme production business organs and engaging in radio and television programme production business activities.

For establishing radio and television programme production business organs and engaging in radio and television programme production business activities, a “Radio and Television Programme Production Business Permit” must be obtained.

Article 5: The State encourages domestic social organizations, enterprise and undertaking organs (not including wholly-foreign invested enterprises or Sino-foreign cooperative or contractual enterprises established within the borders) to establish radio and television programme production business organs or engage in radio and television programme production business activities.

Chapter II: The Programme Production Business Permit

Article 6: Applications for a “Radio and Television Programme Production Business Permit” shall conform to the State planning, distribution and structure related to radio and television programme production industry development, and shall meet the following conditions:

(1) having independent legal person qualifications, having an organ name, organizational structure and articles of association conform to the provisions of State laws and regulations;

(2) having radio and television and corresponding specialty personnel, funding and work premises suited to the requirements of the work scope, enterprise registered capital may not be less than 3.000.000 Yuan;

(3) during three years before the date of application, the legal representative not having a record of violating laws or regulations or the organ not having a record of a “Radio and Television Programme Production Business Permit” being revoked;

(4) other conditions as provided by laws and administrative regulations.

Article 7: When applying for a “Radio and Television Programme Production Business Permit”, applying organs shall at the same time submit the following materials to the examining and approving organ:

(1) an application report;

(2) radio and television programme production organ articles of association;

(3) a “Radio and Television Programme Production Business Permit” application form;

(4) main personnel materials:

1, legal representative identity certification (copy) and résumé;

2, main management personnel (no less than three individuals) radio and television and corresponding specialty résumés, outstanding achievements or participation in corresponding specialized training certification, etc.

(5) registered capital or capital verification certification;

(6) office premise certification;

(7) enterprise and undertaking work unit licence or the industry and commerce entity’s enterprise naming approval document.

Article 8: Central work units in Beijing and their subordinate organs applying for a “Radio and Television Programme Production Business Permit” report to SARFT for examination and approval; other organs applying for a “Radio and Television Programme Production Business Permit” raise an application with the administrative radio and television entity of their locality, and after progressive examination and verification, report to the provincial-level administrative radio and television entity for examination and approval.

Examination and approval organs shall make a decision on approval or non-approval within twenty working days of receiving complete application materials. To applying organs conforming to the provisions of Article 6 and Article 7 of these Regulations, a “Radio and Television Programme Production Business Permit” shall be issued; to applying organs not approved, the reasons for non-approval shall be explained in writing.

Provincial-level administrative radio and television entities shall within one week of making a decision of approval or non-approval, report the examination and approval situation to SARFT for filing.

The “Radio and Television Programme Production Business Permit” is uniformly printed by SARFT. The period of validity is two years.

Article 9: Enterprises approved and having obtained the “Radio and Television Programme Production Business Permit”, go to the administrative industry and commerce management entity to conduct registration or professional expansion formalities with the Permit.

Article 10: Organs already having obtained a “Radio and Television Programme Production Business Permit” that need to establish a radio and television programme production business branch organ having independent legal person qualifications in another province, must according to the provisions of Article 7 of these Regulations, apply for a “Radio and Television Programme Production Business Permit” with the provincial-level administrative radio and television entity of the branch organ’s locality, and report to the original examination and approval organ for filing; those establishing branch organs not with independent legal person qualifications, do not have to apply for a “Radio and Television Programme Production Business Permit” elsewhere.

Article 11: Radio stations and television stations established according to the law producing and operating radio and television programme s do not need to obtain a “Radio and Television Programme Production Business Permit” elsewhere.

Chapter III: The Television Drama Production Permit

Article 12: For television dramas produced by organs holding a “Radio and Television Programme Production Business Permit”, prefecture / city-level (included) or higher television stations (including radio and television stations, radio and television groups) and film production organs holding a “Film Shooting Permit”, it is only necessary to obtain a television drama production permit separately in advance.

