The “Provisional Film Examination Regulations” were passed at the ministerial meeting on 21 April 1993, and are hereby promulgated and implemented.

Provisional Film Examination Regulations

Chapter I: General Provisions

Article 1: In order to persist in the orientation of culture and art serving the people and serving socialism, making film creation and production flourish, protect the lawful rights and interests of film producers and consumers, according to the Constitution and relevant laws, these Provisional Regulations (hereafter named Regulations” are formulated.

Article 2: Film as named in these Regulations includes:

(1) feature films (including stage and opera art films);

(2) fine art films (including cartoons, puppetry and paper-cutting films, etc.);

(3) science and education films;

(4) news and documentary films.

Article 3: These regulations apply to films, film videotapes and film discs of all forms, different widths and different carriers that are publicly screened and broadcasted in our country and exported.

Article 4: Final film examination powers belong to the Ministry of Radio, Film and Television. The Ministry of Radio, Film and Television authorizes the Film Undertaking Management Bureau (hereafter named Film Bureau) to act as film examination organ and take care of film examination work.

Chapter II: The examination organ’s duties

Article 5: Where the film examination organ examines films, it shall exercise the following duties:

(1) examining and approving or prohibiting domestic films and imported films to be publicly screened in our country;

(2) examining and approving or prohibiting domestic film export;

(3) putting forward revision opinions to films that can only be permitted to be publicly screened or exported after editing or revision;

(4) issuing film public screening, export and import permits;

(5) confiscating films publicly screened without approval;

(6) other powers.

Article 6: Where the film examination organ examines films, it undertakes the following duties:

(1) for films of which examination is applied for, putting forward a written examination within 10 days after receiving an application report and materials;

(2) for films having passed examination, handling the issue of a public screening and export permit;

(3) reporting the examination result of every film to the Ministry of Radio, Film and Television;

(4) other duties.

Chapter III: Applications

Article 7: Film holders (referring to film producers or those specializing in film import, specializing in film recording, specializing in film discs. Similar hereafter) shall before public film screening or export, put forward a written application with the film examination organ, and submit the following materials and a written report form:

(1) for domestic films, submit one complete film (during the examination procedure, first submit a double recording tape set). For imported films, submit one complete film (during the examination procedure, first provide one original copy, or one videotape, or one laser disc).

(2) an application report in duplicate. The application report content includes:

1, the film name;

2, the screenwriter’s full name (if concerning an adapted work, the name of the original work and the full name of the author must be indicated);

3, the producer’s name, the full names and résumés of main creative personnel such as screenwriters, directors, filmers, art designers, lyric writers, composers, actors;

4, the main film content or plot outline;

5, a written opinion of the writer of an adapted work agreeing with film shooting;

6, film specifications (length, width, colour type, language, sound standard, etc.);

7, a contract or agreement letter with domestic or foreign producers for co-produced films;

8, the original shooting country, region, studio name and publishing date of imported films;

9, the original language script or plot outline of imported films;

10, the approval letter of producers (or distributors) of foreign films agreeing with public screening of that film in our country;

11, when applying for examination of a science and education film or documentary, it is necessary to write on the report form the opinions of the controlling authority relevant to the content of that film. Where the film producer has a different opinion from the controlling authority and State entities, the film holder shall simultaneously report the different opinions;

12, the film holder’s reasons for examination application;

13, other matters that must be explained.

(3) when reporting completed domestic films, it is necessary to include a technological appraisal card, and written material on the double-recording reform situation.

Article 8: For film examination applications, examination films must be paid.

Chapter IV, Examination

Article 9: The film examination organ shall grant examination to film examination applications conforming to Article 7 and Article 8 of these Regulations.

Article 10: Examined films having one of the following contents, shall be prohibited from screening:

(1) violating our country’s Constitutions and laws;

(2) harming State interest, social stability, ethnic dignity and ethnic unity;

(3) violating present major State policies;

(4) violating socialist public moral norms;

(5) violating science, propagating superstition;

(6) having strong sensual stimulation, propagating pornography, exposure, violence or detailed description of criminal methods;

(7) having content and plot details violating the spiritual and mental health of minors, or inducing minors to be degenerate;

(8) other content and details that should be prohibited.

Article 11: Publicly screened film technology quality, shall be examined according to relevant technological standards.

Article 12: Film examination decisions (approving or prohibiting public screening, or public screening after revision), are valid after being stamped by the film examination organ.

