Provisional Rules concerning Newspaper Publishers, Periodical Publishers and Publishing Houses Launching Paid-For Services and Commercial Activities

In order to implement the spirit of the 13th Party Congress concerning accelerating and deepening reform, correctly guiding newspaper publishers, periodical publishers and publishing houses in running newspapers and periodicals well, and publishing good books, and in appropriately launching other commercial matters permitted by State regulations and policies under the precondition of doing their own work and duties well, stimulate the development of our country’s newspaper, periodical and book publishing undertaking, serve the construction of the “two civilizations” even better, on the basis of relevant State provisions, these Rules are formulated.

I, Newspaper publishers, periodical publishers and publishing houses shall correctly deal with the relationship between doing their own work and duties well and other commercial activities, an, at the same time as paying attention to economic interest, put social interest first. Newspaper publishers, periodical publishers and publishing houses may, on the basis of relevant regulations and their own conditions, give rein to their superiority in extensive integration as well as information, talented personnel, technology, knowledge, facilities, equipment and other aspects, and launch paid-for services and commercial activities where permitted by State policies, that are related to their own business.

II, Newspaper publishers, periodical publishers and publishing houses may, after carrying out State-provided examination and approval formalities, launch the following paid-for services and commercial activities:

1. They may concurrently run advertising business. All those having put forward an application with the administrative industry and commerce management organ, have been examined and approved, and have obtained an “Advertising Business Permit”, may publish advertising within the permitted scope.

2. They may use information in economic, scientific, technological, cultural, educational, legal, hygiene, life and other fields to provide paid-for consulting services to society. All those establishing consulting service business organs shall apply for registration handling with the administrative industry and commerce management organ, and may only engage in commercial activities after approval and being issued with a “Business Licence”.

3. With approval of relevant departments, they may run related cultural exchange activities or literature and art activities.

4. They may, together with enterprises or the controlling department of enterprises, jointly organize news conferences, information conferences as well as technology exchange and popularization activities.

5. With approval of the administrative industry and commerce management department, they may launch filming, duplication, film printing, photo printing and enlargement, platemaking and other paid-for service business activities. Those having funding, premises and other business conditions may also set up specialized salesrooms or business departments.

6. With approval of and registration by the administrative industry and commerce management department, they may also establish reader service departments.

7. With approval of relevant departments, they may organize all sorts of lectures, training classes, tutorial classes, correspondence schools and other culture and education activities.

III, Newspaper publishers, periodical publishers may, with approval of the controlling organ, and integrating their own business and social need, run economic entities (such as paper mills, printing plants, etc.). After administrative industry and commerce management organ approval and registration, they may engage in commercial activities according to the law.

IV, Companies or enterprises run by newspaper publishers or periodical publishers, may without exception not engage in pure commercial activities unrelated to their own business.

V, Commercial activities of newspaper publishers, periodical publishers and publishing houses shall fall under the responsibility of the business department. Editors and journalists may provide information, but may not derive individual remuneration from the information they provide, and may not participate in commercial activities.

VI, Newspaper publishers, periodical publishers and publishing houses shall strengthen leadership and management over commercial activities. Higher-level controlling departments and administrative industry and commerce management organs must provide guidance and support. Financial issues in commercial activities are to be handled according to relevant State regulations.

VII, Newspaper publishers, periodical publishers and publishing houses launching commercial activities shall persist in the correct business orientation, abide by State regulations and policies, implement financial discipline, and accept supervision and management from finance, administrative industry and commerce management, taxation, banking, pricing, auditing and other departments.

VIII, These Rules take effect on 1 April 1988.

 

关于报社、期刊社、出版社开展有偿服务和经营活动的暂行办法

为贯彻落实党的十三大关于加快和深化改革的精神,正确引导报社、期刊社、出版社在办好报刊、出好图书,做好本职工作的前提下,适当开展国家法规、政策允许的其他经营项目,促进我国报刊和图书出版事业的发展,更好地为“两个文明”建设服务,根据国家有关规定,特制订本办法。
一、报社、期刊社、出版社应当正确处理好本职工作和其他经营活动的关系,在注意经济效益的同时,把社会效益放在首位。报社、期刊社、出版社可以根据有关规定和本身的条件,发挥其联系面广以及信息、人才、技术、知识、设备器材等方面的优势,开展国家政策允许的、与本身业务有关的有偿服务和经营活动。
二、报社、期刊社、出版社,在履行国家规定的审批手续后,可以开展下列有偿服务和经营活动:
1.可以兼营广告业务。凡向工商行政管理机关提出申请,经审查批准,领取《广告经营许可证》的,可在许可范围内发布广告。
2.可以利用经济、科技、文化、教育、法律、卫生、生活等方面的信息,为社会提供有偿咨询服务。凡成立咨询服务经营机构的,应当向工商行政管理机关申请办理登记,经核准发给《营业执照》后,方可从事经营活动。
3.经有关部门批准,可以举办有关的文化交流活动或文艺活动。
4.可以同企业或企业的主管部门联合举办新闻发布会、信息发布会,以及技术交流推广活动。
5.经工商行政管理机关核准,可以面向社会开展摄影、复印、影印、洗(扩)印、制版等有偿服务业务。具备资金、场地和其他经营条件的,还可以设立专业性的门市部或经营部。
6.经工商行政管理机关核准登记,还可以成立读者服务部。
7.经有关部门批准,可以举办各种讲座、培训班、辅导班、函授学校等文教活动。
三、报社、期刊社经主管机关批准,可以结合本身业务和社会需要,举办经济实体(如造纸厂、印刷厂等)。经工商行政管理机关核准登记后,依法从事经营活动。
四、报社、期刊社举办的公司、企业,均不得从事与本身业务无关的纯商业经营。
五、报社、期刊社、出版社的经营活动,应由经营部门负责。编辑、记者可提供信息,但不得从所提供的信息服务中提取个人报酬,不得参加经营活动。
六、报社、期刊社、出版社应加强对经营活动的领导和管理。上级主管部门和工商行政管理机关要给予引导和支持。经营活动的财务问题,按国家有关规定执行。
七、报社、期刊社、出版社开展经营活动,应坚持正确的经营方向,遵守国家的法规政策,执行财经纪律,接受财政、工商行政管理、税务、银行、物价、审计等部门的监督管理。
八、本办法于1988年4月1日起施行。