Article 13: Television drama production permits are divided into the “Television Drama Production Permit (Level B)” and the “Television Drama Production Permit (Level A)”, uniformly printed by SARFT.

The “Television Drama Production Permit (Level B)” is only limited for use for the programme indicated on the permit, and its period of validity does not exceed 180 days. Under special circumstances and after approval by the permit-issuing entity, the period may be suitably lengthened.

The period of validity of the “Television Drama Production Permit (Level A)” is two years, and before the expiry of the period of validity, is valid for all television dramas produced by the permit-holding organ.

Article 14: The “Television Drama Production Permit (Level B)” is approved and issued by the provincial-level or higher administrative radio and television entity. Of those, central work units in Beijing and their subordinate organs directly raise applications with SARFT, other organs put forward applications with the administrative radio and television entity of their locality, and after progressive examination and verification, is reported to the provincial-level administrative radio and television entity for examination and approval.

Article 15: For applying for a “Television Drama Production Permit (Level B)”, the applying organ must submit the following application materials:

(1) an application report;

(2) a “Television Drama Production Permit (Level B) Application Registration Form”

(2) SARFT theme planning item approval document copies;

(4) a screenwriter authorization letter;

(5) copies of the contracts or cooperation letters of intents concluded by the applying organ with main creative personnel such as producers, directors, filmers, main actors, etc. and cooperating organs (investing organs) etc. Of those, if foreign main creative personnel participate in production, SARFT approval document copies must also be provided;

(6) the “Radio and Television Programme Production Business Permit” (copy) or corresponding qualification certification for television stations and film production organs;

(7) production funding implementation certification produced by permit-holding organs.

Article 16: Provincial-level administrative radio and television entities shall within one week after approving and issuing a “Television Drama Production Permit (Level B)”, report the approval and issuance situation to SARFT for filing.

Article 17: Where television drama production organs produce and complete six or more single dramas or three or more drama series (3 episodes or more per series) within two years, they may according to procedure apply with SARFT for “Television Drama Production Permit (Level A)” qualifications.

Article 18: For applying for a “Television Drama Production Permit (Level A)”, the applying organ must submit the following application materials:

(1) an application report;

(2) a “Television Drama Production Permit (Level A)” application form;

(3) the “Television Drama Production Permit (Level B)”s (copies) applied for during the last two years;

(4) the television drama catalogue produced and completed holding a “Television Drama Production Permit (Level B)” during the last two years and the corresponding “Television Drama Distribution Permits” (copies).

Article 19: After the period of validity of the “Television Drama Production Permit (Level A)” expires, permit-holding organs applying for extension, if conforming to the provisions of Article 17 of these Regulations and have no record of violating regulations, shall be granted extension; those not conforming to the abovementioned conditions, shall not be granted extension.

Article 20: Domestic radio and television broadcast organs and radio and television programme production business organs cooperating to produce radio and television programmes with foreign organs, report to SARFT according to regulations.

Chapter IV: Management

Article 21: Organs having obtained a “Radio and Television Programme Production Business Permit” shall strictly according to the production business scope approved by the permit launch programme activities.

Radio and television programmes such as current politics, news and similar topical and special column programmes, etc. can only be made by radio and television broadcast organs, other organs having obtained a “Radio and Television Programme Production Business Permit” may not produce radio and television programmes such as current politics, news and similar topical and special column programmes, etc.

Article 22: Radio and television programme production business activities must abide by the provisions of State laws, regulations and corresponding policies. It is prohibited to produce and operate programmes containing the following content:

(1) content contradicting the basic principles determined in the Constitution;

(2) content endangering the unity of the nation, sovereignty or territorial integrity;

(3) content that divulging State provisions, endangers national security or damages State  honour or interests;

(4) content that incites ethnic hatred or discrimination, undermines the solidarity of the ethnicities, or infringes upon ethnic customs and habits;

(5) content that propagates evil cults or superstition;

(6) content that disturbs public order or destroys public stability;

(7) content that propagates obscenity, gambling, violence or instigates crimes;

(8) content that insults or slanders others, or infringes upon the lawful rights and interests of others;

(9) content that endangers public ethics or excellent folk cultural traditions;

(10) other content prohibited by laws, regulations or State provisions.