Article 13: Where the film examination organ is not certain whether or not films can be publicly screened or exported, or when film holders and relevant entities put forward important objections concerning the film examination decision, the film examination organ shall report that film to the Ministry of Radio, Film and Television for final examination and to make a decision.

Article 14: Film holders shall according to the public screening localities and scope approved by the film examination organ distribute, screen and broadcast films.

Article 15: Examination of science and education films and documentary films needed to be exported or imported for scientific research or education (not for public screening), is the responsibility of the Ministry of Radio, Film and Television and all provincial, autonomous region and municipal People’s Governments’ relevant entities with reference to these Regulations. Examination results are reported to the Ministry of Radio, Film and Television film examination organ for filing.

Article 16: Of films already examined and approved, and publicly screened, because of the following reasons, the film examination organ shall on the basis of Article 10 of these Regulations conduct re-examination;

(1) the plot requires change;

(2) the film name requires replacement;

(3) disappearance of the original reason for editing, revision or prohibition of public screening.

Article 17: All levels’ administrative film management entities have the powers to examine the situation concerning implementation of these Regulations in their jurisdictions.

Chapter V: Punitive provisions

Article 18: For violations of Article 10 and Article 14 of these Provisions, the administrative film management entity of their localities have the power to confiscate the illegal income of the relevant screening venue, and impose a fine of 10.000 Yuan or less, and order closure for three to five days. Where circumstances are grave, the judicial organs shall investigate the legal liability of these directly responsible.

Article 19: For openly screening domestic or imported films without film examination organ approval, the film examination organ and the local administrative film management entity have the power to confiscate those films, and impose a fine of 100.000 Yuan or less, and order closure for three to five days. Where circumstances are grave, the judicial organs shall investigate the legal liability of these directly responsible.

Article 20: For violations of Article 22 of these Regulations, the local administrative film management entity shall impose a fine of 5.000 Yuan or less.

Article 21: For film examination personnel violating these Regulations, neglecting their duty and creating damage, the film examination organ shall investigate administrative liability of that party.

Chapter VI: Supplementary provisions

Article 22: Film advertisements and propaganda products shall conform to film content and may not contain sexual or violent content.

Article 23: The film examination organ does not examine feature films that been shot by producers without State administrative film management approval.

Article 24: Fee standards for examination fees paid for film examination applications, public film screening and export permit cost fees, and relevant formality fee standards, shall be formulated by the Film Bureau.

Article 25: Confiscated films shall be submitted to the Film Bureau for storage.

Article 26: Interpretation of these Regulations is the responsibility of the Ministry of Radio, Film and Television.

Article 27: These regulations take effect on the day of promulgation. All relevant regulations not conforming to these Regulations are abolished without exception.

  第一章 总 则 

  第一条 为了坚持文艺为人民服务、这社会主义服务的方向,繁荣电影创作的生产,保护电影生产者和消费者的合法权益,根据宪法及有关法律,特制定本暂行规定(下称规定)。 

  第二条 本规定所称电影片包括: 

  (一) 故事影片(含舞台、戏剧艺术片); 
  (二) 美术影片(含动画、木偶、剪纸片等); 
  (三) 科学教育影片; 
  (四) 新闻纪录影片; 

  第三条 本规定适用于在我国和输出公开放映、播放的各种形式、不同宽度、不同载体的电影片、电影录像带和电影视盘等。 

  第四条 电影终审权属广播电影电视部。 广播电影电视部授权电影事业管理局(下称电影局)作为电影审查机构主持电影审查工作。 

  第二章 审查机构的职责 

  第五条 电影审查机构审查电影片,行使以下职权: 

  (一) 审查批准或禁止国产电影片和输入电影片在我国公映; 
  (二) 审查批准或禁止国产电影片输出; 
  (三) 对需删剪、修改后才准公映、输出的电影片,提出修改意见; 
  (四) 颁发电影片公映、输出、输入许可证; 
  (五) 没收未经批准公开放映的电影片; 
  (六) 其他权利。 

  第六条 电影审查机构审查电影片,承担以下义务: 

  (一) 对申请审查的电影片,在接到申请报告单及实物10日内提出书面审查意见; 
  (二) 对审查通过的电影片,办理发放公映、输出许可证; 
  (三) 将每部影片的审查结果,报广播电影电视部; 
  (四) 其他义务。 

  第三章 申 请 

  第七条 电影片持有人(指制片者或专营输入电影片者、专营电影录像片者、专营电影视盘者。下同)应在电影片公映、输出前,向电影审查机构提出书面申请,并提交以下实物和书面报告单: 

