Newsgathering and editing team construction is an important component part of our country’s press undertaking development, strengthening and improving newsgathering and editing team management work is the essence for the long-term development of news media, and is a basis for strengthening the social credibility of news media. In the light of the problems existing in newsgathering and editing teams in recent years of fake news, paid-for news and using newsgathering activities to obtain improper benefits, it is necessary to progressively establish and perfect newsgathering and editing personnel bad professional behaviour record and registry systems nationwide, and through file management of bad professional behaviour, limiting and prohibiting newsgathering and editing personnel displaying grave problems of breaking the law to continue to engage in newsgathering and editing work, further cleaning up newsgathering and editing teams, restraining unlawful news activities, strengthening the construction of a sincerity and honesty construction in newsgathering and editing teams, establishing a healthy and orderly newsgathering order, and guaranteeing that journalists launch newsgathering and editing activities according to the law.

Newsgathering and Editing Personnel Bad Professional Behaviour Record and Registration Rules

Article 1: In order to standardize newsgathering and editing activities, clean up newsgathering and editing teams, contain unlawful news, establish a healthy and orderly newsgathering order, guarantee that news journalists launch newsgathering and editing activities according to the law, according to the State Council “Publishing Management Regulations”, the General Administration of Press and Publications “News Journalists Credential Management Rules” and relevant regulations, these Rules are formulated.

Article 2: These Rules apply to the management recording bad professional behaviour of personnel engaging in newsgathering and editing activities within the borders of the People’s Republic of China.

Article 3: Newsgathering and editing personnel as named in these Rules, refers to personnel within the personnel allotment of domestic news organ or officially appointed, specially engaging in newsgathering and editing position work.

Article 4: Bad professional activities of newsgathering and editing personnel as named in these rules includes the following aspects:

(1) applying for news journalist credentials by providing false or counterfeit certification documents and other cheating means;

(2) using the conveniences of newsgathering and editing work to engage in advertising, distribution and other commercial activities;

(3) engaging in newsgathering and editing activities within five years of cancellation of newspaper journalist credentials;

(4) activities of compiling false news, including fabricating things out of nowhere, and including purely fictitious matters when compiling news reporting; concealing facts, putting up false fronts and other methods, creating grave inconsistencies between news reports and the facts;

(5) engaging in paid-for news activities, including activities of publishing news reports and actively demanding or passively accepting monies or goods from newsgathering counterparts or persons with a relationship of interest, etc.

(6) practising favouritism and concealing news facts that should be reported, including actively demanding or passively accepting monies or goods from newsgathering counterparts or persons with a relationship of interest, etc., in order to not publish news.

(7) other seeking to gain improper benefits in the name of newsgathering, including utilizing public opinion supervision to conduct blackmail or retaliation, and other activities abusing newsgathering powers;

(8) being punished for criminal liability because of unlawful newsgathering and editing activities;

(9) other acts violating news publishing management laws, regulations, rules and other relevant provisions.

Article 5: The General Administration of Press and Publications is responsible for newsgathering and editing personnel bad professional behaviour recording, registration and management work; all local levels’ administrative press and publications are responsible for newsgathering and editing personnel bad professional behaviour recording and registry reporting and verification work in their administrative areas; all news organs are responsible for newsgathering and editing personnel bad professional behaviour recording and registry reporting work in their own news organs.

Article 6: All levels’ administrative press and publications departments and all news organs discovering that within that administrative area or that news organ, there are newsgathering and editing personnel suspected of exhibiting behaviour provided in Article 4 of these Rules, must conduct inspection according to relevant provisions, after conclusion of the inspection and obtaining corresponding evidence, a “Newsgathering and Editing Personnel Bad Professional Behaviour Record Registration Form” must be filled out according to the provision of these Rules. For those that should be punished for violating press and publications regulations and rules, the administrative press and publications department, before filling out the “Newsgathering and Editing Personnel Bad Professional Behaviour Record Registration Form”, imposes administrative punishment.

Article 7: All levels’ administrative press and publications departments’ administrative punishment decision letters and all levels’ People’s Courts decision letters and other effective documents may be used as evidence to establish a record of bad professional behaviour.

Article 8: All local levels’ administrative press and publications departments and all news organs, after signing a handling opinion on the “Newsgathering and Editing Personnel Bad Professional Behaviour Record Registration Form”, must attach corresponding valid evidence, and report it within ten days to the higher-level administrative press and publications department, after examination and verification by the provincial-level press and publications department, it is reported to the General Administration of Press and Publications for registration.

The General Administration of Press and Publications may conduct registry of newsgathering and editing personnel’s bad professional behaviour directly on the basis of these Rules.

Article 9: Provincial-level and higher administrative press and publications departments, before determining newsgathering and editing personnel bad professional behaviour records, shall notify the party concerned in advance about the facts, reasons and basis for recording newsgathering and editing personnel bad professional behaviour, the party concerned shall submit statements and pleadings within seven days of receiving the notification.