Article 23: Production of radio and television programmes with major revolutionary and history themes such as television dramas, theoretical reference television special subject films, etc., must be implemented according to relevant SARFT regulations.

Article 24: For distribution and broadcast of radio and television programmes such as television dramas, cartoons, etc., the corresponding distribution permit must be obtained.

Article 25: Radio and television broadcasting organs may not broadcast television dramas and cartoons produced by organs not having obtained a “Radio and Television Programme Production Business Permit” or not having obtained a distribution permit.

Article 26: It is prohibited to in any way alter, rent or lend, transfer, sell or forge the “Radio and Television Programme Production Business Permit” and the “Television Drama Production Permit”.

Article 27: Where change occurs in the production organs name, legal representatives, address and articles of association listed in the “Radio and Television Programme Production Business Permit” of the “Television Drama Production Permit (Level A)” or the production organ name, drama name, episode number listed in the “Television Drama Production Permit (Level B)”, etc., the permit-holding organ shall report to the original permit-issuing organ to fulfil modification examination and approval formalities; for termination of radio and television programme production business activities, cancellation formalities must be conducted with the original permit-issuing organ within one week.

Article 28: The “Radio and Television Programme Production Business Permit” and the “Television Drama Production Permit” approval and issuance situation will be announced to society by SARFT.

Chapter V: Punitive provisions

Article 29: Those violating these Regulations, will be punished according to the “Radio and Television Management Regulations”. Where it constitutes a crime, criminal liability will be investigated according to the law.

Chapter VI: Supplementary provisions

Article 30: These Regulations take effect on 20 August 2004. The Ministry of Radio, Film and Television “Provisional Television Production Business Organ Management Regulations” (MRFT Decree No. 16), “Television Drama Production Permit Management Regulations” (MRFT Decree No. 17) and the SARFT “Implementation Regulations Concerning Implementing a Radio and Television Programme Production and Distribution Sector Access System (Trial)” (SSO No. (2001)1476) are abolished at the same time.

广播电视节目制作经营管理

第一章

第一条  为坚持广播电视节目正确导向,促进广播电视节目制作产业繁荣发展,服务社会主义物质文明和精神文明建设,根据国家有关法律、法规,制定本规定。

第二条  本规定适用于设立广播电视节目制作经营机构或从事专题、专栏、综艺、动画片、广播剧、电视剧等广播电视节目的制作和节目版权的交易、代理交易等活动的行为。
    
    专门从事广播电视广告节目制作的机构,其设立及经营活动根据《广告法》等有关法律、法规管理。

第三条  国家广播电影电视总局(以下简称广电总局)负责制定全国广播电视节目制作产业的发展规划、布局和结构,管理、指导、监督全国广播电视节目制作经营活动。   
    县级以上地方广播电视行政部门负责本行政区域内广播电视节目制作经营活动的管理工作。

第四条  国家对设立广播电视节目制作经营机构或从事广播电视节目制作经营活动实行许可制度。
    
    设立广播电视节目制作经营机构或从事广播电视节目制作经营活动应当取得《广播电视节目制作经营许可证》。

第五条  国家鼓励境内社会组织、企事业机构(不含在境内设立的外商独资企业或中外合资、合作企业)设立广播电视节目制作经营机构或从事广播电视节目制作经营活动。

第二章 目制作经营业务许

第六条  申请《广播电视节目制作经营许可证》应当符合国家有关广播电视节目制作产业发展规划、布局和结构,并具备下列条件:

(一)具有独立法人资格,有符合国家法律、法规规定的机构名称、组织机构和章程;