  (一) 国产电影片,提交完成片一部(审查过程中,先提供混录双片一套)。进口电影片,提交完成片一部(审查过程中,先提供原拷贝一个,或录像带一盘,或激光视盘一个)。 
  (二) 申请审查报告单一式二份。报告单内容包括: 

  1、 电影片名; 
  2、 编剧姓名(如系改编作品,需写明原作品名称、作者姓名); 
  3、 制片者名称,编剧、导演、摄影、美工、作词、作曲、演员等主要创作人员 姓名及简介; 
  4、 电影片主要内容或故事梗概; 
  5、 改编作品的原作者同意摄制电影的书面意见; 
  6、 电影片规格(长度、宽度、色别、语种、还音制式等); 
  7、 与国内外制片者合作拍摄电影片的合同书或协议书; 
  8、 输入电影片的原摄制国家、地区、厂家名称和出品日期; 
  9、 输入电影片的原文剧本或故事梗概; 
  11、申请审查科学教育影片及纪录片,要在报告单上填写与该影片内容有关的主 主管部门的意见。制片者与主管部门和国家机关如有不同意见,电影片持有人应将不同意见同时上报; 


  第八条 申请审查电影片要缴纳审查费。 

  第四章 审 查 

  第九条 申请审查电影片如符合本规定的第七条、第八条,电影审查机构应予审查。 第十条 被审查电影片有下列内容之一者,禁止公映: 

  (一) 违背我国宪法和法律; 
  (二) 损害国家利益、社会安定、民族尊严和民族团结; 
  (三) 违反国家现行重大政策; 
  (四) 违反社会主义公共道德规范; 
  (五) 违反科学,宣传迷信; 
  (六) 具有强烈感官刺激、宣传色情、裸露、暴力或详尽展示犯罪手段; 
  (七) 具有伤害未成年人身心健康、诱发未成年人堕落的内容和情节; 
  (八) 其他应禁止的内容和情节。 

  第十一条 公映电影片的技术质量,按有关技术标准进行审查。 

  第十二条 电影片的审查决定(批准和禁止公映,或修改后公映),由电影审查机 构加盖公章后生效。 

  第十三条 电影审查机构对电影片能否公映或输出无把握,或电影片持有人和有关部门对电影审查决定提出重要异议时,电影审查机构应将该电影片报请广播电影电视部终审,作出决定。 

  第十四条 电影片持有人应按照电影审查机构批准的公映地域和范围发行放映、播放电影片。 

  第十五条 因科研、教育需要输出或输入科学教育影片、纪录影片(非公映),由国务院有关部门和各省、自治区、直辖市人民政府有关部门参照本规定负责审查。审查结果报送广播电影电视部电影审查机构备案。 

  第十六条 已审定、公映的电影片,因有下列原因,电影审查机构应根据本规定第十条予以重审。 

  (一) 情节需变更; 
  (二) 片名需更换; 
  (三) 原删剪、修改或禁止公映的原因消失。 

  第十七条 各级电影行政管理部门有权检查本管辖区域执行本规定的情况。 

  第五章 罚 则 

  第十八条 对违反本规定第十条、第十四条者,其所在地的电影行政管理部门有权 没收有关放映场所的非法所得,处以1万元以下罚款,责令停业3日至5日。对情节严重者,由司法机关追究直接责任者的法律责任。 

  第十九条 公开放映未经电影审查机构批准的国产影片或输入影片,电影审查机构、所在地的电影行政管理部门有权没收该电影片,并处以10万元以下罚款,责令停业3日至5日。对情节严重者,由司法机关追究直接责任者的法律责任。 

  第二十条 对违反本规定第二十二条者,其所在地的电影行政管理部门应对其处以5千元以下罚款。 

  第二十一条 电影审查人员违反本规定、失职造成损失,电影审查机构应对当事人追究行政责任。 

  第六章 附 则 

  第二十二条 电影广告、宣传品应与电影片内容相符,不得含有色情、暴光力内容。 

  第二十三条 电影审查机构不审查未经国家电影行政管理部门批准的制片者摄制的故事影片。 

  第二十四条 申请审查电影片需缴纳的审查费和电影片公映、输出许可证的成本费及有关手续费标准,由电影局制定。 

  第二十五条 没收的电影片,送缴电影局保存。 

  第二十六条 本规定由广播电影电视部负责解释。 

  第二十七条 本规定自颁布之日起施行。凡与本规定不符的有关规定,一律废止。