Where effective documents such as administrative punishment decision letters of administrative press and publications departments and judgment letters of People’s Courts, etc., are used as a basis to find newsgathering and editing personnel bad personal behaviour records, it is not necessary to separately notify the party concerned.

Article 10: The General Administration of Press and Publications, on the basis of the registration results, establishes a nationwide newsgathering and editing bad professional behaviour record inquiry system, and regularly reports bad professional behaviour with evil circumstances or creating grave influence, the social masses may inquire into bad professional behaviour records through the China Journalism Net.

Article 11: Personnel listed in bad records objecting to the finding of bad professional behaviour, may put forward a request to cancel the registration of bad records with the administrative press and publications department, and provide corresponding effective evidence, after re-investigation and verification by the provincial-level or higher administrative press and publications department, according to the re-investigation results, the General Administration of Press and Publications makes a decision to cancel the registration or not cancel the registration, and informs the party concerned in written form.

Article 12: All levels’ administrative press and publications departments and all news organs must strictly restrict personnel with bad records to continue to engage in newsgathering and editing work, and concerning those having bad professional behaviour as provided by Article 4 of these rules, from the day of registering the bad professional behaviour record, their engaging in newsgathering and editing work is restricted according to the  period in the following provisions:

(1) those having circumstances as provided in Article 4, Paragraph (1) or Paragraph (2) of these Rules, may not engage in newsgathering and editing work for three years;

(2) those having circumstances as provided in Article 4, Paragraph (3) of these Rules, have three years added to the period of work limitation;

(3) those having one of the circumstances as provided in Article 4, Paragraph (4) to Paragraph (7) of these Rules, or have their news journalist credentials revoked, may not engage in newsgathering and editing work for five years;

(4)  those having circumstances as provided in Article 4, Paragraph (8) of these Rules, may not engage in newsgathering and editing work for the rest of their life;

(5)  those having circumstances as provided in Article 4, Paragraph (9) of these Rules, in view of the gravity of the circumstances, may not engage in newsgathering and editing work for three to five years.

Article 13: After the work limit period of newsgathering and editing personnel having been listed in bad professional behaviour records expires, the General Administration of Press and Publications cancels the bad professional behaviour record registration, and preserves the bad professional behaviour record file.

Article 14: After newsgathering and editing personnel having been listed in bad professional behaviour regain newsgathering and editing professional qualifications, and they violate news publishing laws and regulations again within three years, they may not engage in newsgathering and editing work for the rest of their life.

Article 15: Where news organs conceal bad professional behaviour existing among that work unit’s personnel and do not report this, or delay reporting wilfully, the administrative press and publications may, in view of the gravity of the circumstances, adopt the following administrative measures:

(1) report for criticism;

(2) order open self-criticism

(3) order rectification;

(4) suspension of news journalist credential issuance

(5) delaying examination of annual inspection;

(6) charging the controlling work unit and sponsoring work unit to supervise rectification.

Article 16: These Rules are consulted and applied concerning non-newsgathering and editing personnel (including domestic news organs’ personnel in non-newsgathering and editing posts and other social persons) unlawfully engaging in newsgathering and editing activities.

Article 17: These Rules take effect from the date of promulgation.

各省、自治区、直辖市新闻出版局,新疆生产建设兵团新闻出版局,解放军总政治部宣传部新闻出版局,中央和国家机关各部委、各民主党派、各人民团体报刊主管部门,中央主要新闻单位:

新闻采编队伍建设是我国新闻事业发展的重要组成部分,加强和改进新闻采编队伍管理工作,是新闻媒体长远发展的根本,是增强新闻媒体社会公信力的基础。针对近年来新闻采编队伍中存在的虚假新闻、有偿新闻以及利用新闻采访活动谋取不正当利益等问题,有必要在全国逐步建立和完善新闻采编人员不良从业行为记录登记制度,通过不良行为记录的档案管理,限制和禁止存在严重违法问题的新闻采编人员继续从事新闻采编工作,进一步净化新闻采编队伍,遏制新闻违法活动,加强新闻采编队伍的诚信体系建设,建立健康有序的新闻采访秩序,保障新闻记者依法开展新闻采编活动。