(二)有适应业务范围需要的广播电视及相关专业人员、资金和工作场所,其中企业注册资金不少于300万元人民币;

(三)在申请之日前三年,其法定代表人无违法违规记录或机构无被吊销过《广播电视节目制作经营许可证》的记录;

(四)法律、行政法规规定的其他条件。

第七条  申请《广播电视节目制作经营许可证》,申请机构应当向审批机关同时提交以下材料:

(一)申请报告;

(二)广播电视节目制作经营机构章程;

(三)《广播电视节目制作经营许可证》申领表;

(四)主要人员材料:

1、法定代表人身份证明(复印件)及简历;

2、主要管理人员(不少于三名)的广播电视及相关专业简历、业绩或曾参加相关专业培训证明等材料。

(五)注册资金或验资证明;

(六)办公场地证明;

(七)企事业单位执照或工商行政部门的企业名称核准件。

第八条  在京的中央单位及其直属机构申请《广播电视节目制作经营许可证》,报广电总局审批;其他机构申请《广播电视节目制作经营许可证》,向所在地广播电视行政部门提出申请,经逐级审核后,报省级广播电视行政部门审批。   
    审批机关应在收到齐备的申请材料之日起的二十个工作日内做出批准或不批准的决定。对符合本规定第六条、第七条规定的,应为申请机构核发《广播电视节目制作经营许可证》;对不批准的,应向申请机构书面说明不予批准的理由。
    
    省级广播电视行政部门应在做出批准或不批准决定之日起的一周内,将审批情况报广电总局备案。   
    《广播电视节目制作经营许可证》由广电总局统一印制。有效期为两年。

第九条  经批准取得《广播电视节目制作经营许可证》的企业,凭许可证到工商行政管理部门办理注册登记或业务增项手续。

第十条  已经取得《广播电视节目制作经营许可证》的机构需在其他省、自治区、直辖市设立具有独立法人资格的广播电视节目制作经营分支机构的,须按本规定第七条的规定,向分支机构所在地的省级广播电视行政部门另行申领《广播电视节目制作经营许可证》,并向原审批机关备案;设立非独立法人资格分支机构的,无须另行申领《广播电视节目制作经营许可证》。

第十一条  依法设立的广播电台、电视台制作经营广播电视节目无需另行申领《广播电视节目制作经营许可证》。

第三章 电视剧制作

第十二条  电视剧由持有《广播电视节目制作经营许可证》的机构、地市级(含)以上电视台(含广播电视台、广播影视集团)和持有《摄制电影许可证》的电影制片机构制作,但须事先另行取得电视剧制作许可。

第十三条  电视剧制作许可证分为《电视剧制作许可证(乙种)》和《电视剧制作许可证(甲种)》两种,由广电总局统一印制。

《电视剧制作许可证(乙种)》仅限于该证所标明的剧目使用,有效期限不超过180日。特殊情况下经发证机关批准后,可适当延期。

《电视剧制作许可证(甲种)》有效期限为两年,有效期届满前,对持证机构制作的所有电视剧均有效。

第十四条  《电视剧制作许可证(乙种)》由省级以上广播电视行政部门核发。其中,在京的中央单位及其直属机构直接向广电总局提出申请,其他机构向所在地广播电视行政部门提出申请,经逐级审核后,报省级广播电视行政部门审批。

第十五条  申领《电视剧制作许可证(乙种)》,申请机构须提交以下申请材料:

(一)申请报告;

(二)《电视剧制作许可证(乙种)申领登记表》;

(三)广电总局题材规划立项批准文件复印件;

(四)编剧授权书;

(五)申请机构与制片人、导演、摄像、主要演员等主创人员和合作机构(投资机构)等签定的合同或合作意向书复印件。其中,如聘请境外主创人员参与制作的,还需提供广电总局的批准文件复印件;

(六)《广播电视节目制作经营许可证》(复印件)或电视台、电影制片机构的相应资质证明;