现将《新闻采编人员不良从业行为记录登记办法》印发给你们,请结合实际认真贯彻执行。

新闻采编人员不良从业行为记录登记办法

第一条 为规范新闻采编行为,净化新闻采编队伍,遏制新闻违法活动,建立健康有序的新闻采访秩序,保障新闻记者依法开展新闻采编活动,根据国务院《出版管理条例》、新闻出版总署《新闻记者证管理办法》和有关规定,制定本办法。
第二条 本办法适用于中华人民共和国境内从事新闻采编活动的人员不良从业行为记录的管理。
第三条 本办法所称新闻采编人员,是指境内新闻机构编制内或者经正式聘用,专职从事新闻采编岗位工作的人员。
第四条 本办法所称的新闻采编人员不良从业行为包括以下方面:
(一)以提供虚假、伪造的证明文件等欺骗手段申领新闻记者证;
(二)利用新闻采编工作之便从事广告、发行等经营活动;
(三)被吊销新闻记者证且未满五年的人员从事新闻采编活动;
(四)编写虚假新闻,包括在采写新闻报道中采取凭空捏造,无中生有;隐瞒事实,制造假象等方式,造成发表的新闻报道与事实严重不符的行为;
(五)从事有偿新闻活动,包括为发表新闻报道而主动索取或者被动收受被采访对象或者利益关系人财物等行为;
(六)徇私隐匿应报道的新闻事实,包括为不发表新闻报道而主动索取或者被动收受被采访对象或者利益关系人财物等行为;
(七)其他以新闻采访为名谋取不正当利益,包括利用舆论监督进行敲诈勒索、打击报复等滥用新闻采访权利的活动;
(八)因新闻采编违法活动被追究刑事责任;
(九)其他违反新闻出版管理法规、规章等有关规定的行为。
第五条 新闻出版总署负责全国新闻采编人员不良从业行为记录的登记和管理工作;地方各级新闻出版行政部门负责本行政区域新闻采编人员不良从业行为记录登记的申报和审核工作;各新闻机构负责本新闻机构新闻采编人员不良从业行为记录登记的申报工作。
第六条 各级新闻出版行政部门和各新闻机构发现本行政区域或者本新闻机构内有新闻采编人员涉嫌存在本办法第四条规定的行为,须参照有关规定进行调查,调查终结并取得相关证据后,须按照本办法规定,填写《新闻采编人员不良从业行为记录登记表》。
对违反新闻出版法规规章应予处罚的,新闻出版行政部门须在填写《新闻采编人员不良从业行为记录登记表》前,依法做出行政处罚。
第七条 各级新闻出版行政部门的行政处罚决定书和各级人民法院的判决书等有效文书可以作为新闻采编不良从业行为记录的认定依据。
第八条 地方各级新闻出版行政部门和各新闻机构在《新闻采编人员不良从业行为记录登记表》签署处理意见后,须附相关有效证据,在十日内向上级新闻出版行政部门申报,经省级新闻出版行政部门审核后,报新闻出版总署登记。
新闻出版总署可以依据本办法直接对新闻采编人员不良从业行为记录进行登记。
第九条 省级以上新闻出版行政部门在确定新闻采编人员不良从业行为记录前,应事先向当事人告知拟将其列入新闻采编不良从业行为记录的事实、理由和依据,当事人应在接到告知书之日起七日内提出陈述和申辩。
以新闻出版行政部门的行政处罚决定书和人民法院的判决书等有效文书作为认定新闻采编不良从业行为记录依据的,无须另行告知当事人。
第十条 新闻出版总署根据登记结果建立全国新闻采编人员不良从业行为记录查询系统,定期通报情节恶劣或者造成严重影响的不良从业行为,社会公众可以通过中国记者网查询不良从业行为记录。
第十一条 被列入不良记录的人员对不良从业行为的认定存在异议,可向新闻出版行政部门申请撤销不良记录的登记,并提供相关有效证据,经省级以上新闻出版行政部门重新调查核实后,根据调查结果由新闻出版总署做出撤销登记或者不撤销登记的决定,并以书面形式告知当事人。
第十二条 各级新闻出版行政部门和各新闻机构须严格限制有不良记录的人员继续从事新闻采编工作,对存在本办法第四条规定的不良从业行为的,自不良从业行为记录登记之日起,按照以下规定期限限制从事新闻采编工作:
(一)存在本办法第四条第(一)项或者第(二)项规定情形的,三年内不得从事新闻采编工作;
(二)存在本办法第四条第(三)项规定情形的,限业期限增加三年;
(三)存在本办法第四条第(四)项至第(七)项规定情形之一或者被吊销新闻记者证的,五年内不得从事新闻采编工作;
(四)存在本办法第四条第(八)项规定情形的,终身不得从事新闻采编工作;
(五)存在本办法第四条第(九)项规定情形的,视情节严重程度,三至五年内不得从事新闻采编工作。
第十三条 被列入不良从业行为记录的新闻采编人员限业期满后,由新闻出版总署注销其不良从业行为记录登记,留存其不良从业行为记录档案。
第十四条 被列入不良从业行为记录的新闻采编人员重新获得新闻采编从业资格后,三年内再次违反新闻出版法规的,终身不得从事新闻采编工作。
第十五条 新闻机构对本单位人员存在的不良从业行为隐瞒不报,或者有意拖延缓报,新闻出版行政部门可视情节轻重,采取下列行政措施:
(一) 通报批评;
(二) 责令公开检讨;
(三) 责令改正;
(四) 暂停核发新闻记者证;
(五) 在年度核验中给予缓验;
(六) 责成主管单位、主办单位监督整改。
第十六条 非新闻采编人员(包括境内新闻机构的非新闻采编岗位工作人员和其他社会人员)违法从事新闻采编活动参照适用本办法。
第十七条 本办法自发布之日起施行。