(七)持证机构出具的制作资金落实证明。
    
    第十六条  省级广播电视行政部门应在核发《电视剧制作许可证(乙种)》后的一周内将核发情况报广电总局备案。

第十七条  电视剧制作机构在连续两年内制作完成六部以上单本剧或三部以上连续剧(3集以上/部)的,可按程序向广电总局申请《电视剧制作许可证(甲种)》资格。

第十八条  申领《电视剧制作许可证(甲种)》,申请机构须提交以下申请材料:

(一)申请报告;

(二)《电视剧制作许可证(甲种)》申请表;

(三)最近两年申领的《电视剧制作许可证(乙种)》(复印件);

(四)最近两年持《电视剧制作许可证(乙种)》制作完成的电视剧目录及相应的《电视剧发行许可证》(复印件)。

第十九条  《电视剧制作许可证(甲种)》有效期届满后,持证机构申请延期的,如符合本规定第十七条规定且无违规纪录的,准予延期;不符合上述条件的,不予延期。

第二十条  境内广播电视播出机构和广播电视节目制作经营机构与境外机构合作制作广播电视节目,按有关规定向广电总局申报。

第四章

第二十一条  取得《广播电视节目制作经营许可证》的机构应严格按照许可证核准的制作经营范围开展业务活动。

广播电视时政新闻及同类专题、专栏等节目只能由广播电视播出机构制作,其他已取得《广播电视节目制作经营许可证》的机构不得制作时政新闻及同类专题、专栏等广播电视节目。

第二十二条  广播电视节目制作经营活动必须遵守国家法律、法规和有关政策规定。禁止制作经营载有下列内容的节目:

(一)反对宪法确定的基本原则的;

(二)危害国家统一、主权和领土完整的;

(三)泄露国家秘密、危害国家安全或者损害国家荣誉和利益的;

(四)煽动民族仇恨、民族歧视,破坏民族团结,或者侵害民族风俗、习惯的;

(五)宣扬邪教、迷信的;

(六)扰乱社会秩序,破坏社会稳定的;

(七)宣扬淫秽、赌博、暴力或者教唆犯罪的;

(八)侮辱或者诽谤他人,侵害他人合法权益的;

(九)危害社会公德或者民族优秀文化传统的;

(十)有法律、行政法规和国家规定禁止的其他内容的。

第二十三条  制作重大革命和历史题材电视剧、理论文献电视专题片等广播电视节目,须按照广电总局的有关规定执行。

第二十四条  发行、播放电视剧、动画片等广播电视节目,应取得相应的发行许可。

第二十五条  广播电视播出机构不得播放未取得《广播电视节目制作经营许可证》的机构制作的和未取得发行许可的电视剧、动画片。

第二十六条  禁止以任何方式涂改、租借、转让、出售和伪造《广播电视节目制作经营许可证》和《电视剧制作许可证》。

第二十七条  《广播电视节目制作经营许可证》和《电视剧制作许可证(甲种)》载明的制作机构名称、法定代表人、地址和章程、《电视剧制作许可证(乙种)》载明的制作机构名称、剧名、集数等发生变更,持证机构应报原发证机关履行变更审批手续;终止广播电视节目制作经营活动的,应在一周内到原发证机关办理注销手续。

第二十八条  《广播电视节目制作经营许可证》和《电视剧制作许可证》的核发情况由广电总局向社会公告。

第五章

第二十九条  违反本规定的,依照《广播电视管理条例》进行处罚。构成犯罪的,依法追究刑事责任。

第六章

第三十条  本规定自2004年8月20日起施行。广播电影电视部《影视制作经营机构管理暂行规定》(广播电影电视部令第16号)、《电视剧制作许可证管理规定》(广播电影电视部令第17号)和广电总局《关于实行广播电视节目制作、发行行业准入制度的实施细则(试行)》(广发办字〔2001〕1476号)同时废止。
